The case has been reassigned to Judge Dee Benson.<\/p>\n<p><!--more-->In December, Waddoups <a href=\"\/news\/finally-judge-acknowledges-utahs-right-to-defund-planned-parenthood\/\">ruled<\/a> that Utah had the right to decide for itself whether Planned Parenthood affiliates in the state received $275,000 in taxpayer&#8217;s money, which was to be redirected to local health care agencies. However, last month the 10th Circuit Court of Appeals <a href=\"\/news\/blatant-judicial-tyranny-blocks-utah-planned-parenthood-defunding\/\">placed<\/a> a preliminary injunction on the state&#8217;s effort to defund the abortion giant.<\/p>\n<p><a href=\"https:\/\/liveaction.org\/petition\/\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-68636\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/07\/DefundAd-400b.jpg\" alt=\"DefundAd-400b\" width=\"400\" height=\"170\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/07\/DefundAd-400b.jpg 400w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/07\/DefundAd-400b-300x128.jpg 300w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>This was despite the fact that, as Live Action News has <a href=\"\/news\/obama-admin-warns-states-its-illegal-to-defund-planned-parenthood\/\">previously covered<\/a>, states routinely exercise discretion over which organizations they deem appropriate to contract with, discretion which is not normally met with controversy or lawsuits.<\/p>\n<p>The change of judges could stack the deck further in Planned Parenthood&#8217;s favor, as Benson has <a href=\"http:\/\/www.nytimes.com\/1993\/05\/02\/us\/judge-temporarily-bars-utah-abortion-law.html\">issued<\/a> multiple <a href=\"http:\/\/www.deseretnews.com\/article\/614104\/Appeals-court-rejects-judges-dismissal-of-Utah-abortion-suit.html?pg=all\">rulings<\/a> against pro-life laws in the past.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Wednesday, U.S. District Judge Clark Waddoups has recused himself from the ongoing legal battle over whether Utah has the legal right to defund Planned Parenthood.
