{"id":98442,"date":"2016-07-30T18:26:57","date_gmt":"2016-07-30T22:26:57","guid":{"rendered":"\/news\/?p=98442"},"modified":"2016-08-31T14:04:00","modified_gmt":"2016-08-31T18:04:00","slug":"gary-johnson-admits-no-plans-to-protect-preborn-babies-or-religious-liberty","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/gary-johnson-admits-no-plans-to-protect-preborn-babies-or-religious-liberty\/","title":{"rendered":"Gary Johnson: I have &#8220;no intention of changing the law&#8221; to protect preborn babies"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Libertarian presidential nominee and former New Mexico Governor Gary Johnson <a href=\"https:\/\/www.johnsonweld.com\/personal_freedom\">rails against<\/a> the \u201csteady erosion\u201d of \u201cpersonal freedom in this country,\u201d \u201ca nation that was literally founded on the notion of liberty.\u201d But as Live Action\u2019s Adam Peters <a href=\"\/news\/gary-johnson-abortion-right-to-life\/\">details<\/a>, he doesn\u2019t particularly seem to care that babies\u2019 liberty has eroded to the point where they can be legally killed for any reason before even leaving the womb.<\/p>\n<p>This week, the Washington Examiner\u2019s Timothy Carney <a href=\"http:\/\/www.washingtonexaminer.com\/article\/2598088\">interviewed Johnson<\/a> at the Democrat National Convention he shared his views on abortion and that he wouldn\u2019t protect pro-life Americans\u2019 conscience rights.<\/p>\n<p><!--more--><\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\"><strong>CARNEY: Do you think the Constitution guarantees the right to abortion?<\/strong><\/p>\n<p style=\"padding-left: 30px;\">JOHNSON: The law of the land is Casey v. Planned Parenthood. I have no intention of changing the law, and Casey v. Planned Parenthood says, &#8220;you, woman, you have the right to have an abortion up to viability of the fetus.&#8221; And the Supreme Court has defined viability of the fetus as being able to sustain the life of the fetus outside of the womb, even by artificial means. That is the law of the land.<\/p>\n<\/blockquote>\n<p>So much for the idea that his pro-choice beliefs wouldn\u2019t get in the way of him benefiting the pro-life cause through a commitment to federalism and judicial appointments who follow the Constitution. In 2012, Johnson <a href=\"http:\/\/web.archive.org\/web\/20101227070504\/http:\/\/ouramericainitiative.com\/issues\/abortion.html\">at least believed<\/a> \u201cAny court decision that does not follow this original meaning of the Constitution should be revisited,\u201d accordingly condemning <em>Roe v. Wade<\/em> for \u201cexpand[ing] the reach of the Federal government into areas of society never envisioned in the Constitution.\u201d<\/p>\n<p>Under 2012 Johnson, \u201claws regarding abortion would be decided by the individual states,\u201d but 2016 Johnson has apparently decided that <a href=\"\/news\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">unconstitutional judicial precedent<\/a> shouldn\u2019t be challenged, and that states can\u2019t set their own laws about most abortions.<\/p>\n<p>Johnson had the following to say about laws that protect people from being forced to participate in things that violate their conscience:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">JOHNSON: But if we allow for discrimination \u2014 if we pass a law that allows for discrimination on the basis of religion \u2014 literally, we&#8217;re gonna open up a can of worms when it come stop discrimination of all forms, starting with Muslims \u2026 who knows. You&#8217;re narrowly looking at a situation where if you broaden that, I just tell you \u2014 on the basis of religious freedom, being able to discriminate \u2014 something that is currently not allowed \u2014 discrimination will exist in places we never dreamed of.<\/p>\n<p style=\"padding-left: 30px;\"><strong>CARNEY: Can the current federal RFRA [Religious Freedom Restoration Act] be applied to protect things like the wedding photographer and the Little Sisters of the Poor?<\/strong><\/p>\n<p style=\"padding-left: 30px;\">JOHNSON: The problem is I don&#8217;t think you can cut out a little chunk there. I think what you&#8217;re going to end up doing is open up a plethora of discrimination that you never believed could exist. And it&#8217;ll start with Muslims.<\/p>\n<\/blockquote>\n<p>The Federalist\u2019s David Harsanyi <a href=\"http:\/\/thefederalist.com\/2016\/07\/29\/gary-johnson-is-still-terrible-on-religious-liberty\/#.V5tjZupsmZZ.twitter\">boiled down<\/a> why this answer was nonsense:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">But religious freedom\u00a0laws are narrowly focused, and they don\u2019t permit people to \u201cdiscriminate\u201d on the \u201cbasis of religion.\u201d \u00a0They protect business owners of all faiths from the\u00a0obligation to participate in activities that violate their conscience \u2014\u00a0a slippery slope that doesn\u2019t seem to bother Johnson one bit. Denying a Muslim American service (something\u00a0Johnson,\u00a0<a href=\"http:\/\/reason.com\/blog\/2016\/01\/07\/gov-gary-johnson-on-burqa-ban-my-respons\">who once supported banning burkas<\/a>, seems most concerned about) would still be against the law.<\/p>\n<\/blockquote>\n<p>Indeed. As I\u2019ve <a href=\"\/news\/will-abortion-waiting-period-survive-satanists-religious-freedom-challenge\/\">explained before<\/a>, the RFRA simply establishes that \u201cGovernment may substantially burden a person\u2019s exercise of religion only if\u201d doing so not only serves a \u201ccompelling governmental interest,\u201d but also if it\u2019s the \u201cleast restrictive means\u201d of doing so. When applying those tests to the abortifacient mandate, the Supreme Court <a href=\"http:\/\/dailycaller.com\/2014\/07\/10\/six-myths-and-facts-about-the-hobby-lobby-decision\/\">found in the Hobby Lobby case<\/a> that the government had other, less coercive ways to provide people with contraceptives if they really wanted to. The path to this conclusion didn\u2019t run through any slippery slopes.<\/p>\n<p>Going beyond the overly-convoluted, post-Lockean gymnastics of modern jurisprudence and simply evaluating the issue by the sort of back-to-basics natural rights theory that libertarians like Johnnson are supposed to excel at, there\u2019s still not a slippery slope in sight. People have a right to follow the dictates of their conscience and\/or faith in how they use their own life, liberty, or property, unless and until doing so deprives others of <em>their<\/em> life, liberty, or property\u2014which simply and clearly establishes why these principles don\u2019t establish a legal precedent to harm someone in the name of one\u2019s religion.<\/p>\n<p>The right to choose not to spend one\u2019s own money on a particular item\u2014one that <a href=\"\/news\/glamour-lies-to-public-about-plan-b-abortifacient-nature\/\">kills other people<\/a>, in this case\u2014unmistakably falls within that sphere. An employer-employee relationship is a mutually-voluntary association that changes none of that (unless the former ever agreed to provide abortifacients in a contract, which is a separate issue).
