Three of the report\u2019s five authors had or later would have ties to the abortion industry.<\/p>\n<p><!--more-->The Journal of the American Medical Association defended the report and declined a pro-life research group\u2019s request for a retraction. However, the AMA publication\u2019s top editor recently said the study wasn\u2019t presented as the definitive, final word on the issue of fetal pain.<\/p>\n<p>But despite its being 11 years old, mainstream media outlets such as\u00a0<a href=\"http:\/\/www.nytimes.com\/2016\/05\/05\/us\/utah-abortion-law-fetal-anesthesia.html?_r=0\">The\u00a0New York Times<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.latimes.com\/nation\/la-na-utah-abortion-20160510-20160509-snap-story.html\">Los Angeles Times<\/a>\u00a0cited the study as authoritative in the recent debate over banning abortions after 20 weeks of pregnancy.<\/p>\n<p>The American Congress of Obstetricians and Gynecologists also has\u00a0<a href=\"http:\/\/www.acog.org\/~\/media\/Departments\/Government%20Relations%20and%20Outreach\/20120618DCAborStmnt.pdf\">cited<\/a>\u00a0the study during the debate over banning late-term abortions.<\/p>\n<p>\u201cThe paper\u2019s central argument is demonstrably false,\u201d said\u00a0James Agresti, president of\u00a0<a href=\"http:\/\/www.justfacts.com\/document\/jama_retraction_request_2.pdf\">Just Facts<\/a>, a fact-checking think tank that focuses on researching and publishing verifiable information about public policy issues.<\/p>\n<p>The authors of the American Medical Association\u2019s 2005 analysis argued that a developing human cannot feel pain until the cerebral cortex is fully formed. The cerebral cortex is the brain\u2019s outermost layer, which produces the ability to think and reason. The<a href=\"http:\/\/jama.jamanetwork.com\/article.aspx?articleid=201429\">\u00a0AMA\u00a0report says<\/a>:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Pain perception requires conscious recognition or awareness of a noxious stimulus. Neither withdrawal reflexes nor hormonal stress responses to invasive procedures prove the existence of fetal pain, because they can be elicited by nonpainful stimuli and occur without conscious cortical processing. \u2026 Evidence regarding the capacity for fetal pain is limited but indicates that fetal perception of pain is unlikely before the third trimester.<\/p>\n<\/blockquote>\n<p>At least two other studies,\u00a0<a href=\"http:\/\/iasp.files.cms-plus.com\/Content\/ContentFolders\/Publications2\/PainClinicalUpdates\/Archives\/PCU_XIV-2_June2006_Rev_Mar2012_1390263724028_20.pdf\">one in 2006<\/a>\u00a0by the journal Pain: Clinical Updates, and\u00a0<a href=\"http:\/\/www.karger.com\/Article\/Pdf\/338146\">one in 2012<\/a>\u00a0by researchers at the department of\u00a0anesthesiology at the University Hospitals Gasthuisberg in Belgium, concluded the opposite, determining the development of a cortex is not necessary for an unborn baby to feel pain.<\/p>\n<p>Nevertheless, in a<a href=\"http:\/\/retractionwatch.com\/wp-content\/uploads\/2016\/06\/download-pdf.pdf\">\u00a0June 14 letter<\/a>, Howard Bauchner, editor in chief of the Journal of the American Medical Association, told Agresti that after a review the publication\u2019s editors decided not to retract the 2005 article on the study.<\/p>\n<p>The authors, Bauchner argued, \u201chave included modifiers that reflect their review of the evidence available at the time, including uncertainty.\u201d He added: \u201cAlthough subsequently published reports may add to existing evidence on a topic, or propose alternative theories, that new information does not require retraction of previous review articles.\u201d<\/p>\n<p>At least three of the five authors were involved or continue to be involved in the abortion industry:<\/p>\n<ul>\n<li>Before the study, Susan J. Lee was a\u00a0<a href=\"http:\/\/usatoday30.usatoday.com\/news\/health\/2005-08-24-fetal-pain-bias_x.htm\">lawyer<\/a>\u00a0for the National Abortion and Reproductive Rights Action League, now called NARAL Pro-Choice America, as USA Today and other media outlets reported. Lee left law to enter medical school at the University of California, San Francisco, and was a student there at the time of the study. She currently is a member of the university\u2019s faculty.<\/li>\n<\/ul>\n<ul>\n<li>Dr. Eleanor Drey is the<a href=\"http:\/\/bixbycenter.ucsf.edu\/eleanor-drey-md-edm\">\u00a0medical director<\/a>\u00a0of the Women\u2019s Options Center of San Francisco General Hospital, which<a href=\"https:\/\/www.ucsfhealth.org\/clinics\/womens_options_center\/\">\u00a0performs abortions<\/a>, according to the University of California, San Francisco.<\/li>\n<\/ul>\n<ul>\n<li>Dr. Mark Rosen, a professor of \u00a0clinical anesthesia and obstetrics at University of California, San Francisco, was a consultant for the Center for Reproductive Rights, the National Abortion Federation, and Planned Parenthood Federation of America, according to his\u00a0<a href=\"http:\/\/anes-som.ucsd.edu\/VP%20Articles\/RosenCV.pdf\">r\u00e9sum\u00e9<\/a>.<\/li>\n<\/ul>\n<p>The Daily Signal emailed the three authors, but did not receive responses.\u00a0The report\u2019s two other authors, Dr. Henry J. Peter Ralston and Dr. John Colin Partridge, do not appear to have direct ties to the abortion industry.<\/p>\n<p><a href=\"http:\/\/AbortionProcedures.com\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-88619\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN.jpg\" alt=\"levatino-ad-LAN\" width=\"306\" height=\"225\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN.jpg 306w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN-300x221.jpg 300w\" sizes=\"(max-width: 306px) 100vw, 306px\" \/><\/a><\/p>\n<p>In regard to bias, Bauchner wrote to Agresti, \u201cthe information we have indicated that authors complied with the [Journal of the American Medical Association\u2019s] conflict of interest requirements in 2005.\u201d<\/p>\n<p>Jim Michalski, a spokesman for the publication, told The Daily Signal that editors would have no additional comment beyond the letter.<\/p>\n<p>Agresti said Bauchner did not address some of his main arguments in favor of the retraction.<\/p>\n<p>\u201cBased on his last email to me, they consider the matter closed,\u201d Agresti said. \u201cI don\u2019t think we will see more action until we can bring enough attention to this.\u201d<\/p>\n<p>David Prentice, vice president and research director for the Charlotte Lozier Institute, a pro-life scientific research organization, also advocated a retraction. He said he doesn\u2019t necessarily believe the American Medical Association is biased.<\/p>\n<p>\u201cFor the editors, they may not see the bias among the authors as serious enough,\u201d Prentice said. \u201cEleven years have passed. The interpretation of the science is old. They may feel the paper is pass\u00e9 and has been supplanted by modern science.\u201d<\/p>\n<p>The 2012 Belgium study\u00a0<a href=\"http:\/\/www.karger.com\/Article\/Pdf\/338146\">said<\/a>:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Whether a fetus is capable of experiencing pain as a conscious and emotional feeling remains unclear and is subject to great debate, but we cannot deny that the fetal nervous system mounts protective responses to tissue injury. A physiological fetal reaction to painful stimuli occurs from between 16 and 24 weeks\u2019 gestation on. \u2026\u00a0Evidence is increasing that from the second trimester onwards, the fetus reacts to painful stimuli and that these painful interventions may cause long-term effects.<\/p>\n<\/blockquote>\n<p>The 2006 article in Pain\u00a0<a href=\"http:\/\/iasp.files.cms-plus.com\/Content\/ContentFolders\/Publications2\/PainClinicalUpdates\/Archives\/PCU_XIV-2_June2006_Rev_Mar2012_1390263724028_20.pdf\">asserted<\/a>:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Multiple lines of evidence thus corroborate that the key mechanisms of consciousness or conscious sensory perception are not dependent on cortical activity. Consistent with this evidence, the responses to noxious stimulation of children with hydranencephaly are purposeful, coordinated, and similar to those of intact children. Further, preterm neonates or adolescents with cortical parenchymal injury mount bio-behavioral responses to pain that are indistinguishable from those of normal controls. Whether consciousness is required for sensory perception has also been questioned by recent studies of adult patients in a persistent vegetative state.<\/p>\n<\/blockquote>\n<p>Prentice said he believes the real reason for a retraction by the Journal of the American Medical Association is the conflict of interest, but also sees the interpretation of the science as severely flawed.<\/p>\n<p>\u201cSome people are born without a cortex, but they are able to feel pain and are aware of what is around them,\u201d Prentice said. \u201cOther creatures, birds and some mammals, don\u2019t have a cortex. Would we say they can\u2019t feel pain? Of course not.
