{"id":96743,"date":"2016-06-27T17:45:23","date_gmt":"2016-06-27T21:45:23","guid":{"rendered":"\/news\/?p=96743"},"modified":"2016-08-31T17:41:08","modified_gmt":"2016-08-31T21:41:08","slug":"pro-abortion-media-reacts-to-supreme-court-texas-abortion-decision","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/pro-abortion-media-reacts-to-supreme-court-texas-abortion-decision\/","title":{"rendered":"Pro-abortion media reacts to Supreme Court&#8217;s Texas abortion decision"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Abortion absolutists have wasted no time popping the champagne corks in response to this morning\u2019s <a href=\"\/news\/breaking-u-s-supreme-court-texas-draft\/\">horrendous Supreme Court ruling<\/a> against Texas\u2019s right to regulate abortion facilities in the interest of women\u2019s health and safety.<\/p>\n<p>Jezebel\u2019s Stassa Edwards, for instance, reacted by <a href=\"http:\/\/theslot.jezebel.com\/in-a-major-victory-for-abortion-rights-the-supreme-cou-1782556582\">declaring<\/a>, \u201cThank f***ing god.\u201d You know, to beat back those vicious, unfair stereotypes about pro-aborts being crass juveniles who don\u2019t appreciate the life-or-death stakes of their issue.<\/p>\n<p><!--more-->The rest of her piece is a by-the-numbers recitation of the usual litany of discredited pro-abortion talking points against HB 2, of which one stands out:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">[M]ost major medical groups agree that the TRAP bill endangers women\u2019s healthcare by either delaying or outright blocking the procedure. This is evidenced, perhaps, by the fact that, in Texas, DIY abortion is on the rise.<\/p>\n<\/blockquote>\n<p>The source for that claim is, naturally, the infamous Texas Policy Evaluation Project study on self-abortion attempts which Live Action and others <a href=\"\/news\/texas-self-abortions-study\/\">debunked more than seven months ago<\/a>.<\/p>\n<p>And if we turn the clock back to before abortion-industry sympathizers had a partisan incentive to oppose admitting privileges, many of those same major medical groups, including the American College of Obstetricians and Gynecologists, American Medical Associations, and thirty others <a href=\"\/news\/32-medical-societies-support-admitting-privileges-abortion-advocates-fighting\/\">agreed<\/a> they were a valid and important standard for anything falling under the umbrella of office-based outpatient surgical care. (Oh, and <a href=\"\/news\/real-reason-why-abortion-centers-closing-texas\/\">even the National Abortion Federation<\/a> endorsed admitting privileges\u2026 sixteen years ago.)<\/p>\n<p>Mother Jones\u2019 contribution to the festivities is to <a href=\"http:\/\/www.motherjones.com\/politics\/2016\/06\/best-lines-supreme-court-decision-saved-abortion-rights-texas\">present<\/a> the \u201cbest lines\u201d from the ruling:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">STEPHEN BREYER: We have found nothing in Texas&#8217; record evidence that shows that, compared to prior law\u2026the new law advanced Texas\u2019 legitimate interest in protecting women&#8217;s health.<\/p>\n<p style=\"padding-left: 30px;\">BREYER: More fundamentally, in the face of no threat to women&#8217;s health, Texas seeks to force women to travel long distances to get abortions in crammed-to-capacity superfacilities. Patients seeking these services are less likely to get the kind of individualized attention, serious conversation, and emotional support that doctors at less taxed facilities may have offered.<\/p>\n<p style=\"padding-left: 30px;\">RUTH BADER GINSBURG: It is beyond rational belief that H. B. 2 could genuinely protect the health of women, and certain that the law &#8220;would simply make it more difficult for them to obtain abortions.&#8221;<\/p>\n<p style=\"padding-left: 30px;\">GINSBURG: When a State severely limits access to safe and legal procedures, women in desperate circumstances may resort to unlicensed rogue practitioners, faute de mieux, at great risk to their health and safety.<\/p>\n<\/blockquote>\n<p>If these are the best, then that alone proves the case was wrongly decided. First, how could the Justices find no evidence when the evidence includes the aforementioned conclusion of 32 authoritative medical organizations, women <a href=\"\/news\/if-abortion-advocates-want-to-end-back-alley-abortions-then-they-must-support-more-restrictions\/\">who&#8217;ve been injured or killed<\/a> by botched abortions, and the <em>plaintiff organization\u2019s <a href=\"\/news\/long-history-of-health-violations-at-abortion-chain-suing-over-pro-life-law\/\">own record<\/a><\/em> of failure to have:<\/p>\n<ul>\n<li>licensed nursing staff on-site,<\/li>\n<li>improper disposal of private patient information,<\/li>\n<li>poorly maintained medical equipment including \u201cnumerous rusty spots\u201d on a suction machine,<\/li>\n<li>&#8220;infection control issues&#8221; stemming from not properly sterilizing surgical instruments,<\/li>\n<li>unsanitary equipment,<\/li>\n<li>expired medications,<\/li>\n<li>improperly labeled medications,<\/li>\n<li>improper medical waste disposal,<\/li>\n<li>violation of informed-consent laws,<\/li>\n<li>lack of usable EKG machines and deliberators,<\/li>\n<li>and more?<\/li>\n<\/ul>\n<p>Second, medical standards do not <em>force<\/em> abortion facilities to close; aside from the <a href=\"\/news\/abortion-centers-are-closing-because-women-dont-need-them\/\">declining market for abortions<\/a>, facilities are <a href=\"\/news\/judge-allows-louisiana-admitting-privileges-law-take-effect\/\">choosing<\/a> not to invest in the reforms necessary to comply. Amid 20,000 comments about HB 2, the Texas Department of State Health Services <a href=\"http:\/\/www.texasrighttolife.com\/a\/1140\/Texas-Appellate-Court-Unconvinced-by-Planned-Parenthoods-Unsound-quotUndue-Burdenquot-Argument#.Vkot0Mo7CRs\">found no<\/a> \u201cbasis to believe that abortion providers would be unable to make similar adjustments\u201d than made by abortionists who complained yet \u201cnonetheless received admitting privileges and either stayed open or reopened.\u201d<\/p>\n<p><a href=\"http:\/\/AbortionProcedures.com\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-88619\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN.jpg\" alt=\"levatino-ad-LAN\" width=\"306\" height=\"225\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN.jpg 306w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN-300x221.jpg 300w\" sizes=\"(max-width: 306px) 100vw, 306px\" \/><\/a><\/p>\n<p>Third, it wasn\u2019t the Justices\u2019 place to even get into either of those areas in the first place. Their only job was to determine whether the Constitution prohibits Texas from making this law. Whether the law is a good idea was a policy judgment reserved to the people through their elected branches of government\u2014not for the unelected branch to usurp through the \u201c<a href=\"\/news\/will-abortion-waiting-period-survive-satanists-religious-freedom-challenge\/\">compelling interest<\/a>\u201d or \u201c<a href=\"\/news\/will-undue-burden-test-throw-wrench-supreme-court-case-tx-abortion-law\/\">undue burden<\/a>\u201d test, and certainly not through blind deference to an <a href=\"\/news\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">illegitimate precedent<\/a> such as <em>Roe v. Wade<\/em>.<\/p>\n<p>Finally, at Salon the <a href=\"\/news\/tag\/amanda-marcotte\/\">truth-allergic<\/a> Amanda Marcotte <a href=\"http:\/\/www.salon.com\/2016\/06\/27\/pro_choice_victory_the_supreme_court_strikes_down_texas_abortion_law_further_shredding_the_religious_right\/\">hailed<\/a> the victory for \u201cfurther shredding the religious right,\u201d claiming that HB 2 can\u2019t have been meant to improve safety, based on the novel reasoning\u2014are you sitting down?\u2014that safer abortions would be \u201cpretty much impossible, as abortion is already safer than\u00a0dental surgery or\u00a0a\u00a0colonoscopy.\u201d<\/p>\n<p>Two things, Amanda: first, we don\u2019t really know if abortion is safer (for mothers, that is; it\u2019s deadly to children) because <a href=\"\/news\/unnoticed-tragedies-the-problem-of-abortion-underreporting-in-the-u-s\/\">abortion underreporting<\/a> is a serious hindrance; in particular, we know abortion-related deaths <a href=\"\/news\/vox-video-spreads-abortion-misinformation-while-pretending-to-correct-it\/\">get wrongly classified<\/a> as just \u201cpregnancy-related.\u201d Second, we\u2019re not even talking about the average abortionist; we\u2019re talking about the facilities who, as explained above, commit dozens of acts of medical negligence, yet get people like you to run interference for them.<\/p>\n<p>Of course, Marcotte has no problem going from that deceit to sneering about the \u201cincredible bad faith of the regulations.\u201d Glass houses, Amanda\u2026<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">And this Supreme Court decision is making it harder than ever for the right to cling to religion as the pretense for the politics of resentment.<\/p>\n<\/blockquote>\n<p>Inasmuch as no religious claims were at issue on either side of this lawsuit and nothing pro-lifers argued was false (making \u201cbearing false witness\u201d claims a dead-end), it\u2019s hard to see how Marcotte\u2019s conclusion follows, other than as a manifestation of her persistent psychological need to erect comforting fantasies about her foes\u2019 motives.<\/p>\n<p>As an antidote to all the above nonsense and deceit, I leave you with <a href=\"http:\/\/www.chicksontheright.com\/justice-clarence-thomas-slams-texas-court-ruling-accuses-court-of-bending-the-rules-to-create-putative-right-to-abortion\/\">the following beacon of sanity<\/a> from Justice Clarence Thomas\u2019s dissenting opinion:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Today\u2019s decision creates an abortion exception to ordinary rules of res judicata, ignores compelling evidence that Texas\u2019 law imposes no unconstitutional burden, and disregards basic principles of the severability doctrine. I write separately to emphasize how today\u2019s decision perpetuates the Court\u2019s habit of applying different rules to different constitutional rights\u2014 especially the putative right to abortion [\u2026]<\/p>\n<p style=\"padding-left: 30px;\">A plaintiff either possesses the constitutional right he is asserting, or not\u2014and if not, the judiciary has no business creating ad hoc exceptions so that others can assert rights that seem especially important to vindicate. A law either infringes a constitutional right, or not; there is no room for the judiciary to invent tolerable degrees of encroachment.
