margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/www.texasrighttolife.com\/after-sham-misdemeanor-indictment-dismissed-cmp-lawyers-plan-to-go-after-felony-charge\/\">Texas Right to Life<\/a>) As Texas Right to Life\u00a0<a href=\"https:\/\/www.texasrighttolife.com\/harris-county-judge-dismisses-grand-jury-indictment-of-center-for-medical-progress-journalist\/\" target=\"_blank\">reported<\/a>\u00a0Tuesday, a bogus misdemeanor indictment against Center for Medical Progress founder David Daleiden has been\u00a0<a href=\"http:\/\/www.centerformedicalprogress.org\/wp-content\/uploads\/2016\/06\/img-613140839-0001.pdf\" target=\"_blank\">dismissed<\/a>\u00a0by Harris County Judge Diane Bull.\u00a0 Judge Bull cited a lack of court jurisdiction to proceed with Daleiden\u2019s case.\u00a0 In Harris County District Attorney Devon Anderson\u2019s indictment of Daleiden, a technical omission rendered the indictment void.\u00a0 The indictment failed to address an exception in the law Daleiden was charged with breaking, which is a requirement for a valid indictment.<\/p>\n<p><!--more-->The indictment, issued in January, purports to charge Daleiden with the Class A misdemeanor of intending to buy human organs.\u00a0 The order dismissing the case\u00a0<a href=\"http:\/\/www.centerformedicalprogress.org\/wp-content\/uploads\/2016\/06\/img-613140839-0001.pdf\" target=\"_blank\">reads<\/a>, in part:\u00a0<strong>\u201cAn indictment\u2019s failure to negate an exception is the same as its failure to allege an essential element of the offense; it renders the indictment void.\u201d \u00a0<\/strong>In a statement, the Center for Medical Progress said that the dismissal of the misdemeanor indictments \u201csends a strong message to Planned Parenthood and their political cronies that colluding to suppress the First Amendment rights of citizen journalists will never work.\u201d<\/p>\n<p>Because the indictment was rendered void on a technicality, Devon Anderson\u2019s office could easily refile the charge and continue to pursue misdemeanor charges against Daleiden.\u00a0\u00a0<a href=\"http:\/\/www.usnews.com\/news\/us\/articles\/2016-06-14\/anti-abortion-activists-human-organ-purchase-charge-dropped\" target=\"_blank\">U.S. News &amp; World Report<\/a>\u00a0explains:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Grant Scheiner, a Houston criminal defense attorney not connected to the case, said the misdemeanor count was dismissed on a technicality and prosecutors could easily refile the charge under a different cause number.<\/p>\n<p style=\"padding-left: 30px;\">He called the decision to not refile the charge \u201cvery odd.\u201d<\/p>\n<p style=\"padding-left: 30px;\">\u201cUnless the prosecutor felt there was something wrong with the case, for example if one of the statutory exceptions did apply, then it would be very peculiar for the prosecutor not to refile,\u201d Scheiner said.<\/p>\n<\/blockquote>\n<p>But, tellingly, Anderson told the\u00a0<a href=\"https:\/\/www.texasobserver.org\/david-daleiden-planned-parenthood-indictment\/\" target=\"_blank\">Texas Observer<\/a>\u00a0that her office will not appeal the judge\u2019s decision.\u00a0 Instead, Anderson shifted attention to the felony charges related to the IDs used by Daleiden and his cohort Sandra Merritt when they went undercover at Planned Parenthood Gulf Coast.\u00a0 \u201cOur office remains focused on the felony charge pending in the 338th\u00a0District Court,\u201d Anderson said.<\/p>\n<p>While the misdemeanor indictment was dismissed on an easily-reparable technicality, Anderson\u2019s intention to not revisit the charge points to the bogus nature of the indictment.\u00a0 As Daleiden noted in the immediate aftermath of the indictment in January, \u201cBuying fetal tissue requires a seller as well.\u201d\u00a0 In other words, if Daleiden could be validly charged with the intent to buy human organs, Planned Parenthood by logical extension\u00a0<em>must\u00a0<\/em>likewise be charged with the intent to sell human organs.\u00a0 Yet, we are all aware of the D.A.\u2019s failure to address the collusion of Planned Parenthood \u2013 the only party that\u00a0<em>actually did have intent\u00a0<\/em>to break the law \u2013 in the plot.\u00a0\u00a0<a href=\"\/news\/media-tries-to-downplay-daleiden-victory-as-technicality\/\" target=\"_blank\">Live Action News\u2019<\/a>\u00a0Calvin Freiburger notes the absurdity, saying:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">\u2026Daleiden\u2019s clear lack of intent to go through with any transaction gets directly at the heart of why the charge was bogus, because the law he was accused of breaking\u00a0<a href=\"http:\/\/dailysignal.com\/2016\/01\/26\/pay-no-attention-to-what-planned-parenthood-is-doing-behind-the-curtain\/\" target=\"_blank\">expressly requires<\/a>\u00a0intent for there to be a real violation\u2014an intent, by the way, that couldn\u2019t even have existed if, as Planned Parenthood apologists claim, PP officials never expressed a desire for illegal profits. \u00a0This isn\u2019t a technicality; it\u2019s the essence of the charge.<\/p>\n<\/blockquote>\n<p>Meanwhile, Daleiden\u2019s legal team is preparing for a hearing in the\u00a0<a href=\"https:\/\/www.texasrighttolife.com\/bombshell-review-finds-harris-county-d-a-botched-indictment-of-pro-life-journalists\/\" target=\"_blank\">motion to quash<\/a>\u00a0the felony indictments, which will take place\u00a0<a href=\"http:\/\/www.lifenews.com\/2016\/05\/26\/d-a-admits-breaking-the-law-when-indicting-planned-parenthood-investigator-david-daleiden\/\" target=\"_blank\">July 26<\/a>. Daleiden\u2019s Houston attorney plans to spotlight Planned Parenthood\u2019s audaciously publicized relationship with the D.A.\u2019s office during the D.A.\u2019s sham investigation.\u00a0<a href=\"http:\/\/www.breitbart.com\/texas\/2016\/05\/25\/lawyers-promise-to-smoke-out-collusion-with-planned-parenthood-videographers-prosecutor\/\" target=\"_blank\">Breitbart Texas<\/a>\u00a0reports:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Houston attorney\u00a0<a href=\"https:\/\/www.texasbar.com\/AM\/Template.cfm?Section=Find_A_Lawyer&amp;template=\/Customsource\/MemberDirectory\/MemberDirectoryDetail.cfm&amp;ContactID=227643\" target=\"_blank\">Jared Woodfill<\/a>, one of Daleiden\u2019s lawyers told Breitbart Texas, \u201cThe collusion between the DA and Planned Parenthood lawyers will be flushed out during this hearing. \u00a0We will put Planned Parenthood\u2019s lawyer on the stand and will expose the witch hunt that ended up with the indictment of my client but let baby part selling Planned Parenthood Gulf Coast get off
