{"id":96302,"date":"2016-06-20T14:02:07","date_gmt":"2016-06-20T18:02:07","guid":{"rendered":"\/news\/?p=96302"},"modified":"2016-08-31T17:46:19","modified_gmt":"2016-08-31T21:46:19","slug":"lambda-legals-case-against-tx-abortion-regs-is-not-about-the-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/lambda-legals-case-against-tx-abortion-regs-is-not-about-the-law\/","title":{"rendered":"Lambda Legal&#8217;s case against Texas abortion regulations is not about the law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Court-mandated abortion on demand was <a href=\"\/news\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">bad enough as baseless law<\/a>, but in recent years its supporters seem to have taken constitutional scholar John Hart Ely\u2019s <a href=\"https:\/\/web.archive.org\/web\/20150130144759\/http:\/\/www.washingtonexaminer.com\/the-pervading-dishonesty-of-roe-v.-wade\/article\/1080661\">assessment<\/a> that <em>Roe v. Wade<\/em> \u201cgives almost no sense of an obligation to try to be\u201d constitutional law &#8212; not as a critique, but as permission to ignore the law completely.<\/p>\n<p>Lambda Legal, a gay advocacy group, has submitted one of the amicus briefs in <em>Whole<\/em> <em>Woman\u2019s Health v. Hellerstedt<\/em>, on behalf of the abortion facilities Texas wants to regulate. At the Advocate, Lambda\u2019s Camilla Taylor, Caroline Sacerdote, and Kara Ingelhart <a href=\"http:\/\/www.advocate.com\/commentary\/2016\/6\/16\/abortion-stigma-and-politics-closet\">offer a case<\/a> for why the Supreme Court should side with the abortion industry\u2014a case that stands out for how little it even pretends to be legal analysis.<\/p>\n<p><!--more--><\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">[L]andmark court victories for LGBT people share a common doctrinal foundation with precedents protecting the constitutional right to abortion; erosion of the right to terminate a pregnancy puts LGBT civil rights at risk.<\/p>\n<\/blockquote>\n<p>How? Presumably the right to privacy is the \u201ccommon doctrinal foundation\u201d the authors have in mind, but whatever the constitutional status of the <a href=\"\/news\/gay-marriage-dead-babies-and-the-hypocritical-emptiness-of-liberal-morality\/\">causes grouped under the \u201cLGBT rights\u201d label<\/a> may be, it\u2019s preposterous to suggest that allowing abortion to be regulated or even prohibited would jeopardize gay Americans\u2019 freedoms in any way.<\/p>\n<p><a href=\"http:\/\/AbortionProcedures.com\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-88619\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN.jpg\" alt=\"levatino-ad-LAN\" width=\"306\" height=\"225\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN.jpg 306w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/02\/levatino-ad-LAN-300x221.jpg 300w\" sizes=\"(max-width: 306px) 100vw, 306px\" \/><\/a><\/p>\n<p>First, even if we grant for the sake of argument that the Constitution contains a broad, generalized \u201cright to privacy\u201d (which <a href=\"http:\/\/www.nationalreview.com\/article\/214892\/bad-decision-started-it-all-robert-p-george-david-l-tubbs\">it doesn&#8217;t<\/a>), abortion would still be an <a href=\"\/news\/privacy-dumbest-argument-legal-abortion\/\">illegitimate application of it<\/a>, because one\u2019s <em>individual<\/em> privacy can\u2019t cover harming <em>another<\/em> individual. Second, the current case before SCOTUS isn\u2019t even about the \u201cright\u201d to abortion; it\u2019s about imposing safety regulations on providers of it. The Court has <a href=\"\/news\/pro-life-louisiana-senator-mistaken-calling-abortion-restrictions-unconstitutional\/\">already ruled<\/a> that the two aren\u2019t mutually exclusive, which should be common sense, considering that nobody disputes states\u2019 right to regulate all sorts of <em>actual<\/em> medical procedures that we have undisputed rights to seek.<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">People who have an abortion \u2014 whether members of the LGBT community or not \u2014 experience something familiar to all LGBT people: stigma. Although abortion is one of the most safe and common surgical procedures in the United States, two in three women who have had abortions anticipate being stigmatized if others find out. This concern of being \u201couted\u201d as having had an abortion keeps 58 percent of those who have had abortions from sharing their stories with their families and friends. This silence perpetuates abortion stigma and interferes with the ability of those who have accessed abortion to advocate for themselves in the political arena.<\/p>\n<\/blockquote>\n<p>Ah, yes, the famed Stigma Clause of the Constitution, which our forefathers wrote to ensure\u2014wait, no, that\u2019s not in the Constitution at all. That has absolutely nothing to do with the <a href=\"\/news\/will-undue-burden-test-throw-wrench-supreme-court-case-tx-abortion-law\/\">objective criteria<\/a> and <a href=\"\/news\/disdain-for-the-entire-judicial-process-ruth-bader-ginsburgs-history-on-abortion\/\">absolute impartiality<\/a> by which a law\u2019s permissibility is supposed to be determined. If a law arguably shames something or someone, we have two other branches of government, plus these things called \u201celections,\u201d for deciding whether that\u2019s a good or bad thing.<\/p>\n<p>Aside from how spectacularly off-topic the authors\u2019 \u201clegal\u201d analysis is, there are <a href=\"http:\/\/plagal.org\/\">more than a few<\/a> gay folks who would see the real insult here as putting their consensual relationship decisions in the same category as slaughtering an innocent child\u2026<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Much of the stigma around abortion arises because the act of terminating a pregnancy is seen as deeply transgressing gender norms. Abortion challenges traditional stereotypes of women as mothers and self-sacrificing nurturers.<\/p>\n<\/blockquote>\n<p>\u201cGender norms\u201d? Seriously? Is there a \u201cgender norm\u201d in this country of men killing their children for convenience with societal approval? Anywhere? Because that would be the only circumstance in which it would be the slightest bit sane to suggest protecting babies is about enforcing any sort of stereotype about women.<\/p>\n<p>Only the first of these points even alludes to a legal argument\u2014and it\u2019s a bogus one. The authors don\u2019t even try to mask the rest as anything other than purely ideological or cultural claims.
