(Pregnancy Help News<\/a>) The fate of free speech protections guaranteed by the First Amendment is now in the hands of the 9th U.S. Circuit Court of Appeals,\u00a0following a hearing Tuesday morning<\/a>\u00a0to reverse\u00a0a lower court\u2019s ruling<\/a>\u00a0that allowed California to enforce the so-called \u201cReproductive FACT Act\u201d while the lawsuit is pending.<\/p>\n

The court heard oral arguments from Alliance Defending Freedom (ADF), Pacific Justice Institute and American Center for Law and Justice (ACLJ) lawyers, who urged justices to grant a preliminary injunction against a law that would force community-funded pregnancy help organizations throughout the state to post signage referring for abortions in violation of their life-affirming values.<\/p>\n

Matt Bowman, Senior Counsel for ADF, the question is whether forcing pro-life state-licensed medical clinics to publicize state-funded abortions\u2014in violation of their conscience\u2014is the only way California can publicize its message.<\/p>\n

\u201cThe judges had a lot of probing questions about how this law could injure freedom of speech by the government forcing people to promote its message,\u201d Bowman said.<\/p>\n

Called the \u201cBully Bill\u201d by its pro-life opponents since its introduction in the State Assembly in the spring of 2015, the \u201cReproductive FACT Act\u201d\u00a0was signed into law by Democratic Gov. Jerry Brown in October of 2015<\/a>.<\/p>\n

Francis J. Manion, Senior Counsel for ACLJ, argued the state\u2019s failure to pursue a legitimate means of advertising its own abortion services and instead compelling privately funded pregnancy centers and medical clinics to speak the government\u2019s message was a glaring factor calling for a reversal of the lower court\u2019s ruling.<\/p>\n

\u201c[The state hasn\u2019t] carried the burden of showing they attempted to adopt alternative means of getting their message across,\u201d Manion said. \u201cThe government tries to respond to that by saying it would require a use of government resources, but you have to question\u2014would that use of resources be less than or more than policing and prosecuting the hundreds of crisis pregnancy centers that the act would require here.\u201d<\/p>\n

Reached for comment by Pregnancy Help News after the argument, Manion said the justices had done their part by asking thoughtful questions of both sides.<\/p>\n

\u201cI\u2019d say everybody got a fair shake and we just wait to see what they decide,\u201d Manion said.<\/p>\n

The law would force 75\u00a0state-licensed free ultrasound facilities to give each client the following disclaimer, which includes the phone number of a county social services office where a client could obtain an abortion covered by Medi-Cal.<\/p>\n

The notice, which the law specifies must either be posted as a public notice in \u201c22-point type,\u201d \u201cdistributed to all clients in no less than 14-point font\u201d or distributed digitally \u201cat the time of check-in or arrival,\u201d applies to all pregnancy help medical clinics licensed by the state.<\/p>\n

“California has public programs that provide immediate free or low-cost access to comprehensive family planning services (including all FDA-approved methods of contraception), prenatal care, and abortion for eligible women. To determine whether you qualify, contact the county social services office at [insert the telephone number].”<\/p>\n

Meanwhile, pregnancy help centers that do not offer medical services will be required to post the following signage in two \u201cclear and conspicuous\u201d places\u2014\u201cin the entrance of the facility and at least one additional area where clients wait to receive services,\u201d as well as in \u201cany print and digital advertising materials including Internet Web sites\u201d.<\/p>\n

The font required is to be \u201cin no less than 48-point type\u201d and will read as follows:<\/p>\n

“This facility is not licensed as a medical facility by the State of California and has no licensed medical provider who provides or directly supervises the provision of services.”<\/p>\n

\u201cCalifornia law already prohibits individuals from inaccurately portraying themselves as doctors or other medical personnel,\u201d Danielle White, Legal Counsel for Heartbeat International, said. \u201cThe purpose of this law is to target life-affirming pregnancy help organizations and force them to speak the government\u2019s message.<\/p>\n

\u201cIf California wishes to communicate the message that abortion is one of many legitimate choices in an unplanned pregnancy, it has countless ways to do so that would not involve demanding private life-affirming ministries to refer for abortions.\u201d<\/p>\n

In Tuesday\u2019s oral argument, Bowman pointed out that, if the law was to be enforced, it would mean that non-licensed pregnancy centers in the state\u2014which offer peer counseling and material support but not medical services such as ultrasounds and STI testing\u2014would need to post the disclaimer in as many as five threshold languages in every instance of online or print advertising.<\/p>\n

Responding to Bowman\u2019s argument, Jonathan Eisenberg, counsel representing California Attorney General Kamala Harris said he was unfamiliar with how the law would be applied throughout the state.<\/p>\n

\u201cI\u2019m not sure that the statute has been worked out at that level of detail,\u201d Eisenberg said. \u201cI guess I could see that there might be a problem.\u201d<\/p>\n

A decision by the three-judge panel in the appeal of\u00a0A Woman\u2019s Friend Pregnancy Resource Center v. Kamala Harris<\/em>\u00a0is expected to be announced in the coming weeks.<\/p>\n
