{"id":94998,"date":"2016-05-26T08:00:29","date_gmt":"2016-05-26T12:00:29","guid":{"rendered":"\/news\/?p=94998"},"modified":"2016-09-01T16:17:45","modified_gmt":"2016-09-01T20:17:45","slug":"da-charged-david-daleiden-admits-broke-law-calls-minor-harmless","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/da-charged-david-daleiden-admits-broke-law-calls-minor-harmless\/","title":{"rendered":"DA who charged David Daleiden admits she broke the law; calls it &#8216;minor and harmless&#8217;"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Harris County District Attorney Devon Anderson has admitted in a\u00a0<a href=\"https:\/\/www.scribd.com\/doc\/313310482\/State-s-Response-to-Defendant-s-MTQ-With-Exhibits-David-Robert-Daleiden\">court brief<\/a> that she violated Texas law in her quest\u00a0to prosecute David Daleiden. Daleiden, the leader of the <a href=\"http:\/\/www.centerformedicalprogress.org\/cmp\/investigative-footage\/\">Center for Medical Progress<\/a> (CMP),\u00a0was indicted in January by a grand jury that was believed to be\u00a0investigating Planned Parenthood. The Associated Press <a href=\"http:\/\/bigstory.ap.org\/article\/0f9ee593bc8d4d4e904c33bb08f0f9dc\/houston-prosecutor-has-angered-anti-abortion-groups\">reported<\/a> that the grand jury never took a vote on indicting Planned Parenthood, and instead, indicted Daleiden and his colleague, Sandra Merritt, for alleged activities involved in their <a href=\"http:\/\/www.centerformedicalprogress.org\/cmp\/investigative-footage\/\">undercover investigation<\/a> of the abortion chain.<\/p>\n<p>Daleiden&#8217;s attorneys filed a motion to quash his indictment, and Anderson <a href=\"https:\/\/www.scribd.com\/doc\/313310482\/State-s-Response-to-Defendant-s-MTQ-With-Exhibits-David-Robert-Daleiden\">filed a brief<\/a> in response. In the brief, the DA admits that Texas law did not permit her to make Daleiden&#8217;s indictment public prior to him being &#8220;in custody or under bond.&#8221; Yet despite the directives in the law, Anderson sent out a public press release (which she\u00a0forwarded to PP attorney Josh Schaffer on the same day) announcing Daleiden&#8217;s indictment.<\/p>\n<p><!--more--><\/p>\n<p>The Texas law involved, according to Anderson, states:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">If the defendant is not in custody or under bond at the time of the presentment of indictment, the indictment may not be made public and the entry in the record of the court relating to the indictment must be delayed until the capias is served and the defendant is placed in custody or under bond.<\/p>\n<\/blockquote>\n<p>Daleiden <a href=\"\/news\/david-daleiden-posts-bail-planned-parenthood-video-indictment\/\">turned himself in and posted bail<\/a> (which put him &#8220;under bond&#8221;) on February 4. Anderson&#8217;s <a href=\"http:\/\/thefederalist.com\/2016\/01\/25\/houston-grand-indicts-david-daleiden-for-organ-trafficking-issues-no-charges-against-planned-parenthood\/\">public announcement to the media went out on January 25<\/a>. However, the DA says\u00a0in her brief that her actions were an &#8220;oversight&#8221; that &#8220;was a mere technical, inconsequential violation.&#8221; She also refers to her broadly spread press release as a &#8220;minor and harmless&#8221; &#8220;procedural irregularity.&#8221;<\/p>\n<p>According to <a href=\"https:\/\/www.scribd.com\/doc\/313310482\/State-s-Response-to-Defendant-s-MTQ-With-Exhibits-David-Robert-Daleiden\">an affidavit<\/a> by Planned Parenthood attorney Josh Schaffer, Anderson&#8217;s office informed him that a press release about the grand jury&#8217;s findings would be coming out later on January 25. This information, given to Schaffer in a private phone call he\u00a0describes as taking place prior to the public announcement, indicates that the press release was a planned effort by the DA&#8217;s office.<\/p>\n<p>Additionally, the press release appears to have provided the public and the media with misleading\u00a0information about Planned Parenthood&#8217;s claimed innocence. According to <a href=\"http:\/\/thefederalist.com\/2016\/01\/25\/houston-grand-indicts-david-daleiden-for-organ-trafficking-issues-no-charges-against-planned-parenthood\/\">The Federalist<\/a>, the DA&#8217;s press release specifically stated: &#8220;This grand jury cleared PPGC of breaking the law.&#8221; However, as a government attorney knows, it is impossible for a grand jury to &#8220;clear&#8221; anyone or declare them innocent. A grand jury simply decides to charge or not to charge, usually at the request of the prosecutor. Yet such a claim, coming straight from the DA &#8211; despite its inaccuracy &#8211; has proved to be a terribly useful narrative for Planned Parenthood who has repeated it again and again.<\/p>\n<p>In <a href=\"https:\/\/www.scribd.com\/doc\/313310482\/State-s-Response-to-Defendant-s-MTQ-With-Exhibits-David-Robert-Daleiden\">her most recent brief<\/a>, Anderson compares her actions to two other Texas cases where indictments were allowed to stand. In one case, a typo was made, and in the other, it appears that the minutes recorded in court were not completely accurate. LifeSiteNews <a href=\"https:\/\/www.lifesitenews.com\/blogs\/da-sure-i-broke-the-law-indicting-david-daleiden-but-it-was-minor-and-harml\">notes<\/a> that it would appear Anderson wants to &#8220;present her entire press release as one enormous typo.&#8221; She also\u00a0claims\u00a0that the Texas law she admits to violating was &#8220;directory&#8221; rather than mandatory.<\/p>\n<p>In closing,\u00a0Anderson uses Daleiden&#8217;s choice to turn himself in as proof that her violation was &#8220;minor and harmless.&#8221; She argues that the purpose of not allowing public announcements until the person under indictment is in custody is to &#8220;<span class=\"a\">prevent[] defendants from hearing of their indictment before arrest, and<\/span><span class=\"g\"><span class=\"a\">\u00a0possibly avoid[] apprehension.&#8221; She <a href=\"https:\/\/www.scribd.com\/doc\/313310482\/State-s-Response-to-Defendant-s-MTQ-With-Exhibits-David-Robert-Daleiden\">continues<\/a>:<\/span><\/span><\/p>\n<blockquote>\n<div class=\"ff5\" style=\"padding-left: 30px;\"><span class=\"a\">Here, given that Defendant made no attempt to avoid apprehension and, in fact,<\/span><span class=\"a\">voluntarily surrendered himself into custody just prior to his first court appearance, it is\u00a0<\/span><span class=\"a\">clear that the purpose of Article 20.22(b)\u00a0<\/span><span class=\"a\">\u2014\u00a0<\/span><span class=\"a\">to prevent defendants from fleeing or\u00a0<\/span><span class=\"a\">avoiding apprehension upon learning of their indictment<\/span><span class=\"a\">\u00a0\u2014\u00a0<\/span><span class=\"a\">was not thwarted by the fact\u00a0<\/span><span class=\"a\">that Defendant<\/span><span class=\"a\">\u2019<\/span><span class=\"a\">s indictment became public before the warrant for his arrest was executed\u00a0<\/span><span class=\"a\">and he was <span class=\"l6\">placed under bond. <\/span><\/span><\/div>\n<\/blockquote>\n<p>In other words, according to Anderson&#8217;s arguments, if Daleiden had fled and &#8220;avoided apprehension&#8221; in Texas, her violation of law may\u00a0not have been minor or harmless at all.\u00a0But since Daleiden chose to follow the law &#8211; unlike Anderson &#8211; she gets to claim that her actions don&#8217;t matter at all.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Harris County District Attorney Devon Anderson has admitted in a\u00a0court brief that she violated Texas law in her quest\u00a0to prosecute David Daleiden.
