{"id":94599,"date":"2016-05-19T16:59:41","date_gmt":"2016-05-19T20:59:41","guid":{"rendered":"\/news\/?p=94599"},"modified":"2016-05-25T01:51:22","modified_gmt":"2016-05-25T05:51:22","slug":"a-pro-life-look-at-donald-trumps-supreme-court-nominees","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/a-pro-life-look-at-donald-trumps-supreme-court-nominees\/","title":{"rendered":"A pro-life look at Donald Trump&#8217;s Supreme Court nominees"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>On Wednesday, presumptive Republican presidential nominee Donald Trump\u00a0<a href=\"https:\/\/www.donaldjtrump.com\/press-releases\/donald-j.-trump-releases-list-of-names-of-potential-united-states-supreme-c\">released<\/a> a list of eleven potential Supreme Court nominees he considers \u201crepresentative of the kind of constitutional principles I value.\u201d<\/p>\n<p>Trump has also <a href=\"http:\/\/dailycaller.com\/2016\/05\/18\/trump-releases-list-of-people-he-would-nominate-for-supreme-court\/\">promised<\/a>, \u201cI won\u2019t go beyond the list, and I\u2019m going to let people know. Because some people say maybe I\u2019ll appoint a liberal judge. I\u2019m not appointing a liberal judge.\u201d<!--more-->So far, the consensus in pro-life and constitutionalist circles is positive. The Susan B. Anthony List <a href=\"http:\/\/www.lifenews.com\/2016\/05\/18\/donald-trump-releases-list-of-11-potential-supreme-court-justices-im-not-appointing-a-liberal\/\">calls<\/a> it \u201can exceptionally strong list of jurists with immense respect for our founding documents,\u201d and law professor and ex-Bush Administration attorney John Yoo <a href=\"http:\/\/www.nationalreview.com\/corner\/435570\/donald-trump-judicial-appointments-list-outstanding-conservatives\">says<\/a> it\u2019s a \u201cFederalist Society all-star list of conservative jurisprudence.\u201d (And hey, at least his <a href=\"\/news\/trump-i-was-joking-about-putting-pro-abortion-sister-on-supreme-court\/\">radical pro-abortion sister<\/a> isn&#8217;t on the list.)<\/p>\n<p>On the other hand, conservative pro-life columnist Quin Hillyer <a href=\"http:\/\/dailycaller.com\/2016\/05\/18\/trump-releases-list-of-people-he-would-nominate-for-supreme-court\/\">says<\/a> while it\u2019s \u201ca very strong list,\u201d \u201cI trust this list as far as I can throw a rhinoceros.&#8221;\u00a0National Review\u2019s Dan McLaughlin also\u00a0<a href=\"http:\/\/www.nationalreview.com\/corner\/435573\/donald-trumps-supreme-court-list-too-little-too-late\">dismisses it<\/a> as \u201cmostly cribbed from a prior Heritage Foundation list and from names fed to Trump by Hugh Hewitt in a radio interview\u201d and \u201cobviously is not the product of much due diligence.\u201d<\/p>\n<p>But what about the names? All eleven are listed below, along with whatever specific information we can dig up about their pro-life credentials and constitutional philosophy.<\/p>\n<p><strong>8<sup>th<\/sup> Circuit Judge Steven Colloton<\/strong>\u2014A jurist who has ruled <a href=\"http:\/\/cdn.harvardlawreview.org\/wp-content\/uploads\/pdfs\/vol126_planned_parenthood.pdf\">in favor<\/a> of informed-consent requirements for abortion and <a href=\"https:\/\/www.iowaappeals.com\/eighth-circuit-tees-up-the-aca-contraception-mandate-and-accommodation-for-another-scotus-review\/\">against<\/a> forcing employers to cover contraceptives.<\/p>\n<p><strong>Colorado Supreme Court Justice Allison Eid<\/strong>\u2014A <a href=\"http:\/\/www.coloradoan.com\/story\/news\/2016\/05\/18\/colorados-allison-eid-donald-trumps-supreme-court-list\/84558708\/\">former clerk<\/a> for the great pro-life Justice Clarence Thomas and speechwriter for Ronald Reagan\u2019s pro-life Education Secretary Bill Bennett, in 2013 Eid <a href=\"http:\/\/volokh.com\/2013\/03\/06\/cert-petition-challenging-injunction-against-display-of-gruesome-images-where-children-can-see-them\/\">voted<\/a> to hear the appeal of an injunction against public displays of graphic abortion images (although voting to hear the case is not a vote on the case\u2019s merits, ruling the other way was a de facto vote to let the injunction stand).<\/p>\n<p><strong>8<sup>th<\/sup> Circuit Judge Raymond Gruender<\/strong>\u2014Like Colloton, Gruender sided with pro-lifers on <a href=\"https:\/\/kansansforlife.wordpress.com\/2011\/09\/05\/another-winloss-for-so-dakota-pro-life-laws-stuck-in-court\/\">informed consent<\/a> and <a href=\"http:\/\/law.justia.com\/cases\/federal\/appellate-courts\/F3\/479\/936\/589276\/\">forced contraception coverage<\/a>.<\/p>\n<p><strong>3<sup>rd<\/sup> Circuit Judge Thomas Hardiman<\/strong>\u2014A jurist who has <a href=\"https:\/\/www.congress.gov\/109\/chrg\/shrg34698\/CHRG-109shrg34698.htm\">described<\/a> his judicial philosophy as follows: \u201cour role as judges is to interpret the law, not to inject our own policy preferences [\u2026] any good judge recognizes his or her place in our constitutional government, and that place is not to upset the will of the people as expressed through their elected representatives.\u201d<\/p>\n<p><strong>6<sup>th<\/sup> Circuit Judge Raymond Kethledge<\/strong>\u2014A Judge who has <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/CHRG-110shrg48894\/html\/CHRG-110shrg48894.htm\">described<\/a> his judicial philosophy as \u201cfollow[ing] Supreme Court precedent\u201d \u201cfirst and foremost\u201d (a <a href=\"\/news\/the-future-of-roe-can-pro-lifers-afford-to-wait-for-the-supreme-court-to-take-a-stand\/\">potential problem<\/a> if it means excessive deference for bad precedent such as <em>Roe v. Wade<\/em>), but also \u201cmak[ing] sure that the values that I would be enforcing if I were a judge are not just my values, that I am not striking something down simply because I don&#8217;t like it,\u201d and \u201cstart[ing] with the text. I would say that, sir.\u201d<\/p>\n<p><strong>Michigan Supreme Court Justice Joan Larsen<\/strong>\u2014A former clerk of pro-life hero <a href=\"\/news\/time-pro-lifers-stand-strong-protecting-scalias-principles\/\">Justice Antonin Scalia<\/a>, who <a href=\"http:\/\/wlns.com\/2016\/02\/18\/exclusive-michigan-supreme-court-justice-reflects-on-justice-scalias-death\/\">called<\/a> her former boss \u201cone of the greatest legal minds of our era\u201d with \u201ca commitment to reading the law faithfully and applying the law as written.\u201d<\/p>\n<p><strong>Utah Supreme Court Justice Thomas Lee<\/strong>\u2014The <a href=\"http:\/\/abcnews.go.com\/Politics\/wireStory\/latest-texas-judge-laughs-off-trumps-list-39207318\">brother<\/a> of <a href=\"\/news\/senator-mike-lee-planned-parenthood-defenders-silent-know-true\/\">strong pro-life<\/a> Senator Mike Lee, Justice Lee <a href=\"http:\/\/www.utcourts.gov\/opinions\/supopin\/Carranza122011.pdf\">ruled in 2011<\/a> that fetuses qualified as \u201cminor children\u201d under the state\u2019s wrongful death law.<\/p>\n<p><strong>11<sup>th<\/sup> Circuit Judge William Pryor<\/strong>\u2014A name Trump has mentioned before, and a respected pro-life jurist who <a href=\"http:\/\/www.businessinsider.com\/who-are-diane-sykes-and-bill-pryor-trump-scalia-2016-2\">called<\/a> Roe v. Wade \u201cthe worst abomination in the history of constitutional law\u201d (a declaration with which <a href=\"https:\/\/web.archive.org\/web\/20150130144759\/http:\/\/www.washingtonexaminer.com\/the-pervading-dishonesty-of-roe-v.-wade\/article\/1080661\">many pro-abortion legal scholars agree<\/a>). A solid choice.<\/p>\n<p><strong>Minnesota Supreme Court Justice David Stras<\/strong>\u2014Another former Thomas clerk, in 2009 Stras <a href=\"http:\/\/www.scotusblog.com\/2009\/05\/the-politics-of-the-sotomayor-nomination\/\">criticized as unfair<\/a> Ted Kennedy\u2019s infamous declaration that \u201cRobert Bork\u2019s America is a land in which women would be forced into back-alley abortions.\u201d<\/p>\n<p><strong>7<sup>th<\/sup> Circuit Judge Diane Sykes<\/strong>\u2014Another name Trump first floated months ago, who is disturbingly still in consideration despite <a href=\"http:\/\/blogs.wsj.com\/law\/2012\/10\/23\/appeals-court-blocks-indiana-law-to-defund-abortion-providers\/\">striking down<\/a> Indiana\u2019s 2012 attempt to defund Planned Parenthood. Pro-lifers have <a href=\"\/news\/trump-might-need-some-help-choosing-terrific-judges\/\">pointed this out<\/a> repeatedly over the past several months, so it\u2019s not a good sign that neither Trump nor anyone else on his team was listening.<\/p>\n<p><strong>Texas Supreme Court Justice Don Willett<\/strong>\u2014A judge who <a href=\"http:\/\/www.americanbar.org\/groups\/litigation\/committees\/insurance\/news_analysis\/articles_2014\/coverage-september-october-2014\/interview_texas_justice_don_willett.html\">has said<\/a> a court\u2019s role is \u201cnot to aggrandize power or impose their own policy preferences,\u201d and that a \u201ccourt squanders that legitimacy when it stiff-arms the law to reach wished-for policy outcomes,\u201d because \u201claw isn\u2019t wet clay that a willful, activist judge can mold into whatever outcome he finds more fashionable, politically enticing, or ideologically satisfying.\u201d However, it turns out Willet\u2019s also a <a href=\"http:\/\/www.mediaite.com\/online\/trumps-proposed-scotus-nominee-sure-seems-to-mock-him-a-lot-on-twitter\/\">recurring Trump critic<\/a>, so pro-lifers probably shouldn\u2019t expect him to be nominated anyway.<\/p>\n<p>So it\u2019s definitely an encouraging list, but real question is whether Trump would actually follow through and nominate these people. As Ramesh Ponnuru <a href=\"http:\/\/www.nationalreview.com\/corner\/435583\/can-trump-be-trusted-courts\">explains<\/a>, a lot of skepticism remains because (among other reasons):<\/p>\n<blockquote>\n<p style=\"padding-left: 30px\">[H]e often says he wants to make deals and that conservatism is a second-order concern for him, and making deals with the Democrats on judges would preclude fighting for judicial conservatives. (Trump\u2019s interest in getting conservative judges on the bench is in doubt; the Democrats\u2019 interest in blocking them is not.) Fifth, because he has frequently broken his word and casually abandoned his previously stated positions.<\/p>\n<\/blockquote>\n<p>On the other hand, giving us specific names increases the likelihood at least somewhat, simply because we now have clear markers by which to evaluate his performance.
