{"id":94418,"date":"2016-05-16T11:49:54","date_gmt":"2016-05-16T15:49:54","guid":{"rendered":"\/news\/?p=94418"},"modified":"2016-05-16T11:49:54","modified_gmt":"2016-05-16T15:49:54","slug":"supreme-court-sends-contraception-case-back-to-lower-courts","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/supreme-court-sends-contraception-case-back-to-lower-courts\/","title":{"rendered":"U.S. Supreme Court sends HHS contraception case back to lower courts"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>On Monday, the U.S. Supreme Court <a href=\"http:\/\/www.usatoday.com\/story\/news\/2016\/05\/16\/supreme-court-contraception-mandate-obama-religious-objectors\/82358568\/\">unanimously sent<\/a> the latest dispute over the Obama Administration&#8217;s contraception mandate back to the federal appeals courts to find a compromise between the two sides.<\/p>\n<p>&#8220;The court expresses no view on the merits of the cases,&#8221; the justices&#8217; <a href=\"http:\/\/www.supremecourt.gov\/opinions\/15pdf\/14-1418_8758.pdf\">order<\/a> said. &#8220;In particular, the court does not decide whether petitioners&#8217; religious exercise has been substantially burdened, whether the government has a compelling interest, or whether the current regulations are the least restrictive means of serving that interest.&#8221;<!--more--><\/p>\n<p>Despite the Supreme Court ruling in favor of the right not to be forced to subsidize contraceptives <a href=\"\/news\/the-bigger-picture-behind-the-hobby-lobby-decision\/\">two years ago in the Hobby Lobby case<\/a>, the Obama Administration has been <a href=\"\/news\/white-house-seeking-to-circumvent-supreme-court-hobby-lobby-ruling\/\">seeking ways<\/a> to <a href=\"\/news\/207-members-congress-file-amicus-brief-behalf-little-sisters-poor\/\">keep enforcing<\/a> the mandate ever since under the guise of so-called compromises.<\/p>\n<p><a href=\"http:\/\/www.liveaction.org\/petition\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-84611 aligncenter\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2016\/01\/NewDefundAd3.jpg\" alt=\"NewDefundAd3\" width=\"400\" height=\"170\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/NewDefundAd3.jpg 400w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/NewDefundAd3-300x128.jpg 300w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>In this case, a number of petitioners, including Priests for Life, Little Sisters of the Poor, and a number of religious colleges and universities, had sued for the same outright exemption from the mandate that Obamacare grants churches instead of the &#8220;compromise,&#8221; which ostensibly relieves them of direct responsibility for providing contraception, but still involves them with the third-party insurers and administrators who would be providing it.<\/p>\n<p>The death of Justice Antonin Scalia this February left the Supreme Court without a majority to uphold the religious objectors&#8217; conscience rights. A 4-4 ruling on the case&#8217;s merits would have upheld the lower courts&#8217; rulings without setting binding precedent beyond those specific participants, but the various lower court rulings differed (as this case was a consolidation of similar cases from different plaintiffs). They also opted not to reschedule the case for when Scalia&#8217;s replacement is confirmed, which will likely not happen until the next president is in
