{"id":92873,"date":"2016-04-18T17:29:38","date_gmt":"2016-04-18T21:29:38","guid":{"rendered":"\/news\/?p=92873"},"modified":"2016-04-18T19:33:32","modified_gmt":"2016-04-18T23:33:32","slug":"tennessee-defends-state-amendment-laws-regulating-abortion","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/tennessee-defends-state-amendment-laws-regulating-abortion\/","title":{"rendered":"Tennessee defends state amendment and laws regulating abortion"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>At a recent <a href=\"http:\/\/tennesseerighttolife.nationbuilder.com\/pro_life_womens_day_on_the_hill\">Pro-life Women\u2019s Day on the Hill<\/a> in Nashville, Tennessee Right to Life gave the audience an update on the lawsuits being brought against the citizens of Tennessee by Tracey George, Board Chair of Planned Parenthood of Middle and East Tennessee.<\/p>\n<p><!--more-->Tennessee won a tremendous victory in November of 2014, when voters\u00a0passed a constitutional amendment giving the legislature the right to pass regulations on\u00a0abortion. \u00a0As I explained in a previous\u00a0<a href=\"\/news\/all-eyes-are-on-tennessee-as\/\">post<\/a>, this action was necessary because the ACLU and Planned Parenthood sued the people of Tennessee in a lawsuit known as\u00a0<em><a href=\"http:\/\/caselaw.findlaw.com\/tn-supreme-court\/1171782.html\">Planned Parenthood vs.\u00a0Sundquist<\/a><\/em>. They sued to remove three regulations around abortion that had been voted into place by bi-partisan legislators: informed consent, a 48-hour waiting period, and requiring\u00a0later term abortions to be done in hospitals. \u00a0On\u00a0September 15, 2000, the Tennessee Supreme Court ruled in favor by of the ACLU and Planned Parenthood, and with the ruling, a broad right to an abortion in our state Constitution was &#8216;discovered.&#8217; \u00a0This prevented any regulation from being enforced that could not pass a strict scrutiny standard.<\/p>\n<p>Despite being heavily outspent by abortion advocates, the\u00a0<a href=\"\/news\/pro-life-amendment-passes-in-tennessee-despite-major-funding-disadvantage\/\">Amendment 1<\/a>\u00a0passed by 57-43%.<\/p>\n<p>In Tennessee, the bar for passing a constitutional amendment is quite high. The <a href=\"https:\/\/ballotpedia.org\/Amending_state_constitutions#Tennessee\">language<\/a> of the amendment must be approved by both the state House and Senate by a simple majority, and then by a super majority (two-thirds). After this, it must be placed on the ballot in the next election in which a gubernatorial candidate is chosen. Finally, it has to pass by 50% plus one.<\/p>\n<p>In the 2014 election, incumbent Governor Bill Haslam ( R ) easily <a href=\"https:\/\/ballotpedia.org\/Tennessee_gubernatorial_election,_2014\">defeated<\/a> a political unknown, Charlie Brown, and an independent, John Jay Hooker. Three days after the election, Planned Parenthood of Middle and East Tennessee Board Chair Tracey George filed a <a href=\"\/news\/tn-lawsuit-seeks-to-throw-out-election-resulting-in-pro-life-victory\/\">lawsuit<\/a>\u00a0in federal court, seeking to throw out the election results for the amendment.\u00a0 The reason for filing in federal court was clear. They were cherry picking a judge they felt would be favorable to their cause. \u00a0After several delays, the long -awaited <a href=\"http:\/\/tennesseerighttolife.nationbuilder.com\/update_on_amendment_1_lawsuits\">court date<\/a> occurred on April 7, 2016.<\/p>\n<p><a href=\"https:\/\/liveaction.org\/petition\/\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-84611\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2016\/01\/NewDefundAd3.jpg\" alt=\"NewDefundAd3\" width=\"400\" height=\"170\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/NewDefundAd3.jpg 400w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/NewDefundAd3-300x128.jpg 300w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>A point of interest that is not lost on the pro-life community is that the method of counting votes in the 2014 elections passed\u00a0<a href=\"https:\/\/ballotpedia.org\/Tennessee_2014_ballot_measures\">four<\/a>\u00a0amendments.\u00a0 One amendment concerned the election of judges, one on gambling and one on taxes.\u00a0 However, note that only the one on abortion is being challenged. \u00a0(No one is concerned about gambling, election of judges, or taxes, but apparently, the industry that profits from killing of babies must not be impeded.)<\/p>\n<p>By previous agreement, each side was given an hour to present their case and the state was ably represented by\u00a0<a href=\"http:\/\/r20.rs6.net\/tn.jsp?f=001tY8HODyRqKCC-Wd8KuaV2XlKxDlyKt_02TeYXI5EfJGRM7lu0Fd3iIH1MtoMvgZC34X6A4uFisHa-P5FC3RdZB7r0Kr6R1tNBot3KQFdLYG5JNgJIrcrKVLQTvTaXK5tDSaeEgj2hmxarwiutr3XrFDJhRNLwNCdM6_5J7F4-onPTJWwwZ-nnjGgUjBstbmpuPeswC5a9_I=&amp;c=LL4WfPrAbvY0mCFbwmf7-13cEL5rmMvYtTQAIu19ODEoWYeOzMRdoQ==&amp;ch=rEZvdYfOM_CBsmTdslWuPS1fIC7a0lk1ZFOow65U_1UChxt_d0hXoQ==\">Deputy Attorney General Janet Kleinfelter<\/a>,\u00a0who presented a spirited defense of the state&#8217;s electoral process, relevant precedents and a clear historical basis for ratifying the pro-life Amendment. &#8220;The (pro-abortion) plaintiff&#8217;s case is based on speculation and conjecture,&#8221; said Kleinfelter. &#8220;There is no injury nor are rights violated in the state&#8217;s ratification of Amendment.\u201d<\/p>\n<p>After hearing oral arguments, Judge Sharp took the matter under advisement and gave no timeline for his decision.
