{"id":9103,"date":"2011-12-26T18:50:01","date_gmt":"2011-12-26T23:50:01","guid":{"rendered":"http:\/\/liveaction.org\/blog\/?p=9103"},"modified":"2013-04-02T06:23:53","modified_gmt":"2013-04-02T10:23:53","slug":"preborn-baby-minor-child-utah","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/preborn-baby-minor-child-utah\/","title":{"rendered":"Utah court declares preborn baby a &#8220;minor child&#8221; in wrongful death lawsuit"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><a href=\"http:\/\/liveaction.org\/blog\/sidewalk-counseling\/baby-hand-adult-hand\/\" rel=\"attachment wp-att-5698\"><img decoding=\"async\" loading=\"lazy\" class=\"alignright  wp-image-5698\" style=\"margin: 15px;\" title=\"baby-hand-adult-hand\" alt=\"\" src=\"http:\/\/liveaction.org\/blog\/wp-content\/uploads\/2011\/08\/baby-hand-adult-hand-150x150.jpg\" width=\"192\" height=\"188\" \/><\/a>The Supreme Court of Utah has <a href=\"http:\/\/www.therepublic.com\/view\/story\/7ab396bc5e1e40d69d57d66320f162d4\/UT--Definition-Of-Child-Ruling\/\" target=\"_blank\">deemed a preborn baby a \u201cminor child\u201d<\/a> under Utah statute after a health clinic in Provo disregarded Amelia Sanchez\u2019s plea to induce labor when she was pregnant, likely resulting in the death of her unborn son in April of 2006.<\/p>\n<p>According to the lawsuit, Sanchez was 39, carrying a high-risk pregnancy, and her doctor had indicated the baby may have had a precursor for Down syndrome.\u00a0 She was having contractions and felt her child\u2019s heartbeat was growing faint the day before he was due.\u00a0 When she asked her doctors to induce labor, she was told she would \u201cbe in more pain\u201d if it was time for her to give birth and her request was rejected.\u00a0 Her pain became more severe and when she went in for an ultrasound a few days later, she learned her child had died.<\/p>\n<p>The court documents stated that the baby\u2019s umbilical cord had wrapped around his throat, but he did not have any other birth defects.<\/p>\n<p><!--more--><\/p>\n<p>Amelia Sanchez and Miguel Carranza (the child\u2019s father) sued the clinic for wrongful death of the child, but the lawsuit was put at a standstill so the Supreme Court of Utah could determine if their preborn son could legally be a\u00a0subject of the claim.<\/p>\n<p>Chief Justice Christine Durham stated that the language of the Utah law implies that \u201cthe term &#8216;minor child,&#8217; as used in this statute, includes an unborn child\u2026 In general usage, the term &#8216;child&#8217; may refer to a young person, a baby or a fetus\u2026 thereby encompassing an unborn child.\u201d<\/p>\n<p>Only one of the five court justices, Ronald Nehring, disagreed with the ruling.<\/p>\n<p>&#8220;The usage of &#8216;minor child&#8217; to refer to a fetus is far from being general. It is unique. It is usage specific to anti-abortion political rhetoric&#8230;&#8221; Nehring stated.\u00a0 However, referring to an unborn human being as a \u201cchild\u201d is in no way unique, contrary to what many pro-abortion rights activists and organizations claim: major medical groups such as the Mayo Clinic, WebMD, and Johns Hopkins <a href=\"http:\/\/liveaction.org\/blog\/planned-parenthood-vs-the-medical-authorities\/\" target=\"_blank\">all refer to the unborn as babies or children<\/a>.<\/p>\n<p>Kevin J.
