{"id":9096,"date":"2011-12-25T15:41:16","date_gmt":"2011-12-25T20:41:16","guid":{"rendered":"http:\/\/liveaction.org\/blog\/?p=9096"},"modified":"2013-04-02T06:25:15","modified_gmt":"2013-04-02T10:25:15","slug":"activist-judge-junks-nevada-personhood-measure-for-vague-wording","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/activist-judge-junks-nevada-personhood-measure-for-vague-wording\/","title":{"rendered":"Activist judge junks Nevada personhood measure for vague wording"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><a href=\"http:\/\/liveaction.org\/blog\/activist-judge-junks-nevada-personhood-measure-for-vague-wording\/grammar-jpg\/\" rel=\"attachment wp-att-9097\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-medium wp-image-9097\" title=\"grammar-jpg\" alt=\"\" src=\"http:\/\/liveaction.org\/blog\/wp-content\/uploads\/2011\/12\/grammar-jpg-300x300.gif\" width=\"300\" height=\"300\" \/><\/a><br \/>\nEven for those of us <a href=\"..\/the-mississippi-personhood-fight-wasnt-a-total-loss\/\">sympathetic to<\/a> the \u201cpersonhood\u201d approach to fighting abortion, it\u2019s easy to see that Personhood Nevada didn\u2019t do itself any favors with the wording of their state\u2019s proposed personhood initiative, which a judge <a href=\"http:\/\/thehill.com\/blogs\/healthwatch\/abortion\/200983-nevada-judge-throws-out-personhood-ballot-petition\">threw out on December 21<\/a> for being too vague:<\/p>\n<blockquote><p><em>\u201c<\/em><em>To me it is not clear,\u201d\u00a0Carson City District Judge James Wilson told petitioners late Wednesday, according to news reports.\u00a0\u201cIt is not capable of being rehabilitated through rewriting.\u201d<\/em><\/p>\n<p><em>The petition, from Personhood Nevada, states: \u201cThe term\u00a0\u2018person\u2019\u00a0includes every human being.\u201d<br \/>\n<\/em><\/p><\/blockquote>\n<p>Constitutionally speaking, I can&#8217;t see where Judge Wilson gets the authority to invalidate citizen ballot initiatives for \u201cclarity\u201d or any reason other than constitutionality; it certainly isn\u2019t listed among the judiciary\u2019s powers under <a href=\"http:\/\/www.law.cornell.edu\/constitution\/articleiii\">Article III of the US Constitution<\/a>, nor does it seem apparent under <a href=\"http:\/\/www.leg.state.nv.us\/const\/nvconst.html#Art19\">Article 19 of the Nevada Constitution<\/a>, which defines the state\u2019s initiative &amp; referendum processes. It\u2019s up to the voters of Nevada to decide whether the measure is clear enough for their tastes. (<strong>UPDATE<\/strong>: below, commenter LY112 directs me to Nevada Revised Statutes <a href=\"http:\/\/www.leg.state.nv.us\/nrs\/NRS-295.html#NRS295Sec009\">295.009<\/a> and <a href=\"http:\/\/www.leg.state.nv.us\/nrs\/NRS-295.html#NRS295Sec061\">295.061<\/a>, which <em>do<\/em> establish a clarity requirement and provide for judicial review of initiative language.)<\/p>\n<p><em>Practically<\/em> speaking, however, I actually agree that the petition is vague enough that it would invite needless uncertainty and equivocation in the courtroom as well as on the campaign trail. In defense of their brevity, <a href=\"http:\/\/www.personhoodnevada.com\/\">Personhood Nevada<\/a> argues on their FAQ page:<\/p>\n<blockquote><p><em>Personhood Nevada believes in the value of simplicity and clarity for language in our Nevada Constitution. We salute and share Nevadans&#8217; individualism, independent spirit and healthy dubiety of government. We have therefore chosen straightforward Amendment language which everyone can understand, not just lawyers and politicians. Albert Einstein once said, &#8220;Everything should be as simple as possible but not more so.&#8221; Our goal is adopt clear and simple language such that children will be able to explain it clearly to lawyers.<\/em><\/p><\/blockquote>\n<p>Unfortunately, simplicity and clarity don\u2019t always go hand in hand. Those of us who\u2019ve studied the subject may know that \u201chuman being\u201d <a href=\"http:\/\/rightcal.blogspot.com\/2011\/07\/indisputable-fact-life-begins-at.html\">means embryo from fertilization onward<\/a>. But the initiative doesn\u2019t say so, leaving judges all the leeway they need to infer whatever starting point for \u201chuman being\u201d they wish, be it fertilization, implantation, heartbeat, first breath, viability, or some even more radical, <a href=\"http:\/\/www.discoverthenetworks.org\/individualProfile.asp?indid=2340\">Singeresque<\/a> standard of mental sophistication.<\/p>\n<p>If we could trust judges to rule based on the plain meaning of words, interpreted in light of basic scientific knowledge, we wouldn\u2019t need such amendments in the first place, because courts never would have ruled that \u201cprivacy\u201d means \u201cabortion\u201d or \u201cperson\u201d doesn\u2019t mean \u201cunborn baby.\u201d<\/p>\n<p>The trick to any successful amendment or referendum is leaving activist judges as little wiggle room as possible in which to substitute their own will for the people\u2019s\u2014\u201clet no more be heard of confidence in man, but bind him down from mischief,\u201d <a href=\"http:\/\/press-pubs.uchicago.edu\/founders\/documents\/v1ch8s41.html\">in Thomas Jefferson&#8217;s words<\/a>. Any ambiguity\u2014even on something that should be an obvious inference\u2014is a potential weak spot. For pro-lifers, that means spelling out when human life begins, what procedures you want banned, the works.<\/p>\n<p>Granted, it\u2019s impossible to sufficiently preempt <em>every<\/em> conceivable abuse of the law, just as no house can be perfectly burglar-proofed.
