Right Wing Watch, a website put out by the left-wing advocacy group People for the American Way to shame alleged \u201cextremists,\u201d has <a href=\"http:\/\/www.rightwingwatch.org\/content\/courting-extremism-gop-attacks-garland-range-pathetic-bizarre\">identified<\/a> yours truly as perpetrating one of the \u201cfive most ridiculous conservative pro-obstruction arguments of the week\u201d opposing Merrick Garland\u2019s confirmation to the Supreme Court. What did I say that has so outraged author Brian Tashman?<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">The group Live Action even <a href=\"\/news\/why-are-abortion-advocates-praising-obamas-scotus-nominee-merrick-garland\/\">said<\/a> that by hailing the release of Blackmun\u2019s papers, Garland \u201chas lavished praised\u201d on Blackmun, \u201cauthor of the legally indefensible Roe v. Wade.\u201d Live Action\u2019s Calvin Freiburger also stated that Republicans should oppose Garland simply because Obama nominated him, saying that the president \u201ca judicial activist at heart and is wildly committed to abortion-on-demand at any time for any reason as a \u2018constitutional right.\u2019\u201d<\/p>\n<p style=\"padding-left: 30px;\">Just to recap, according to the Right Wing, it is now a scandal that a federal judge praised the release of a Supreme Court justice\u2019s papers, and it is controversial that a president fulfilled his constitutional duties to appoint jurists to the bench.<\/p>\n<\/blockquote>\n<p><!--more--><\/p>\n<p>Note well that at no point does Tashman <em>refute<\/em> the objection that Obama is a judicial activist who cannot be trusted to nominate decent jurists. Nor does he show that Obama is correct to deem abortion a constitutional right, or that I\u2019m wrong to declare <em>Roe<\/em> legally indefensible (perhaps because he isn\u2019t used to being reminded that <a href=\"https:\/\/web.archive.org\/web\/20150130144759\/http:\/\/www.washingtonexaminer.com\/the-pervading-dishonesty-of-roe-v.-wade\/article\/1080661\">his own side&#8217;s legal scholars<\/a> admit it, making this one inconvenient truth he can\u2019t dismiss as the work of \u201cright-wing extremists\u201d).<\/p>\n<p>Accordingly, he neglects to mention the other bits of evidence I presented: Garland\u2019s ties to Justice William Brennan, who <a href=\"https:\/\/www.oyez.org\/cases\/1971\/70-18\">voted for <em>Roe<\/em><\/a>, the vast majority of his law clerks going on to other pro-abortion judicial activists, Obama\u2019s admission that Garland would make decisions based on factors other than the text and authorial intent and that he wanted a judge deferential to precedent (such as <em>Roe<\/em>), and NARAL welcoming Garland\u2019s nomination. Since I wrote that we\u2019ve <a href=\"\/news\/obama-nominee-garland-sided-against-priests-for-life-in-contraception-mandate-case\/\">also learned<\/a> that Garland has sided with the Obama Administration\u2019s unconstitutional contraception mandate, and there\u2019s also Obama\u2019s <a href=\"http:\/\/www.npr.org\/templates\/story\/story.php?storyId=126164572\">2010 doublespeak<\/a> confirming that while he says he doesn\u2019t have an abortion litmus test, he totally does:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Obama also said there would be no &#8220;litmus test&#8221; on abortion. But, he added, &#8220;I want somebody who&#8217;s going to be interpreting our Constitution in a way that takes into account individual rights, and that includes women&#8217;s rights.&#8221;<\/p>\n<\/blockquote>\n<p><a href=\"\/news\/equal-rights-amendment-another-effort-sneak-abortion-constitution\/\">We&#8217;re all for women&#8217;s rights<\/a>, but the only time that doesn\u2019t go without saying is if you\u2019re using it as code for abortion.<\/p>\n<p><a href=\"https:\/\/liveaction.org\/petition\/\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-84611\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2016\/01\/NewDefundAd3.jpg\" alt=\"NewDefundAd3\" width=\"400\" height=\"170\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/NewDefundAd3.jpg 400w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/NewDefundAd3-300x128.jpg 300w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>As for his claim we find it \u201ccontroversial that a president fulfilled his constitutional duties to appoint jurists to the bench\u201d\u2014no, Brian, read it again. We object <em>to the illicit constitutional philosophy<\/em> underlying his picks. His \u201cconstitutional duty\u201d is not to pick <em>whoever he wants for whatever reason he wants<\/em>, as if there being nine judges at any given time is the most important thing. His duty, per his <a href=\"https:\/\/memory.loc.gov\/ammem\/pihtml\/pioaths.html\">oath of office<\/a>, is to pick judges that will \u201cpreserve, protect and defend the Constitution of the United States.\u201d For reasons you read but apparently didn\u2019t feel like writing about, Obama\u2019s judicial criteria can do nothing but undermine the Court\u2019s mission.<\/p>\n<p>That leaves us with his complaint that I highlighted Garland\u2019s <a href=\"https:\/\/www.wilsoncenter.org\/event\/becoming-justice-blackmun-harry-blackmuns-supreme-court-journey\">praise<\/a> of Blackmun, specifically his 2005 remarks that the public release of the late <em>Roe<\/em> author\u2019s papers was \u201ca great gift to the country.\u201d Granted, praising the historical value of a historical figure\u2019s documents isn\u2019t necessarily praise of the man himself, but taken in the context of the other aforementioned warning signs, praise as dramatic as \u201cgreat gift\u201d is cause for concern. Besides, we wouldn\u2019t be in the position of having to infer Garland\u2019s views in the first place if Obama was simply open about what he wanted for the judiciary.<\/p>\n<p>Finally, Tashman also blasts other commentators for raising this point:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">As such, all they are left with is the historically inaccurate talking point that the Senate has a \u201ctradition\u201d of refusing to confirm Supreme Court nominees in the final year of a president\u2019s term. Since anyone who performs a simple Google search about past confirmation votes can easily debunk the GOP\u2019s claim, it is hard to see how much longer they can trot this one out.<\/p>\n<\/blockquote>\n<p>Yes, let\u2019s Google, shall we?<\/p>\n<p><a href=\"http:\/\/www.weeklystandard.com\/the-supreme-court-can-handle-a-vacancy-for-a-long-time-just-as-its-done-before\/article\/2001521\">According to<\/a> the Congressional Research Service, the last election-year Supreme Court nomination was 47 years ago, when Chief Justice Earl Warren resigned less than six months before the 1968 election\u2026 and a replacement wasn\u2019t confirmed until after the election. The most recently a nominee was confirmed in an election year was way back in 1932, when Justice Benjamin Cardozo was named to replace retiring Justice Oliver Wendell Holmes Jr.\u2014and even then, President Herbert Hoover agreed to nominate the widely-respected Cardozo <em>despite not sharing his political views<\/em>.<\/p>\n<p>Please, tell us more about historical inaccuracy.<\/p>\n<p>So, at the risk of disappointing the folks at Right Wing Watch, the only things pathetic and false here are their attempts to run interference for Obama\u2019s attempts to rig the Supreme Court to insulate abortion and the rest of his legacy from the voters.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u201cPathetic,\u201d \u201cbizarre,\u201d and \u201cdishonest.\u201d As the saying goes, you know you\u2019re over the target when you\u2019re getting flak.
