Judge William H. Orrick (via cand.uscourts.gov)<\/p><\/div>\n

US District Judge William Orrick\u2019s decision to extend the restraining order against the Center for Medical Progress’s release of undercover videos that involve the National Abortion Federation symbolizes everything corrupt about American jurisprudence today.<\/p>\n

Where judges are supposed to be the most impartial figures in our entire system of government, putting aside personal desire and political preference in favor of objectively ensuring that the law is accurately followed, Orrick\u2019s ruling rejects the facts to benefit a party on which he has a staggering conflict of interest.<\/p>\n

<\/p>\n

As Susan Michelle covered previously<\/a> for Live Action, Orrick raised at least $200,000 for Barack Obama\u2019s election and donated $30,800 to pro-Obama committees (he also donated and bundled<\/a> tens of thousands of dollars to the Democratic National Committee and John Kerry\u2019s 2004 presidential campaign), and his wife Caroline has been described<\/a> as an \u201cavid abortion-rights advocate,\u201d her social media profile indicating<\/a> she\u2019s a fan of a number of radical pro-abortion projects (and other far-left causes), including the Center for Reproductive Justice\u2019s push for a \u201cbill of reproductive rights\u201d (an idea any real judge would know is insane<\/a>) and a \u201cKeep America Pro-Choice\u201d Facebook group that equates<\/a> our government protecting babies with China\u2019s government ordering babies killed.<\/p>\n

Supreme Court Justice Ruth Bader Ginsburg rightly (if hypocritically) declared<\/a> that \u201ca judge sworn to decide impartially can offer no forecasts, no hints, for that would show not only disregard for the specifics of the particular case, it would display disdain for the entire judicial process\u201d\u2014and the Orricks\u2019 activities are much more than hints.<\/p>\n

Accordingly, his latest ruling<\/a> is predicated on \u201cfacts\u201d that are at best immaterial and at worst outright false:<\/p>\n

\n

Critical to my decision are that the defendants agreed to injunctive relief if they breached the agreements and that, after the release of defendants\u2019 first set of Human Capital Project videos and related information in July 2015, there has been a documented, dramatic increase in the volume and extent of threats to and harassment of NAF and its members.<\/p>\n<\/blockquote>\n

The basis? According to his full injunction<\/a>, because NAF told him so. It also notes that Orrick overruled the obvious objections that NAF\u2019s allegations they were under increased threat couldn\u2019t be independently verified, meaning that the good judge has just set the precedent that if your organization is committing major crimes, you can shut up the those who bring them to light by crying \u201cdeath threat!\u201d<\/p>\n

Among those threats, Orrick shamefully tries to tie CMP to the Colorado Springs Planned Parenthood shooting, noting it as the \u201cmost significant\u201d of NAF\u2019s examples because Savita Ginde, who was featured in the videos<\/a>, also worked there. Yes, because it\u2019s totally plausible that mentally-disturbed hermit<\/a> Robert Lewis Dear watched the videos in detail and carefully researched which personnel worked where before deciding to shoot up the place, and didn\u2019t simply snap upon catching wind of a genuine national news story<\/a> (Orrick overruled objections to playing this card, too).<\/p>\n

\n

Having reviewed the records or transcripts in full and in context, I find that no NAF attendee admitted to engaging in, agreed to engage in, or expressed interest in engaging in potentially illegal sale of fetal tissue for profit. The recordings tend to show an express rejection of Daleiden\u2019s and his associates\u2019 proposals or, at most, discussions of interest in being paid to recoup the costs incurred by clinics to facilitate collection of fetal tissue for scientific research, which NAF argues is legal.<\/p>\n<\/blockquote>\n

A \u201cfull review\u201d that somehow missed this part of this video<\/a>:<\/p>\n

\n

When the actors explain, \u201cWe do donate the fees that we get from our researchers, we give a portion back to the clinics as just a thank you for letting us come in,\u201d one NAF representative replies, \u201cYeah, it definitely sounds like something some our members would be really interested in.\u201d The second NAF representative affirms this kickback arrangement to split the money from fetal parts as \u201ca win-win\u201d for the abortion clinics.<\/p>\n<\/blockquote>\n

Affirming that a \u201cthank you\u201d portion of research \u201csounds like something some of our members would be really interested in\u201d sure sounds like more than \u201cbeing paid to recoup the costs.\u201d<\/p>\n

Orrick\u2019s \u201cfull review\u201d also missed this nugget<\/a>:<\/p>\n

\n

Deborah VanDerhei is the National Director for CAPS, an influential committee within Planned Parenthood that drives abortion policy across the organization. VanDerhei refers to payments for fetal tissue as \u201cdonation for remuneration,\u201d which carries the connotation of financial reward or benefit without regard for actual expenses. VanDerhei explains, \u201cI have been talking to the executive director of the National Abortion Federation, we\u2019re trying to figure this out as an industry, about how we\u2019re going to manage remuneration, because the headlines would be a disaster.\u201d<\/p>\n<\/blockquote>\n

Nope, nothing to see here\u2026 but when it comes to CMP\u2019s conduct, Orrick sees plenty that isn\u2019t there:<\/p>\n

\n

The products of that Project \u2013 achieved in large part from the infiltration \u2013 thus far have not been pieces of journalistic integrity, but misleadingly edited videos and unfounded assertions (at least with respect to the NAF materials) of criminal misconduct.<\/p>\n<\/blockquote>\n

Lies. Two forensic analyses<\/a>\u2014one of which was commissioned by Planned Parenthood themselves and conducted by a left-wing, pro-Democrat research firm<\/em>\u2014have both confirmed the videos were not manipulated to make anyone appear to say things they didn\u2019t say. In October, even CNN’s Anderson Cooper and Drew Griffin failed to find any<\/a> of the infamous, mythical deceptive edits.<\/p>\n

When Orrick claims to identify deceptive edits, what he really means is that CMP\u2019s highlight reels omit\u2026<\/p>\n

\n

Dr. [Deborah] Nucatola\u2019s comments that \u201cnobody should be selling tissue. That\u2019s just not the goal here,\u201d and her repeated comments that Planned Parenthood would not sell tissue or profit in any way from tissue donations,\u201d [and] that tissue donation was not about profit, but \u201cabout people wanting to see something good come out\u201d of their situations, \u201cthey want to see a silver lining . . . .\u201d<\/p>\n<\/blockquote>\n

Nonsense. As I detailed here<\/a>, these alleged \u201comissions\u201d aren\u2019t misleading in the slightest. When the statements are considered in their entirety and in context (which Orrick claimed to have done here), it becomes clear that the comments supposedly exonerating Planned Parenthood are really referring to their interest in avoiding the appearance<\/em> of profit, not the reality\u2014Nucatola also says she doesn\u2019t \u201cthink it\u2019s a reservations issue so much as a perception<\/em> issue\u201d and discusses PP affiliates \u201cwant[ing] to come to a number that doesn\u2019t look like<\/em> they\u2019re making money,\u201d that \u201clooks like<\/em> it is a reasonable number for the effort that is allotted on their part\u201d (emphasis added).<\/p>\n

Ultimately, statements from personnel alluding to innocence do not automatically erase other statements far more strongly indicating guilt, like Dr. Mary Gatter saying \u201cin negotiations whoever throws out the figure first is at a loss,\u201d the payment \u201chas to be big enough that it\u2019s worthwhile for me,\u201d and \u201cwe can bump it up. I want a Lamborghini.\u201d Nor do they negate the numerous other laws<\/a> people discuss breaking on the videos\u2026 laws which, despite his job description, Judge William Orrick is scandalously disinterested in ensuring are respected.<\/p>\n","protected":false},"excerpt":{"rendered":"
