Devon Anderson\u2019s handling of the Planned Parenthood investigation.\u00a0 The investigation \u2013 which bizarrely took issue with the witnesses who uncovered Planned Parenthood\u2019s criminal activity and\u00a0<em>not\u00a0<\/em>Planned Parenthood\u2019s actions \u2013 culminated in a grand jury ruling indicting two journalists from the Center for Medical Progress. Napolitano called the outcome a \u201cpolitical hit job,\u201d citing inconsistency in the charges.<\/p>\n<p><!--more--><\/p>\n<p>\u201cAbsolutely this is a political hit job,\u201d said\u00a0<a href=\"http:\/\/www.newsbusters.org\/blogs\/nb\/curtis-houck\/2016\/01\/26\/megyn-kelly-judge-napolitano-blast-political-hit-job-indicting-cmp#sthash.spMCigp2.dpuf\">Napolitano to Megyn Kelly<\/a>. \u00a0\u201cYou used to practice law. \u00a0I used to be on the bench. \u00a0We both know a skilled prosecutor can get a grand jury to indict anything. \u00a0The favorite phrase is you can get a grand jury to indict a ham sandwich if you want.\u201d\u00a0 Napolitano noted that the prosecutors\u2019 monopoly over the information brought before the grand jury plays a role in the startling outcomes that sometimes follow such investigations. \u00a0\u201cThere&#8217;s no judge,\u201d he said. \u00a0\u201cThere\u2019s nobody there on the other side. \u00a0We won&#8217;t know what this prosecutor told the grand jury unless and until there&#8217;s an actual criminal trial.\u201d<\/p>\n<p>First, he explains, David Daleiden was charged with the misdemeanor of trying to buy baby body parts.\u00a0 Daleiden\u2019s indictment reads: \u201c[T]he Defendant\u2026 did then and there unlawfully, intentionally and knowingly offer to buy human organs, namely, fetal tissue, for valuable consideration.\u201d\u00a0 Napolitano explains that this is a \u201ccrime of intent\u201d \u2013 meaning Daleiden must have\u00a0<em>intended<\/em>\u00a0to actually purchase baby body parts for the felony to have been committed.\u00a0 Neither side has attempted to argue that this is true; in fact, Daleiden\u2019s felony charge of creating a fake ID contradicts the idea that he actually intended to buy human organs because the false identity was assumed expressly for the purpose of exposing Planned Parenthood via undercover work.<\/p>\n<p>The charge related to purchasing trafficked organs is also problematic because, in order to charge Daleiden with attempting to buy fetal organs, scrutiny must be placed on the selling party, Planned Parenthood.\u00a0 The only way Planned Parenthood could have been exonerated from the tandem charge of intent to\u00a0<em>sell\u00a0<\/em>human organs would have been if the business had refused Daleiden\u2019s request.<\/p>\n<p>In reality, the exact opposite occurred. \u00a0Planned Parenthood was cooperative in\u00a0<em>every way<\/em> with Daleiden\u2019s propositions and explained their established scheme for carrying out such transactions without legal scrutiny.\u00a0 Indeed, Planned Parenthood\u2019s research director, Melissa Farrell, delineated the protocol that had\u00a0<em>long been in place\u00a0<\/em>for accommodating the transactions of trafficking human organs out of their facility.\u00a0 She even explained how organ trafficking was worked into Planned Parenthood\u2019s operational budget.<\/p>\n<p>Napolitano iterated that Harris County\u2019s indictment of undercover journalists from the Center for Medical Progress was a political hit job.\u00a0 He also cautioned that the act of prosecuting a witness bringing crimes to light threatens to \u201cchill\u201d the investigative efforts of every journalist \u2013 and many government officials, who employ the same tactics in their quest for truth and justice.\u00a0 The audacious precedent set by Harris County in punishing the whistleblower and not the law-breaker is chilling indeed.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Editor&#8217;s Note: Article originally printed at <a href=\"http:\/\/www.texasrighttolife.com\/a\/1987\/Judge-CMP-indicted-for-crimes-of-intent-but-intent-didnt-exist#.VqvJ0sfFoTU\">Texas Right to Life<\/a> on January 29, 2016, and reprinted here with permission.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(Texas Right to Life)\u00a0In two Monday appearances on FoxNews, Judge Andrew Napolitano\u00a0commented on\u00a0Harris County D.A.
