{"id":85376,"date":"2016-01-18T10:47:16","date_gmt":"2016-01-18T15:47:16","guid":{"rendered":"\/news\/?p=85376"},"modified":"2016-01-18T16:31:47","modified_gmt":"2016-01-18T21:31:47","slug":"rubio-attacks-christies-pro-life-cred-latest-gop-debate","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/rubio-attacks-christies-pro-life-cred-latest-gop-debate\/","title":{"rendered":"Rubio attacks Christie&#8217;s pro-life cred at latest GOP debate"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>There was no significant\u00a0discussion of abortion at <a href=\"http:\/\/www.cbsnews.com\/news\/transcript-sixth-republican-top-tier-debate-2016\/\">Thursday night&#8217;s Republican presidential debate<\/a>, except for a brief mention by Ted Cruz of New York being a relatively pro-abortion place (a crazy idea he must have gotten from Americans United for Life&#8217;s\u00a0<a href=\"http:\/\/www.aul.org\/blog\/\">ranking of New York\u00a0among the ten most pro-abortion states,\u00a0<\/a>or NY Governor Andrew Cuomo <a href=\"http:\/\/www.dailywire.com\/news\/2643\/no-cruzs-new-york-values-slam-wont-hurt-him-ben-shapiro\">outright saying<\/a> pro-lifers \u201chave no place in the state of New York\u201d), and Marco Rubio criticizing funding of Planned Parenthood.<\/p>\n<p>In a brief segment, Rubio criticized Obama for making\u00a0Planned Parenthood funding a priority instead of the military. In another, he\u00a0accusing Chris Christie of having donated to Planned Parenthood and of having supported\u00a0pro-abortion Supreme Court Justice Sonia Sotomayor.<\/p>\n<p>The ensuing argument between Cruz and Donald Trump on New York didn\u2019t touch on abortion again, but sparks flew on the latter incident&#8230;<\/p>\n<p><!--more--><\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">RUBIO: Unfortunately, Governor Christie has endorsed many of the ideas that Barack Obama supports, whether it is Common Core or gun control or the appointment of Sonia Sotomayor or the donation he made to Planned Parenthood. Our next president, and our Republican nominee can not be someone who supports those positions.<\/p>\n<p style=\"padding-left: 30px;\">CAVUTO: Governor?<\/p>\n<p style=\"padding-left: 30px;\">CHRISTIE: I stood on the stage and watched Marco in rather indignantly, look at Governor Bush and say, someone told you that because we&#8217;re running for the same office, that criticizing me will get you to that office. It appears that the same someone who has been whispering in old Marco&#8217;s ear too.<\/p>\n<p style=\"padding-left: 30px;\">So the indignation that you carry on, some of the stuff, you have to also own then. So let&#8217;s set the facts straight. First of all, I didn&#8217;t support Sonia Sotomayor. Secondly, I never wrote a check to Planned Parenthood.<\/p>\n<\/blockquote>\n<p>As we <a href=\"\/news\/christie-alleged-planned-parenthood-donation-misquoted\/\">covered<\/a> earlier in the week, the donation accusation stems from a quotation in the Newark Star-Ledger of Christie saying in 1994, \u201cI support Planned Parenthood privately with my personal contribution.\u201d Christie&#8217;s response earlier this month\u00a0was that he was misquoted by the newspaper and had never donated.<\/p>\n<p>National Review\u2019s Ramesh Ponnuru was <a href=\"http:\/\/www.nationalreview.com\/corner\/429843\/christie-misremembers-record-guns-life-judges\">not impressed<\/a> with that explanation:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">Presumably what he actually said was something like, \u201cEven though I am still pro-choice, for now, I oppose Planned Parenthood with every fiber of my being,\u201d and the reporter just misheard him.<\/p>\n<\/blockquote>\n<p>I\u2019m not so sure. On the one hand, it would be an awfully specific thing for a reporter to get wrong. On the other, Christie has never tried to deny that he was pro-choice back then, and <a href=\"\/news\/chris-christie-under-fire-donate-planned-parenthood-1994\/\">became pro-life a year later<\/a>, converted, as so many are, by hearing his preborn daughter\u2019s heartbeat for the first time. So there would be nothing surprising if he had supported Planned Parenthood, nothing that contradicts anything we already know about him, and therefore no incentive to lie about it.<\/p>\n<p>The Sotomayor charge, however, is much clearer. In 2009, Christie <a href=\"http:\/\/www.nationalreview.com\/corner\/429541\/chris-christie-revises-his-record-abortion-guns\">said<\/a>\u00a0in a written press release:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">While Judge Sotomayor would not have been my choice, President Obama has used his opportunity to fill a seat on the Supreme Court by choosing a nominee who has more than proven her capability, competence and ability.<\/p>\n<p style=\"padding-left: 30px;\">I support her appointment to the Supreme Court and urge the Senate to keep politics out of the process and confirm her nomination.<\/p>\n<\/blockquote>\n<p>So not only was his denial absolutely false, his support for a judge <a href=\"http:\/\/archive.lifenews.com\/nat5250.html\">certain to uphold Roe v. Wade<\/a> came well after he knew better.<\/p>\n<p>If someone cornered Christie on this and got him to admit the truth, presumably his defense would be something along the lines of \u201cI showed the proper deference to the president\u2019s prerogative to choose his own appointees, even if I don\u2019t personally agree with them.\u201d This is a <a href=\"\/news\/pro-life-look-ted-cruzs-plan-rein-judicial-activism\/\">popular idea<\/a>\u2014Sotomayor and Elena Kagan got well over sixty votes, and Ruth Bader Ginsburg\u2019s confirmation was just four shy of unanimous\u2014but it\u2019s <a href=\"\/news\/lindsey-graham-so-what-if-the-attorney-general-is-cool-with-stabbing-babies-heads\/\">insane<\/a>.<\/p>\n<p>It comes from a severe misunderstanding of the Appointments Clause of the <a href=\"http:\/\/www.archives.gov\/exhibits\/charters\/constitution_transcript.html\">Constitution<\/a>, which says the president \u201cshall nominate\u201d judges \u201cby and with the advice and consent of the Senate.\u201d Many take this to mean the Senate\u2019s role in the nomination process is limited to ensuring that nominees are professionally qualified for the position, but shouldn\u2019t block someone over ideological disagreements&#8211;hence Christie&#8217;s reference to &#8220;capability, competence, and ability.&#8221;<\/p>\n<p>There is absolutely no basis for that reading in the Constitution, and in fact it\u2019s an abdication of the legislative branch\u2019s role as a check on the executive. As Northwestern University law professor John McGinnis <a href=\"http:\/\/www.heritage.org\/constitution\/#!\/articles\/2\/essays\/91\/appointments-clause\">explains<\/a>:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">The Senate has independent authority in that it may constitutionally refuse to confirm a nominee for any reason. While ideology and jurisprudential &#8220;point of view&#8221; were not among the kinds of concerns listed by the Framers as justifying the requirement of advice and consent, nothing in the text of the clause appears to limit the kind of considerations the Senate can take up. It is thus reasonable to infer that the Framers located the process of advice and consent in the Senate as a check to prevent the President from appointing people who have unsound principles as well as blemished characters. As the President has complete discretion in the use of his veto power, the Senate has complete and final discretion in whether to accept or approve a nomination.<\/p>\n<\/blockquote>\n<p>While he goes on to discuss some of the logistical reasons for why nominees tend not to be rejected over disagreements, there is no principle in play preventing an ideological problem with a nominee from rising to that level.
