Wade"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><em>Roe v. Wade <\/em>has been the most fatal judicial decision in U.S. history. In the aftermath of <em>Roe<\/em>, 58 million babies have been aborted, while <a href=\"\/news\/cnn-special-report-features-hundreds-of-women-who-regret-their-abortions\/\">countless women have been irreparably damaged<\/a> and <a href=\"\/news\/the-suffering-brothers-and-sisters-of-aborted-children\/\">families<\/a> have been <a href=\"\/news\/sister-of-aborted-baby-describes-her-struggles\/\">harmed<\/a> and <a href=\"http:\/\/www.rtl.org\/prolife_issues\/abortion_and_families.html\">torn apart<\/a>.<\/p>\n<p><em>Roe<\/em> was based on multiple mistakes, <a href=\"\/news\/5-things-you-didnt-know-about-roe-v-wade\/\">direct lies<\/a>, and a <a href=\"http:\/\/www.lifenews.com\/2014\/01\/21\/roe-v-wade-unjust-unconstitutional-and-undemocratic\/\">rejection of accurate<\/a> <a href=\"http:\/\/www.ehd.org\/\">science, <\/a>research, and the real Constitution. (Even Ruth Bader Ginsburg <a href=\"http:\/\/www.washingtonexaminer.com\/the-pervading-dishonesty-of-roe-v.-wade\/article\/1080661\">agrees<\/a> that\u00a0<em>Roe<\/em> was &#8220;heavy-handed judicial intervention [which] was difficult to justify.\u201d) However, there are two particularly damaging mistakes &#8211; one made by the justices and one by the attorney who argued the case<\/p>\n<p><strong>FATAL MISTAKE #1: The justices completely missed the intent of the 14th Amendment.<\/strong><\/p>\n<p>The justices behind <em>Roe<\/em> wrote that there was no constitutional basis for protecting preborn life. They rejected the 14th Amendment as a basis for protecting the preborn, even though it recognizes the right to life and equal protection for all persons.<\/p>\n<p>They entirely failed to recognize the specific intent of the Congressional sponsors of the 14th Amendment. The intent &#8211; a key part of interpreting law &#8211; shows that the sponsors wanted to include future vulnerable and oppressed human beings in constitutional equal protection.<\/p>\n<p>Representative John Bingham, a House sponsor, intended the Amendment to be applied universally &#8211; to any and every human being.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> In a speech to Congress, prior to the passage of the 14th Amendment, he declared that the Constitution is \u201cbased upon the equality of the human race. Its primal object must be to protect each human being&#8230;\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p>Senate sponsor Jacob Howard agreed that \u201cthe measure would apply to even the &#8216;humblest, the poorest, the most despised of the human race.'&#8221;<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> Representative H.D. Scott stated: \u201cThe strength of this Government\u2026is in its willingness as well as ability to do equal and exact justice to every human being\u2026\u201d<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> He condemned justice being \u201cmade subservient to interest\u201d and when the strong \u201ccan prey upon the weak and unfortunate with impunity.\u201d<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p>Just as these statements applied to Black Americans at the time, they apply to the preborn now, just as they did on January 22, 1973, and at the time the 14 Amendment was passed. The <em>Roe<\/em> Court would have done well to recognize this clear and constitutional truth.<\/p>\n<p><strong>FATAL MISTAKE #2: The lawyer who argued <em>Roe<\/em> believed women needed abortion to be successful.<\/strong><\/p>\n<p>There are certainly things to admire about Sarah Weddington, the 26-year-old lawyer who successfully argued <em>Roe v. Wade<\/em> before the U.S. Supreme Court. At a very young age, she took on the entire nation to advocate for something she believed in. She didn&#8217;t let her age, gender, or inexperience stop her.<\/p>\n<div id=\"attachment_84756\" style=\"width: 484px\" class=\"wp-caption aligncenter\"><a href=\"\/news\/2-fatal-mistakes-made-by-roe-v-wade\/sarah-weddington-with-a-supporter-roe-v-wade-attorney\/\" rel=\"attachment wp-att-84756\"><img aria-describedby=\"caption-attachment-84756\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-84756 size-large\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2016\/01\/Sarah-Weddington-with-a-supporter-Roe-v.-Wade-attorney-525x700.jpg\" alt=\"CC 2.0 license\" width=\"474\" height=\"632\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/Sarah-Weddington-with-a-supporter-Roe-v.-Wade-attorney-525x700.jpg 525w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/Sarah-Weddington-with-a-supporter-Roe-v.-Wade-attorney-225x300.jpg 225w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2016\/01\/Sarah-Weddington-with-a-supporter-Roe-v.-Wade-attorney.jpg 768w\" sizes=\"(max-width: 474px) 100vw, 474px\" \/><\/a><p id=\"caption-attachment-84756\" class=\"wp-caption-text\">Weddington with a supporter (Photo credit: John and Belinda Bosley)<\/p><\/div>\n<p>However, besides the fact that Weddington was on the completely wrong side of a human justice issue, she also has a sad story in her personal history. Before she married Ron Weddington, she became pregnant with their child in her final year of law school. Neither of them wanted children, and so the couple traveled over the border to Mexico, for an illegal abortion.<\/p>\n<p>Weddington cites her ability to have an abortion as the reason she went on to have a career as a lawyer, and yet countless successful female attorneys have proven Weddington&#8217;s assertion wrong. Women are, in fact, able to be successful <em>and<\/em> to be mothers.<\/p>\n<p>Erika Bachiochi, a feminist and former pro-choice attorney,\u00a0 authored \u201cEmbodied Equality: Debunking Equality Arguments for Abortion Rights\u201d for the Harvard Journal of Law &amp; Public Policy. She also <a href=\"http:\/\/www.cnn.com\/2015\/01\/22\/opinion\/bachiochi-abortion-roe-v-wade\/\">wrote about the real truth on abortion and women <\/a>for CNN:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">As a one-time abortion rights supporter, I well know the temptation to see the right to abortion as a representation of women\u2019s equality. \u2026<\/p>\n<p class=\"zn-body__paragraph\" style=\"padding-left: 30px;\">Abortion betrays women by having us believe that we must become like men \u2014 that is, not pregnant \u2014 to achieve parity with them, professionally, socially, educationally. . \u2026<\/p>\n<p class=\"zn-body__paragraph\" style=\"padding-left: 30px;\">When we belittle the developing child in the womb, a <a href=\"http:\/\/topdocumentaryfilms.com\/national-geographic-in-the-womb\/\" target=\"_blank\" rel=\"noopener\">scientific reality<\/a> that most pro-choice advocates have come to admit, we belittle and distort that child\u2019s mother. We make her out to be one with property rights over her developing unborn child (much as husbands <a href=\"http:\/\/www.britannica.com\/EBchecked\/topic\/141184\/coverture\" target=\"_blank\" rel=\"noopener\">once had property rights over their wives<\/a>).<\/p>\n<p class=\"zn-body__paragraph\" style=\"padding-left: 30px;\">We give her the inhumane (but for 42 years, constitutionally protected) right to decide the fate of another human being, of a vulnerable child \u2014 her child \u2014 to whom she properly owes an affirmative duty of care. We do all this rather than offering her the myriad familial and social supports she needs, whatever her situation, and cherishing her role in the <a href=\"http:\/\/www.pbs.org\/wgbh\/nova\/body\/life-greatest-miracle.html\" target=\"_blank\" rel=\"noopener\">miracle of human life. <\/a><\/p>\n<\/blockquote>\n<p><strong>Conclusion<\/strong><\/p>\n<p>While these two fatal mistakes continue to cost millions of lives, we can each personally work to stop the damage. In our conversations with friends, on social media, on campus, and at our offices, clubs, churches, and groups, we can spread the truths that every human being &#8211; at every stage of development &#8211; deserves equal protection and that no woman needs to take her child&#8217;s life to succeed at life. We can <a href=\"\/news\/next-step-ministry-serves-teen-moms-who-already-chose-life\/\">actively<\/a> and practically <a href=\"\/news\/pro-love-action\/\">help women<\/a> who <a href=\"http:\/\/pregnancyhelpnews.com\/\">make the choice for life<\/a>.<\/p>\n<p>As Carol Tobias, President of the National Right to Life Committee, <a href=\"http:\/\/www.dallasnews.com\/news\/local-news\/20130119-for-sarah-weddington-the-winning-lawyer-in-roe-vs.-wade-celebrity--or-notoriety--came-early.ece\">says:<\/a>\u00a0 \u201cAs long as abortion is legal, pro-lifers will fight and never give up.\u201d<\/p>\n<p><span style=\"text-decoration: underline;\">Sources:<\/span><br \/>\n<a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> CONG.
