{"id":81017,"date":"2015-11-26T13:05:00","date_gmt":"2015-11-26T19:05:00","guid":{"rendered":"\/news\/?p=81017"},"modified":"2024-09-20T12:31:31","modified_gmt":"2024-09-20T17:31:31","slug":"wi-judges-admitting-privileges-ruling-weak-facts-weaker-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/wi-judges-admitting-privileges-ruling-weak-facts-weaker-law\/","title":{"rendered":"WI judge&#8217;s admitting privileges ruling weak on facts, weaker on law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Following the 7<sup>th<\/sup> Circuit Court of Appeals\u2019 <a href=\"\/news\/federal-court-strikes-wisconsin-abortion-law\/\">decision Monday<\/a> to strike down Wisconsin\u2019s admitting privileges requirement for abortion facilities, pro-aborts are hailing <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2015\/D11-23\/C:15-1736:J:Posner:aut:T:fnOp:N:1661222:S:0\">the ruling&#8217;s<\/a> author, Judge Richard Posner, for supposedly landing an authoritative blow against pro-lifers.<\/p>\n<p>Becca Andrews at Mother Jones <a href=\"http:\/\/www.motherjones.com\/mojo\/2015\/11\/wisconsin-judge-just-schooled-abortion-opponents-trap-laws\">calls it<\/a> a \u201cwithering ruling\u201d from a jurist \u201cknown for his tart legal arguments.\u201d Tara Culp-Ressler of ThinkProgress <a href=\"http:\/\/thinkprogress.org\/health\/2015\/11\/24\/3725319\/wisconsin-abortion-federal-court\/\">cheers<\/a> Posner for \u201clay[ing] bare the larger strategy that abortion opponents are pursuing across the country\u201d in \u201cjust three sentences.\u201d And Slate\u2019s Dahlia Lithwick <a href=\"http:\/\/www.slate.com\/articles\/news_and_politics\/jurisprudence\/2015\/11\/wisconsin_s_abortion_law_is_an_unconstitutional_undue_burden.single.html\">says<\/a> he \u201cpretty much just pantses the judges who argue that the real intent of this law is to protect women.\u201d<\/p>\n<p>Let\u2019s see if Posner\u2019s legal arguments, which attempt to show the law is invalid because its medical rationale is a disingenuous front, really are as devastating as they say.<\/p>\n<p><!--more--><\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">As it happens, complications from an abortion are both rare and rarely dangerous\u2014a fact that further attenuates the need for abortion doctors to have admitting privileges [\u2026] Opponents of abortion reveal their true objectives when they procure legislation limited to a medical procedure\u2014 abortion\u2014that rarely produces a medical emergency.<\/p>\n<\/blockquote>\n<p>To support abortion\u2019s safety, Posner cites studies by Tracy Weitz and Kelly Cleland. Bad move for impartiality, Your Honor\u2014Weitz is so radically pro-abortion that she <a href=\"http:\/\/www.lifenews.com\/2014\/07\/17\/activist-admits-she-doesnt-want-abortions-to-be-rare-we-want-as-many-abortions-as-needed\/\">denounces<\/a> the \u201csafe, legal, and rare\u201d mantra as too stigmatizing, directs a think tank <a href=\"\/news\/flawed-biased-turnaway-study-now-claims-95-women-happy-abortion\/\">known for highly flawed abortion research<\/a>, and has <a href=\"\/news\/planned-parenthood-ultrasound-except-using-find-fetal-organs\/\">falsely attacked ultrasound laws<\/a> as too expensive even though abortion facilities\u00a0already pay for and routinely use them.<\/p>\n<p>Taking their work at face value means not bothering to check out the <a href=\"\/news\/salon-freaks-pro-lifers-holding-journalists-standards\/\">substantial evidence<\/a> that we don\u2019t really know how dangerous abortions are to women because abortion data is <a href=\"\/news\/unnoticed-tragedies-the-problem-of-abortion-underreporting-in-the-u-s\/\">notoriously underreported<\/a> and because abortion-related deaths get miscategorized as pregnancy-related deaths.<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">A woman who experiences complications from an abortion will go to the nearest hospital, which will treat her regardless of whether her abortion doctor has admitting privileges. As pointed out in a brief filed by the American College of Obstetricians and Gynecologists, the American Medical Association, and the Wisconsin Medical Society, \u201cit is accepted medical practice for hospital-based physicians to take over the care of a patient and whether the abortion provider has admitting privileges has no impact on the course of the patient\u2019s treatment.\u201d<\/p>\n<\/blockquote>\n<p>If Posner thinks admitting privileges are unnecessary, then his quarrel isn\u2019t with pro-lifers\u2014it\u2019s with the <a href=\"\/news\/abortion-doctors-and-admitting-privileges-are-clinics-being-treated-unfairly\/\">unanimous consensus of 32 medical organizations<\/a>, including the American Medical Association, American College of Obstetricians and Gynecologists, American College of Surgeons, and Federation of State Medical Boards, that \u201cphysicians performing office-based surgery must have admitting privileges at a nearby hospital, a transfer agreement with another physician who has admitting privileges at a nearby hospital, or maintain an emergency transfer agreement with a nearby hospital.\u201d At least\u2014that was what they said before getting the memo that their professional opinion was inconveniencing the abortion lobby.<\/p>\n<p>Why? Of course anyone who shows up at a hospital or calls 911 is going to get treatment in an emergency. But as American Association for Accreditation of Ambulatory Surgical Facilities president Dr. Geoffrey Keyes has <a href=\"http:\/\/www.montgomeryadvertiser.com\/story\/news\/politics\/southunionstreet\/2014\/06\/05\/state-witness-admitting-privileges-can-help-patients\/10016215\/\">explained<\/a>, there\u2019s more to good care than that:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">&#8220;If you perform procedures, and someone goes to the hospital, you know what transpired in the procedure,&#8221; Keyes said by video link Thursday morning. &#8220;You&#8217;re not starting from scratch. You&#8217;ve been there in the whole process.&#8221; [\u2026]<\/p>\n<p style=\"padding-left: 30px;\">Keyes, who has testified in favor of similar laws in Wisconsin and Mississippi, testified that his organization &#8220;would not look favorably&#8221; on doctors who, like those at local abortion clinics, travel from elsewhere to perform the procedures.<\/p>\n<p style=\"padding-left: 30px;\">&#8220;There&#8217;s no continuity of care, no credentialing of physicians in the community,&#8221; he said.<\/p>\n<\/blockquote>\n<p>But don\u2019t take a pro-life expert witness\u2019s word for it. When commenting on the hospitalization of comedian Joan Rivers shortly before her death last year, NBC News chief medical editor Nancy Snyderman <a href=\"http:\/\/www.newsbusters.org\/blogs\/jill-stanek\/2014\/09\/01\/nbcs-dr-nancy-snyderman-joan-rivers-emergency-underlines-importance-hos\">stressed<\/a> that it was important to \u201cmake sure your doctor has admitting privileges to the local hospital,\u201d calling it potentially life-saving.<\/p>\n<p>Posner continued:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">No other procedure performed outside a hospital, even one as invasive as a surgical abortion, is required by Wisconsin law to be performed by doctors who have admitting privileges at hospitals within a specified radius of where the procedure is performed. And that is the case even for procedures performed when the patient is under general anesthesia, and even though more than a quarter of all surgical operations in the United States are now performed outside of hospitals.<\/p>\n<\/blockquote>\n<p>This may indict lawmakers as negligent when it comes to other medical procedures, but it doesn\u2019t make abortion facility\u00a0regulations unnecessary\u2014and it has nothing to do with Posner\u2019s job, which is determining constitutionality. There\u2019s no Equal Protection Clause for medical procedures.<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">If a burden significantly exceeds what is necessary to advance the state\u2019s interests, it is \u2018undue\u2019 which is to say unconstitutional. The feebler the medical grounds (in this case, they are nonexistent), the likelier is the burden on the right to abortion to be disproportionate to the benefits and therefore excessive.<\/p>\n<\/blockquote>\n<p>For the third time in the past two weeks, the \u201cundue burden\u201d test <a href=\"\/news\/will-undue-burden-test-throw-wrench-supreme-court-case-tx-abortion-law\/\">is not constitutional law<\/a>. The purpose of a Constitution is to place clear limits on government power which politicians can\u2019t weasel around\u2014\u201cin questions of power, then, let no more be heard of confidence in man, but bind him down from mischief by the chains of the Constitution,\u201d Thomas Jefferson <a href=\"http:\/\/press-pubs.uchicago.edu\/founders\/documents\/v1ch8s41.html\">put it<\/a>. If a federal action violates the people\u2019s natural rights without express authorization from a specific constitutional provision, end of discussion. If a state action does not violate a specific tenet of the state or federal Constitution, end of discussion.<\/p>\n<p>The \u201cundue burden\u201d test turns that on its head. Asking judges to decide the <em>degree<\/em> to which an interest is <em>compelling<\/em> intrinsically demands subjectivity, value judgments, and consideration of innumerable factors other than the law.<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">A great many Americans, including a number of judges, legislators, governors, and civil servants, are passionately opposed to abortion\u2014as they are entitled to be. But persons who have a sophisticated understanding of the law and of the Supreme Court know that convincing the Court to overrule Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey is a steep uphill fight, and so some of them proceed indirectly, seeking to discourage abortions by making it more difficult for women to obtain them.<\/p>\n<\/blockquote>\n<p>In other words, pro-lifers are damned if they try to directly challenge <em>Roe v. Wade<\/em>, and damned if we try to play by <em>Roe\u2019s<\/em> rules\u2014a situation far more politically manipulative than what Posner claims to refute.<\/p>\n<p>That\u2019s how his ruling can seem superficially compelling but ultimately not be: his logic may be internally consistent given the legal precedent he\u2019s assuming as a given, but that precedent <a href=\"\/news\/columbia-prof-tries-fails-find-real-constitutional-right-abortion\/\">is itself legally weak and politically biased<\/a>.<\/p>\n<p>So sorry, pro-aborts, but if you hoped this was the definitive legal takedown of pro-lifers, you\u2019ll have to keep looking.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Following the 7th Circuit Court of Appeals\u2019 decision Monday to strike down Wisconsin\u2019s admitting privileges requirement for abortion facilities, pro-aborts are hailing the ruling&#8217;s author, Judge Richard Posner, for supposedly landing an authoritative blow against pro-lifers.
