{"id":80196,"date":"2015-11-17T08:32:25","date_gmt":"2015-11-17T13:32:25","guid":{"rendered":"\/news\/?p=80196"},"modified":"2015-11-17T09:59:31","modified_gmt":"2015-11-17T14:59:31","slug":"will-undue-burden-test-throw-wrench-supreme-court-case-tx-abortion-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/will-undue-burden-test-throw-wrench-supreme-court-case-tx-abortion-law\/","title":{"rendered":"Will &#8220;undue burden&#8221; test throw a wrench into Supreme Court case on TX abortion law?"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Now that we know the US Supreme Court will <a href=\"\/news\/u-s-supreme-court-will-hear-texas-abortion-case\/\">hear the case<\/a> of Texas\u2019s law subjecting abortion clinics to admitting privilege and ambulatory surgical standards, KUT News 90.5 in Austin, TX <a href=\"http:\/\/kut.org\/post\/scotus-use-undue-burden-test-decide-if-texas-abortion-law-constitutional\">reports<\/a> that the Supremes will decide the law\u2019s fate by applying the \u201cundue burden test,\u201d which assumes as a given that the right to abortion is constitutionally valid yet <a href=\"https:\/\/www.law.cornell.edu\/wex\/undue_burden\">considers<\/a> whether the law places a \u201csubstantial obstacle\u201d on exercising that right&#8230;<\/p>\n<p><!--more--><\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">&#8220;The state has wide discretion to pass laws ensuring Texas women are not subject to substandard conditions at abortion facilities,&#8221; said Attorney General Ken Paxton in a statement. &#8220;The advancement of the abortion industry\u2019s bottom line shouldn\u2019t take precedent over women\u2019s health, and we look forward to demonstrating the validity of these important health and safety requirements in Court.\u201d<\/p>\n<p style=\"padding-left: 30px;\">Amy Hagstrom Miller, the lead plaintiff in the case against the law, however, says what it does in practice is deny women their right to an abortion.<\/p>\n<p style=\"padding-left: 30px;\">&#8220;Driving hundreds of miles and waiting 20 days for an appointment &#8212; that is by far and away undue burden,&#8221; Hagstrom Miller says.<\/p>\n<\/blockquote>\n<p>Objectively, the merits would seem to be on pro-lifers\u2019 side. Last year, Texas Right to Life <a href=\"http:\/\/www.texasrighttolife.com\/a\/1140\/Texas-Appellate-Court-Unconvinced-by-Planned-Parenthoods-Unsound-quotUndue-Burdenquot-Argument#.Vkot0Mo7CRs\">noted<\/a> that despite receiving almost 20,000 comments about the law, the Texas Department of State Health Services admitted that none of them contained \u201cany basis to believe that abortion providers would be unable to make similar adjustments\u201d to complaining abortion providers who \u201cnonetheless received admitting privileges and either stayed open or reopened.\u201d<\/p>\n<p>This \u201cclaim is deeply deceptive,\u201d they further <a href=\"http:\/\/www.texasrighttolife.com\/a\/1614\/Fifth-Circuit-Court-of-Appeals-enforces-crucial-Lifesaving-provisions-of-HB-2#.Vkot9co7CRs\">write<\/a>, since abortion advocates here are pretending that women in El Paso will drive three hours east to San Antonio, instead of driving 20 minutes west to the abortion clinic in Santa Teresa, New Mexico, or driving 45 minutes northwest to a new abortion clinic in Las Cruces, New Mexico.&#8221;<\/p>\n<p>Unfortunately, reasonableness often has <a href=\"\/news\/john-roberts-defection-spells-trouble-for-overturning-roe\/\">little to do<\/a> with <a href=\"\/news\/pro-life-look-ted-cruzs-plan-rein-judicial-activism\/\">SCOTUS&#8217;s decisions<\/a>. The problem is that the ground has been gerrymandered to pro-aborts\u2019 liking before the question was even asked. \u201cUndue burden\u201d is yet another incident of the modern judiciary\u2019s <a href=\"http:\/\/www.anncoulter.com\/columns\/2005-07-06.html\">bad habit<\/a> of interpreting the Constitution not through a straightforward reading of what its provisions\u2019 authors said it meant versus the statute before the court, but through convoluted \u201ctests\u201d originating solely in judges\u2019 personal notions of justice.<\/p>\n<p>Among this particular test\u2019s shortcomings is that \u201cundue burden\u201d <a href=\"http:\/\/www.texasrighttolife.com\/a\/1417\/HB2-arguments-conclude-Texans-await-verdict-from-panel-of-judges#.Vko4Nso7CRt\">does not have<\/a> a precise or objective legal meaning and is therefore subject to the biased interpretation of any individual judge and that it <a href=\"\/news\/myths-about-roe-v-wade\/\">flips the burden of proof<\/a> from the feds having to prove that their intervention serves a \u201ccompelling interest\u201d not otherwise achievable to the states having to prove they\u2019re playing nice with the judiciary\u2019s favored legal fictions such as Roe v. Wade.<\/p>\n<p>This is not how the constitutionality of controversial laws is supposed to be decided. Indeed, the word \u201cconstitutionality\u201d should be a clue that the question is far simpler: <em>does the Constitution allow us to do this?<\/em> Let\u2019s do a quick walk-through of how a properly functioning judiciary would decide this one:<\/p>\n<ol>\n<li><a href=\"http:\/\/thomas.loc.gov\/home\/histdox\/fed_45.html\">According to<\/a> Father of the Constitution James Madison, \u201cThe powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite,\u201d extending to \u201call the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State.\u201d Are we dealing with a federal or state law? State? Okay, that means the general supposition is that Texas can do it unless something in their or the federal Constitution says otherwise.<\/li>\n<li>Does anything in the US Constitution say there is a right to abortion that states are bound to respect, or that abortion clinics warrant a special exemption from government regulation? <a href=\"\/news\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">Despite Roe v. Wade<\/a>, no, it does not.<\/li>\n<li>Does anything in the US Constitution forbid states from imposing safety regulations on private entities? No, it does not. The body of the document is solely concerned with restricting the federal government. Its only provision touching on the subject, the Commerce Clause, <a href=\"\/news\/obamacare-tramples-constitution\/\">only touches activity crossing state lines<\/a>, and does so for a very limited purpose. And <a href=\"http:\/\/www.heritage.org\/constitution\/#!\/amendments\/1\">none of its amendments<\/a> have added any provisions saying otherwise.<\/li>\n<li>Does anything in the Texas Constitution tie the legislature\u2019s hands in this area in any ways that differ from the US Constitution? Again, no. The word \u201cabortion\u201d is again <a href=\"http:\/\/www.statutes.legis.state.tx.us\/SearchResults.aspx?CP=1&amp;Code=CN&amp;Phrase=abortion\">nowhere to be found<\/a>, and neither <a href=\"https:\/\/www.plannedparenthood.org\/planned-parenthood-center-for-choice\/texas-abortion-laws\">Planned Parenthood<\/a> nor <a href=\"https:\/\/www.plannedparenthood.org\/planned-parenthood-center-for-choice\/texas-abortion-laws\">NARAL&#8217;s<\/a> overviews of state abortion laws can identify a specific section that has supposedly been violated.<\/li>\n<\/ol>\n<p>I hope the Supreme Court sides with Texas\u2019s pro-life lawmakers and the pregnant women they\u2019re protecting, but can\u2019t say I\u2019m expecting them to do the right thing. <a href=\"\/news\/pro-life-look-ted-cruzs-plan-rein-judicial-activism\/\">Reforming the judiciary<\/a> and the legislative branch\u2019s checks on it, to give pro-life voters a fighting chance of passing meaningful laws without being disenfranchised at every turn, is long overdue.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Now that we know the US Supreme Court will hear the case of Texas\u2019s law subjecting abortion clinics to admitting privilege and ambulatory surgical standards, KUT News 90.5 in Austin, TX reports that the Supremes will decide the law\u2019s fate by applying the \u201cundue burden test,\u201d which assumes as a given that the right to [&hellip;]<\/p>\n","protected":false},"author":54,"featured_media":65993,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false},"categories":[3],"tags":[19,3795,253,2546,5016,259,197,82,3800],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Will &quot;undue burden&quot;
