The answers she <em>did<\/em> manage to give raised their own legal questions. Let&#8217;s discuss.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/aR6tX8EQoA4\" width=\"420\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\n<!--more--><\/p>\n<p>Investigating a taxpayer funded organization that has been caught on tape with at least the suggestion of scandal and law-breaking\u00a0 is the legally responsible thing to do &#8211; especially considering the fact that 41% of Planned Parenthood&#8217;s annual budget <a href=\"\/news\/five-little-known-facts-about-planned-parenthood\/\">comes from government<\/a> &#8211; i.e., taxpayer &#8211; money.<\/p>\n<p>Cecile Richards is smart enough to know that being noncompliant with Congress will land her in the doghouse with the American public. In the hearing, she made a big show &#8211; some might term it grandstanding &#8211; declaring her great and amazing and awesome and wonderful cooperation. And then, she proved to be very <em>un<\/em>cooperative &#8211; and to even outright lie &#8211; when the information didn&#8217;t suit her or paint Planned Parenthood in a pleasant light.<\/p>\n<p><strong>1) Richards is only familiar with the info on Planned Parenthood that benefits her &#8211; a legal red flag.<\/strong><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-54863\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2014\/10\/cecile-richards.jpg\" alt=\"cecile-richards\" width=\"1200\" height=\"800\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2014\/10\/cecile-richards.jpg 1200w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2014\/10\/cecile-richards-300x200.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2014\/10\/cecile-richards-700x466.jpg 700w\" sizes=\"(max-width: 1200px) 100vw, 1200px\" \/><\/p>\n<p>Richards played the martyr when asked questions she preferred to evade, claiming the vast broadness of Planned Parenthood wealth makes it virtually impossible for her to know all that goes on within the abortion giant. When she was repeatedly asked how much of Planned Parenthood&#8217;s income comes from abortion she seemed unsure if the data was even possible to obtain.<\/p>\n<p>Similarly, when Rep. DeSantis asked Richards, &#8220;If a child survives an abortion attempt, should it be given nourishment and medical care?\u201d she responded with an easy, &#8220;I\u2019ve never heard of such a circumstance happening&#8230; in my experience at Planned Parenthood, we haven\u2019t ever had that kind of circumstance.\u201d<\/p>\n<p>First, practically everyone has heard of babies who survive abortion attempts, notably because one of them &#8211; Gianna Jessen &#8211; <a href=\"\/news\/planned-parenthood-president-babies-have-never-born-alive-after-botched-abortions\/\">recently testified to Congress<\/a> about how she has paperwork to prove <a href=\"\/news\/rh-reality-check-called-abortion-survivors-myth-two-myths-just-testified-congress\/\">she survived an abortion<em>.<\/em><\/a><\/p>\n<p>Secondly, what exactly is Ms. Richards&#8217; &#8220;experience&#8221; in this regard? She&#8217;s <a href=\"\/news\/he-used-to-be-an-abortionist-save-lives-of-preborn\/\">not an abortionist<\/a>. She doesn&#8217;t work at any of the clinics. How can her &#8220;experience&#8221; be trusted on this matter, especially when she claims to be so unfamiliar with the details of her various facilities?<\/p>\n<p><strong>2) Richards clearly doesn&#8217;t understand &#8211; or admit &#8211; Planned Parenthood&#8217;s legal responsibility.<\/strong><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-68361\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/07\/Holly-ODonnell.jpg\" alt=\"Holly-ODonnell\" width=\"1920\" height=\"1080\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/07\/Holly-ODonnell.jpg 1920w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/07\/Holly-ODonnell-300x169.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/07\/Holly-ODonnell-700x394.jpg 700w\" sizes=\"(max-width: 1920px) 100vw, 1920px\" \/><\/p>\n<p>Richards made double claims on the testimony of Holly O&#8217;Donnell (claiming she read all the transcripts, but couldn&#8217;t remember <a href=\"\/news\/breaking-brain-harvested-from-intact-baby-with-a-beating-heart-says-eyewitness-inside-planned-parenthood\/\">what O&#8217;Donnell said<\/a>). O&#8217;Donnell is the StemExpress technician who shared\u00a0about <a href=\"\/news\/yes-planned-parenthood-kills-infants-born-alive-abortions\/\">the living baby boy<\/a> whose <a href=\"\/news\/the-case-for-prosecuting-planned-parenthood-and-stemexpress\/\">face was sliced open and his brain harvested<\/a> at the San Jose Planned Parenthood abortion facility.<\/p>\n<p>Despite Richards&#8217; claim that &#8220;that woman does not work at Planned Parenthood&#8230;I\u2019m not responsible for her,&#8221; she&#8217;s wrong. Because Planned Parenthood staff are the ones who handed this living baby over to Stem Express technicians\u2014and because the baby was killed after a live birth <em>in a Planned Parenthood clinic\u2014<\/em>\u00a0Planned Parenthood is <a href=\"\/news\/the-case-for-prosecuting-planned-parenthood-and-stemexpress\/\">very much legally responsible<\/a> \u2014\u00a0at the very least <a href=\"\/news\/ca-officials-receive-live-action-letter-demanding-investigation-into-baby-parts-sales\/\">for gross criminal negligence.<\/a><\/p>\n<p><strong>3) Richards&#8217; viability claim is a complete lie.<\/strong><\/p>\n<div id=\"attachment_63472\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-63472\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-63472\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/05\/Screen-shot-2015-05-07-at-11.36.22-AM1.png\" alt=\"Planned Parenthood aborts babies who could survive.\" width=\"700\" height=\"464\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/05\/Screen-shot-2015-05-07-at-11.36.22-AM1.png 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/05\/Screen-shot-2015-05-07-at-11.36.22-AM1-300x199.png 300w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><p id=\"caption-attachment-63472\" class=\"wp-caption-text\">Planned Parenthood aborts babies who could survive.<\/p><\/div>\n<p>Richards said, very clearly, to Rep. DeSantis: &#8220;we don\u2019t provide abortions after, um, viability.&#8221; And yet, as just one example, the Planned Parenthood Margaret Sanger abortion facility\u00a0in New York City publicly claims, on its website, to perform abortion up to 24 weeks.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-75901\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/10\/PP-Lie.jpg\" alt=\"Planned Parenthood, viability, abortion, new york, lie, margaret sanger\" width=\"868\" height=\"150\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/10\/PP-Lie.jpg 868w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/10\/PP-Lie-300x52.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/10\/PP-Lie-700x121.jpg 700w\" sizes=\"(max-width: 868px) 100vw, 868px\" \/><\/p>\n<p>With modern medicine, viability &#8211; when a baby can survive outside the womb &#8211; comes at 22 weeks<em>.\u00a0<\/em>By 23\u00a0to\u00a024 weeks, a baby&#8217;s survival is almost guaranteed if she is born premature and given appropriate care. From 22\u00a0to\u00a024 weeks, some babies have survived even without extra care, as the study below indicates. Even <em>Roe v. Wade <\/em>and <em>Planned Parenthood v. Casey &#8211; <\/em>decade<em>s-<\/em>old abortion rights cases<em> &#8211; <\/em>state that viability can be achieved at 23 or 24 weeks.<\/p>\n<p>A <a href=\"\/news\/new-study-shows-many-premature-babies-can-survive-as-early-as-22-weeks\/\">new study in The New England Journal of Medicine,<\/a> from the spring of 2015, found:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">[A] new study has found that a significant number of babies born at 22 weeks will survive if they receive life-saving treatment.<\/p>\n<p style=\"padding-left: 30px;\">Nearly one out of every four babies born at that early date was able to live after receiving medical treatment, according to a study published today in <em>The New England Journal of Medicine<\/em>.<\/p>\n<p style=\"padding-left: 30px;\">Five percent of babies born at 22 weeks survived without any outside assistance, according to the <em>Wall Street Journal<\/em>.<\/p>\n<\/blockquote>\n<p>Could Richards have told a more hard-core lie?<\/p>\n<p><strong>4) Richards&#8217; viability claim proves her ignorance of the law.<\/strong><\/p>\n<div id=\"attachment_59656\" style=\"width: 437px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-59656\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-59656\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/02\/walter-028.jpg\" alt=\"Walter Joshua Fretz who lived 19 weeks.\" width=\"427\" height=\"640\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/02\/walter-028.jpg 427w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/02\/walter-028-200x300.jpg 200w\" sizes=\"(max-width: 427px) 100vw, 427px\" \/><p id=\"caption-attachment-59656\" class=\"wp-caption-text\"><a href=\"\/news\/baby-walter-was-born-too-young-but-his-fathers-simple-decision-ensures-a-lasting-legacy\/\">Walter Joshua Fretz<\/a> who lived 19 weeks and <a href=\"\/news\/baby-walter-was-born-too-young-but-his-fathers-simple-decision-ensures-a-lasting-legacy\/\">was born alive<\/a>, with his heart beating. Credit: Lexi Fretz &amp; F2 Photography<\/p><\/div>\n<p>Richards&#8217; claim that babies aren&#8217;t ever born alive at Planned Parenthood seemed to be largely\u00a0based on her lie that Planned Parenthood doesn&#8217;t abort viable babies. However, the law on giving treatment and care to born-alive infants has absolutely nothing to do with whether they are viable.<\/p>\n<p>In fact, <a href=\"\/news\/ca-officials-receive-live-action-letter-demanding-investigation-into-baby-parts-sales\/\">the law is incredibly simple<\/a>: if a baby is born alive <em>at absolutely any age of gestation<\/em>, she is considered a legal person, and deserves medical treatment and care &#8211; not to have his face sliced open and his brain harvested. DeSantis asked Richards if Planned Parenthood alters abortion procedures to &#8220;better harvest&#8221; baby body parts, Richards answered a completely different question &#8211; pointing to Planned Parenthood&#8217;s guilt.<\/p>\n<p>She said, &#8220;We have a very clear policy, which I\u2019m happy to read to you, about how we allow patients to make fetal tissue donations.\u201d<\/p>\n<p>What? The question was whether or not abortions are altered to better harvest organs and body parts (something top Planned Parenthood doctor Deborah Nucatola &#8211; whom Richards is &#8220;<a href=\"\/news\/planned-parenthood-ceo-tells-congress-she-is-proud-of-abortionist-caught-discussing-how-to-crush-babies\/\">proud of<\/a>&#8221; &#8211; <a href=\"\/news\/breaking-planned-parenthood-director-caught-on-tape-selling-aborted-baby-parts\/\">vividly described doing<\/a>).<\/p>\n<p>By her failure to answer, Richards answered loud and clear.<\/p>\n<p><strong>6) Richards proved Planned Parenthood&#8217;s disregard for the law by turning an important task over to medical personnel instead of legal experts.<\/strong><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-74065\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/09\/Screen-Shot-2015-09-15-at-8.47.44-AM.png\" alt=\"russo, planned parenthood, law\" width=\"1349\" height=\"656\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/09\/Screen-Shot-2015-09-15-at-8.47.44-AM.png 1349w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/09\/Screen-Shot-2015-09-15-at-8.47.44-AM-300x146.png 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/09\/Screen-Shot-2015-09-15-at-8.47.44-AM-700x340.png 700w\" sizes=\"(max-width: 1349px) 100vw, 1349px\" \/><\/p>\n<p>Rep. DeSantis asked Richards if, since the release of the videos, Planned Parenthood has &#8220;issued any updated guidance&#8221; to the companies who get baby parts from Planned Parenthood \u201cregarding the sale of fetal body parts for profit and\/or the manipulation of abortion procedures?&#8221;<\/p>\n<p>After answering a blunt, \u201cno,&#8221; Richards further explained:<\/p>\n<blockquote>\n<p style=\"padding-left: 30px;\">\u201cWe\u2019ve\u2026I\u2019ve asked our chief medical officer and our medical team to review all the work we do\u2026to ensure that if there are any things we could be doing better, we would like to do that.\u201d<\/p>\n<\/blockquote>\n<p>If Planned Parenthood was truly concerned about following the law, it would absolutely be asking legal experts to review its guidelines and ensure that things were being done correctly.
