One school of thought holds that we should chip away at abortion with incremental reforms like <a href=\"..\/planned-parenthood-notification-bill\/\">parental notification<\/a> and <a href=\"..\/judge-declares-pro-life-texas-sonogram-measure-unconstitutional\/\">sonogram bills<\/a>, and wait until <em><a href=\"..\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">Roe v. Wade<\/a><\/em> gets overturned to attempt more comprehensive abortion bans, since the latter would just get struck down by the courts anyway. Others think we should try to bypass <em>Roe<\/em> completely with a <a href=\"http:\/\/www.nchla.org\/issues.asp?ID=46\">constitutional amendment<\/a> permanently securing the rights of the unborn in American law.<\/p>\n<p>Both sides have a compelling pragmatic case, but there is one critical point which I believe incrementalist arguments don\u2019t sufficiently account for: <em>Roe\u2019s<\/em> overturn is nowhere near as close as many would like to believe.<!--more--><\/p>\n<p>Conventional wisdom holds that there are currently four anti-<em>Roe<\/em> justices on the Supreme Court\u2014Antonin Scalia, Clarence Thomas, John Roberts, and Samuel Alito\u2014so only one more is needed for a majority. But in reality, while <a href=\"http:\/\/www.lifesitenews.com\/news\/archive\/ldn\/1961\/jan\/6101705\">Scalia<\/a> and <a href=\"http:\/\/www.visionforum.com\/news\/blogs\/doug\/2007\/04\/2483\/\">Thomas<\/a> are reliable, the jury\u2019s still out on Roberts and Alito.<\/p>\n<p>As Deputy Solicitor General, Roberts coauthored a <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?navby=search&amp;court=US&amp;case=\/us\/500\/173.html\">1991 brief<\/a> arguing against <em>Roe<\/em>, and he did vote to uphold the Partial-Birth Abortion Ban Act in <em><a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/05-380.ZS.html\">Gonzales v. Carhart<\/a><\/em>. However, in <em>Gonzales<\/em> he declined to join Thomas and Scalia in a concurring opinion that called for <em>Roe\u2019s<\/em> overturn, and most troubling, during <a href=\"http:\/\/www.asksam.com\/ebooks\/releases.asp?file=JGRHearing.ask\">his Senate confirmation hearings<\/a> he said:<\/p>\n<blockquote><p><em>Roe v. Wade is the settled law of the land. It&#8217;s a little more than settled. It was reaffirmed in the face of a challenge that it should be overruled in the Casey decision. Accordingly, it&#8217;s the settled law of the land. There&#8217;s nothing in my personal views that would prevent me from fully and faithfully applying that precedent, as well as Casey.<\/em><\/p><\/blockquote>\n<p>Alito\u2019s abortion record <a href=\"http:\/\/www.ft.com\/cms\/s\/2\/558e739e-4b06-11da-aadc-0000779e2340.html#axzz1arIg3OcL\">is also mixed<\/a>, containing instances where he has both upheld and struck down pro-life laws. As a White House lawyer in 1985, he <a href=\"http:\/\/www.usatoday.com\/news\/washington\/2005-12-23-alito-roe-memo_x.htm\">argued<\/a> President Reagan\u2019s position that <em>Roe<\/em> should be overturned, and in <a href=\"http:\/\/www.asksam.com\/ebooks\/releases.asp?file=Alito_Hearing.ask\">his 2006 Senate confirmation testimony<\/a> he merely said of <em>Roe<\/em> that he \u201cwould approach the question with an open mind.\u201d But his testimony was also far too deferential to the concept of <em>stare decisis<\/em> (the authority of past rulings):<\/p>\n<blockquote><p><em>[I]t&#8217;s important because it reflects the view that courts should respect the judgments and the wisdom that are embodied in prior judicial decisions. It&#8217;s not an exorable command, but it is a general presumption that courts are going to follow prior precedents [\u2026] <\/em><strong><em>I don&#8217;t agree with the theory that the Constitution always trumps stare decisis. <\/em><\/strong><em>There would be no room for the doctrine of stare decisis in constitutional law if that were the case. [Emphasis added.]<\/em><em><\/em><\/p><\/blockquote>\n<p>So we <em>might<\/em> only need one more vote to vanquish <em>Roe<\/em>\u2026or we might need three. And that\u2019s assuming the next president will appoint pro-lifers, rather than brand-new pro-aborts. That\u2019s also assuming that Scalia (age 75) and Thomas (age 63) remain on the Court long enough to rule on abortion again. Barack Obama appointing a relatively young replacement for either judge is all it would take to ensure that <em>Roe<\/em> continues to dominate US abortion law for another generation.<\/p>\n<p>Granted, considering the <a href=\"http:\/\/pollingreport.com\/abortion.htm\">public&#8217;s mixed feelings<\/a> about abortion, reaching the <a href=\"http:\/\/www.usconstitution.net\/constam.html\">high bar necessary<\/a> to amend the Constitution (passage by two thirds of Congress or 33 states, then ratification by 38 states) would also be a difficult, long-term battle. Even so, we at the grassroots level can at least do <em>something<\/em> about public opinion, whereas our influence over the judiciary is virtually nonexistent.<\/p>\n<p>We may sometimes struggle to determine the right strategies in the battle against abortion, but one thing should be clear to everyone: we won\u2019t get anywhere if we simply wait for someone else to tear down roadblocks like <em>Roe v.
