The pleas of one of the fetal procurement companies implicated in the undercover Planned Parenthood videos have been squelched by the court<\/a> today.\u00a0 StemExpress sued in late July<\/a> for a temporary restraining order, preventing Center for Medical Progress (CMP) from releasing any videos featuring high-ranking officials from the company from a meeting with CMP actors. Today, a\u00a0 California superior court ruled against StemExpress.<\/p>\n

<\/p>\n

In its decision, the court said:<\/a><\/p>\n

\n
Because Plaintiff seeks discovery in support of its effort to obtain a preliminary injunction, to qualify for the \u201cgood cause shown\u201d\u00a0 exception, the discovery Plaintiff wants to conduct must be necessary to support that effort.<\/div>\n
Plaintiff does not persuade the Court that the discovery it seeks is necessary to obtain the preliminary injunction. That is because it appears unlikely that the Court is going to grant the preliminary injunction. The injunction Plaintiff seeks would prevent Defendants from disseminating the videotapes. First, this proposed injunction would constitute a prior restraint on the Defendants’ rights under the First Amendment and the parallel protections under the California Constitution.<\/div>\n<\/blockquote>\n

The second reason the court lists for denying StemExpress is one that may be even more troubling to Planned Parenthood. Naysayers of CMP’s work say that it was obtained illegally so that should make it worthless. CMP mainatains it has collected all its information within the bounds of the law and that will be shown over time.<\/p>\n

Second, even if Plaintiff’s evidence demonstrates that the videotapes were obtained in violation of Penal Code Section 632, Section 632 does not prohibit the disclosure of information gathered in violation of its terms.<\/div>\n
Accordingly, even if Plaintiff may demonstrate a probability\u2013\u00a0even an overwhelming probability\u2013 that it will prevail on the merits of its claims under Penal Code Section 632, it will not be entitled to injunctive relief. As a result there is no good cause to permit discovery under CCP \u00a7425.16(g), as it has not been demonstrated that there is \u201ca reasonable probability the court [will] ever reach [the] issue[s]\u201d of the probability of prevailing on the merits of the Plaintiff s causes of action or the imminent nature of the harm to be enjoined.<\/div>\n<\/blockquote>\n

The Alliance Defending Freedom (ADF) allied attorney\u00a0defending CMP, Charles\u00a0S. LiMandri, commented that the StemExpress lawsuit shows that the fetal procurement agency has something to hide. <\/strong><\/p>\n

LiMandri, \u00a0who is the President of the Freedom of Conscience Defense Fund, said, “People who don\u2019t have anything to hide don\u2019t go to court to stop journalists from reporting the truth.<\/p>\n

“The court was right to deny StemExpress\u2019 request to gain access to damaging material against them obtained through solid investigative journalism. Americans have the right to know the truth about Planned Parenthood’s sale of baby body parts and the \u2018fiscal rewards\u2019 Stem Express says that it provides to abortion clinics.”<\/p>\n

Life Legal Defense Foundation Vice President of Legal Affairs Catherine Short added, “As has been more than apparent from the videos that have been released, StemExpress and Planned Parenthood have plenty to hide. These videos not only expose the potential illegality of Planned Parenthood\u2019s actions, they expose the grisly, inhuman nature of Planned Parenthood\u2019s business.”<\/p>\n

The lawsuit came about after the first video<\/a> from CMP’s Human Capital documentary<\/a> series showed an interview with former fetal procurement technician, Holly O’Donnell. Just yesterday, part two of that series-<\/a>–\u00a0the sixth video in total–was released, revealing a more extensive and even more troubling interview with O’Donnell about the fetal procurement business.<\/p>\n

The defeat of StemExpress, at least in this round, means the only active lawsuit against CMP<\/a> is the current extended restraining order issued by a federal judge in San Francisco, keeping CMP from releasing any video related to activities at the National Abortion Providers meeting.<\/p>\n","protected":false},"excerpt":{"rendered":"
