{"id":65694,"date":"2015-07-01T12:10:24","date_gmt":"2015-07-01T16:10:24","guid":{"rendered":"\/news\/?p=65694"},"modified":"2015-07-01T12:29:17","modified_gmt":"2015-07-01T16:29:17","slug":"florida-judge-blocks-24-hour-abortion-waiting-period","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/florida-judge-blocks-24-hour-abortion-waiting-period\/","title":{"rendered":"Florida judge blocks 24-hour abortion waiting period"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>On Tuesday, Florida Chief Circuit Judge Charles Francis blocked the state\u2019s 24-hour waiting period for abortion just before it was to take effect July 1, CBS News <a href=\"http:\/\/www.cbsnews.com\/news\/fla-judge-blocks-law-requiring-1-day-wait-to-have-abortion\/\">reports<\/a>.<\/p>\n<p>Florida\u2019s waiting period would have become the 27<sup>th<\/sup> in the nation and made exceptions for rape, incest, domestic abuse, or human trafficking victims, provided documentation of such claims is provided.<\/p>\n<p><!--more--><\/p>\n<p>Siding with the pro-abortion American Civil Liberties Union and Center for Reproductive Rights, Francis, who <a href=\"http:\/\/www.usatoday.com\/story\/news\/nation\/2015\/06\/30\/judge-blocks-florida-abortion-waiting-period-law\/29544269\/\">was appointed<\/a> by former Governor Jeb Bush, ruled that the law violated the <a href=\"https:\/\/www.flsenate.gov\/Laws\/Constitution\">state Constitution\u2019s<\/a> guarantee of a \u201cright to be let alone and free from governmental intrusion into the person\u2019s private life.\u201d He dismissed claims that other states\u2019 courts have upheld\u00a0similar laws on the grounds that Florida\u2019s privacy provision is broader.<\/p>\n<p><a href=\"http:\/\/www.usatoday.com\/story\/news\/nation\/2015\/06\/30\/judge-blocks-florida-abortion-waiting-period-law\/29544269\/\">According to<\/a> <em>USA Today<\/em>, the ruling is a temporary injunction, not a final judgment. Neither Florida Right to Life nor Governor Rick Scott have responded to the decision yet, but <a href=\"http:\/\/www.frtl.org\/life-news\/pro-life-governor-rick-scott-signs-24-hour-waiting-period-before-abortion\/\">at the time of the bill&#8217;s signing<\/a>, Florida RTL President Lynda Bell noted that \u201cNo major surgical procedure is done the same day a surgical procedure is recommended!\u201d<\/p>\n<p>The US Supreme Court <a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/91-744.ZS.html\">ruled<\/a> in 1992\u2019s <em>Planned Parenthood v. Casey<\/em> that the federal Constitution does not prohibit states from enacting such laws: \u201cthe waiting period helps ensure that a woman&#8217;s decision to abort is a well considered one, and rationally furthers the State&#8217;s legitimate interest in maternal health and in unborn life.
