{"id":64940,"date":"2015-06-21T12:53:46","date_gmt":"2015-06-21T16:53:46","guid":{"rendered":"\/news\/?p=64940"},"modified":"2015-06-30T02:00:26","modified_gmt":"2015-06-30T06:00:26","slug":"pro-aborts-anguish-fifth-circuit-upholds-texas-clinic-regulations","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/pro-aborts-anguish-fifth-circuit-upholds-texas-clinic-regulations\/","title":{"rendered":"To pro-aborts&#8217; anguish, Fifth Circuit upholds Texas clinic regulations"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><img decoding=\"async\" loading=\"lazy\" class=\"alignright size-full wp-image-12568\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2012\/03\/0atexas-flag-150x150.jpg\" alt=\"0atexas-flag-150x150\" width=\"150\" height=\"150\" \/>H.B. 2, the Texas law requiring abortion clinics to meet higher safety and cleanliness standards and abortionists to have admitting privileges at local hospitals in case of complications, has been upheld by a three-judge panel of the Fifth Circuit Court of Appeals, <a href=\"http:\/\/dailysignal.com\/2015\/06\/11\/victory-for-womens-health-and-safety-court-upholds-texas-law-that-regulates-abortion-clinics-doctors\/\" target=\"_blank\">the Daily Signal reports<\/a>.<\/p>\n<p>As <a href=\"\/news\/usa-today-accuses-texas-of-removing-abortion-rights\/\">discussed previously<\/a> on Live Action News, abortion defenders claim the law\u00a0renders <em>Roe v. Wade<\/em>\u00a0effectively\u00a0meaningless by forcing the closure of even more abortion clinics in a state that&#8217;s already down to eight. What good is a right to &#8220;choose&#8221; if women have to\u00a0travel burdensome distances and pay exorbitant amounts of money to abort? (Never mind, of course, that confusing freedom with &#8220;access&#8221; <a href=\"\/news\/pro-abortion-comic-mangles-freedom-by-abusing-the-word-access\/\">defeats the purpose of the former<\/a>.)<!--more--><\/p>\n<p>However, the Daily Signal <a href=\"http:\/\/dailysignal.com\/2015\/06\/11\/victory-for-womens-health-and-safety-court-upholds-texas-law-that-regulates-abortion-clinics-doctors\/\">notes<\/a> that the Fifth Circuit panel based its decision in part on <em>Roe v. Wade\u2019s<\/em> own concession that the \u201cState has a legitimate interest in seeing to it that abortion, like any other medical procedure, is performed under circumstances that insure maximum safety for the patient,\u201d including \u201cthe facilities involved\u201d and \u201cadequate provision for any complication or emergency that might arise.\u201d\u00a0The panel found \u201cno question\u201d that Texas was exercising a legitimate state purpose, and chided a lower court for \u201csubstituting its own judgment for that of the legislature.\u201d<\/p>\n<p>Isn&#8217;t it remarkable?\u00a0Abortion defenders are\u00a0absolutely certain that everything they want is not only an obviously correct policy decision, but that it&#8217;s all <em>constitutionally mandated<\/em>, making opposition fascistic in addition to foolish. And yet,\u00a0a pattern is beginning to emerge of their demands being slapped down not by more originalist readings of the Constitution, but of <em>their own<\/em> Supreme Court precedent. <em>Roe<\/em> admits a state interest in fetal life, that abortion may be regulated, and even that the preborn <a href=\"\/news\/wise-bill-oreilly-insists-preborn-potential-humans\/\">would deserve full 14th Amendment protection<\/a> if their humanity wasn&#8217;t (supposedly) ambiguous. And <em>Planned Parenthood v. Casey<\/em> specifically <a href=\"\/news\/will-abortion-waiting-period-survive-satanists-religious-freedom-challenge\/\">says abortion waiting periods are lawful<\/a>.<\/p>\n<p>These might be signs you&#8217;re overreaching <em>juuuuust<\/em> a tad, folks.<\/p>\n<p>Considering that pro-aborts <a href=\"\/news\/states-burn-through-cash-defending-pro-life-laws-from-sore-losers-with-lawyers\/\">really, really love lawsuits<\/a>, they&#8217;re likely to appeal this ruling. Legal scholars <a href=\"http:\/\/news.wustl.edu\/news\/Pages\/Texas-abortion-ruling-Appleton-Law.aspx\" target=\"_blank\">predict<\/a> the Supreme Court may be inclined to take the case as an opportunity to give a definitive legal definition to the concept of &#8220;undue burden.&#8221; If that&#8217;s the case, pro-lifers should be wary.<\/p>\n<p>That&#8217;s not an objective, analytical deduction\u00a0of the sort the judiciary is meant to handle, like whether federal abortion subsidies are mentioned among Congress&#8217;s enumerated powers or whether criteria laid out in statues like the Religious Freedom Restoration Act have been met.
