H.R. 36 leaves the first <em>five months<\/em> of pregnancy perfectly free to get one for any reason. Five months somehow isn\u2019t enough time for rape victims to abort? H.R. 36 makes an exception for rape. A basic law-enforcement confirmation that a rape actually took place is <a href=\"\/news\/renee-ellmers-excuses-for-house-abortion-meltdown-still-not-compelling\/\">somehow too much to ask<\/a> when seeking <em>permission to kill someone<\/em>? Under the version the House voted on, now rape counseling 48 hours beforehand will suffice (with the documentation requirements broad enough that presumably any Planned Parenthood with a medical license would qualify).<!--more--><\/p>\n<p>If any of the hatred and fear mongering routinely aimed at pro-lifers were sincere, appeasing it would dramatically alter pro-aborts\u2019 reactions. There\u2019d be no sneering about \u201ctaking women back\u201d or temper tantrums about \u201cdisgustingly cruel\u201d pro-lifers from the leaders of the opposition. Barack Obama, who <a href=\"https:\/\/25.media.tumblr.com\/GBhc2wOjvikuuk5pcO04QMXWo1_400.jpg\">claimed he was running to move politics beyond partisan division<\/a>, wouldn\u2019t <a href=\"https:\/\/www.lifesitenews.com\/news\/obama-admin-stopping-abortion-of-babies-who-can-feel-pain-is-disgraceful\">call pro-lifers \u201cdisgraceful\u201d for meeting him halfway<\/a>. Jezebel wouldn\u2019t <a href=\"http:\/\/jezebel.com\/house-passes-20-week-anti-abortion-bill-1704368444\">claim<\/a> such a fundamentally <em>moderate<\/em> bill is a sign politicians are \u201cworking harder than ever to make themselves the dictators of our bodies.\u201d<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-20382\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2012\/08\/rapebabies.jpg\" alt=\"which\" width=\"600\" height=\"411\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2012\/08\/rapebabies.jpg 600w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2012\/08\/rapebabies-300x205.jpg 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/p>\n<p>All of this is wildly disproportionate to the bill\u2019s results, but it\u2019s nothing compared to the way they\u2019re specifically trying to spin the finalized rape exception. <em>Salon\u2019s<\/em> Katie McDonough <a href=\"http:\/\/www.salon.com\/2015\/05\/13\/new_packaging_same_odious_garbage_the_gop_didnt_fix_its_20_week_abortion_ban\/\">insists<\/a> nothing was \u201cfixed\u201d and instead it\u2019s the \u201csame odious garbage.\u201d<\/p>\n<p>ThinkProgress\u2019s Tara Culp-Ressler <a href=\"http:\/\/thinkprogress.org\/health\/2015\/05\/14\/3658708\/20-week-abortion-rape-exception\/\">says<\/a> \u201cthe GOP will never be able to craft a rape exception that\u2019s truly sensitive to survivors of sexual assault \u2014 let alone any other woman who may need abortion care for a <a href=\"http:\/\/www.thenation.com\/blog\/177578\/please-dont-call-it-rape-insurance-michigans-anti-choice-bill-hurts-all-women\">different and equally valid reason<\/a>.\u201d So you\u2019re admitting rape isn\u2019t a <em>more<\/em> valid reason for abortion after all, Tara? Then why are we even having this conversation?<\/p>\n<p>At <em>Slate<\/em>, Amanda Marcotte <a href=\"http:\/\/www.slate.com\/blogs\/xx_factor\/2015\/05\/13\/house_gop_passes_a_ban_on_abortions_after_20_weeks_waiting_period_for_rape.html\">explains<\/a> (I use the term loosely) how H.R. 36 still presents \u201cunnecessary hassles\u201d:<\/p>\n<p style=\"padding-left: 30px\"><em>And a woman can&#8217;t start the clock by going to her abortion provider: <\/em><a href=\"http:\/\/thinkprogress.org\/health\/2015\/05\/12\/3657603\/house-gop-20-week-abortion-vote\/\"><em>She has to find someone else<\/em><\/a><em>\u2014another doctor or counselor\u2014to begin the 48-hour period. Which means more paperwork and more money to shell out, which will likely extend the waiting period past two days for many women, who have to do their jobs and live their lives while also filling out pointless forms and running around to make-work appointments. Guess rape victims should have thought about that before they got raped. <\/em><\/p>\n<p>I hate to be a broken record. Really. But all of this is totally undermined by two single-syllable words: FIVE. MONTHS. Someone has no problem waiting more than 150 days to get an abortion, but suddenly another two is a crisis? Way to carry on the \u201creproductive justice\u201d movement\u2019s proud tradition of <a href=\"\/news\/debunking-narals-lies-about-crisis-pregnancy-centers-part-1\/\">infantilizing women<\/a>, Amanda.<\/p>\n<p>Virtually no corner of the pro-choice movement has given H.R. 36 or its authors and supporters a shred of credit for compromising with them, despite pro-lifers\u2019 intense anguish over agreeing to leave victims of early-term and rape abortions unprotected. So why do we bother anymore? I first <a href=\"\/news\/renee-ellmers-excuses-for-house-abortion-meltdown-still-not-compelling\/\">began wondering that<\/a>\u00a0when the uproar over this bill began, and since then it\u2019s only become harder to deny that it\u2019s time to re-strategize.<\/p>\n<p>Granted, the basic driving force has not changed; the thought of rape survivors having to give birth is <a href=\"\/news\/lessons-of-2012-pro-life-politicians-must-prepare-better-for-the-rape-question\/\">simply an emotional bridge too far for most voters<\/a>. Polling shows that\u2019s <a href=\"http:\/\/www.kofc.org\/un\/en\/resources\/communications\/Abortion_in_America_January2015_For_Release_150121.pdf\">still the case<\/a>. But the \u201csave some now and the rest later\u201d tradeoff only works if we\u2019re working to bring the public closer to saving the rest while we\u2019re at it. Does it look like that\u2019s happening here?<\/p>\n<p>If anything, it looks like the abortion lobby is working overtime to do the opposite. With the constant barrage of hysterical new claims that a <em>concession to their desires<\/em> is manifestation of right-wing anti-abortion extremism, they\u2019re trying to reorient the <a href=\"http:\/\/en.wikipedia.org\/wiki\/Overton_window\">Overton window<\/a> of abortion thought so that the new \u201ccenter\u201d is further left than ever before. And judging by how many Congressional Republicans demonstrated that hiding and groveling were their first instincts, it seems to be working.<\/p>\n<p>So again, why bother? If we\u2019re doomed to carry the \u201cextremism\u201d label no matter how far we bend to prove we\u2019re not\u2014if, as Culp-Ressler inadvertently admits, we\u2019ll \u201cnever be able to get it quite right\u201d to the demagogues\u2019 satisfaction\u2014then why should we continue to preemptively surrender ground? After all, it\u2019s a <a href=\"http:\/\/www.negotiations.com\/articles\/negotiation-price-positions\/\">basic tenet of negotiation<\/a> that parties should start out by asking for more than they expect to actually end up with.<\/p>\n<p>The only way to counter this is to start working the Overton window ourselves. It\u2019s time to be more aggressive and proactive in challenging the conventional wisdom on which abortion policies are reasonable and which are extreme. It\u2019s time to risk some political waves to <a href=\"\/news\/life-baby-conceived-rape-worth-protecting\/\">make the case that our fellow Americans conceived in rape are people too<\/a>\u2014not just in the blogosphere, but on the floors of Congress.<\/p>\n<p>Make that case <a href=\"\/news\/behold-the-anti-akin-njs-jeff-bell-turns-the-tables-on-cory-booker-over-hard-case-abortions\/\">with a straightforward, unapologetic clarity<\/a> that forces the mainstream media to take notice and expose their audience to the compassion and rationality behind a position they\u2019ve previously only heard spoken of in caricature. This isn\u2019t asking pro-life lawmakers to <a href=\"https:\/\/www.lifesitenews.com\/news\/this-south-carolina-senator-is-filibustering-a-20-week-abortion-ban-to-remo\">oppose or abandon good legislation for being imperfect<\/a>\u2014it\u2019s simply asking them to orient their efforts to a pro-life victory more comprehensive than saving their own skin.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The most striking thing about the abortion lobby&#8217;s collective freakout over the Pain-Capable Unborn Child Protection Act&#8217;s House vote is that it isn\u2019t even slightly fazed by the bill\u2019s various concessions to pro-choice complaints.
