Bill Haslam meets with a local scout troop\u00a0(Photo: Nick Smith \/\u00a0<a href=\"https:\/\/www.flickr.com\/photos\/nick4900\/2946074588\" target=\"_blank\">Flickr<\/a>)<\/p><\/div>\n<p><!--more--><\/p>\n<p>While only a first step to protect women and save pre-born lives in Tennessee, these laws represent the culmination of a tireless 14-year effort by pro-life advocates to reverse a dangerous, even deadly policy put in place through a court ruling.<\/p>\n<p>Tennessee used to have these protections before being hit with a\u00a0<a href=\"http:\/\/caselaw.findlaw.com\/tn-supreme-court\/1171782.html\">lawsuit<\/a>\u00a0by Planned Parenthood and the ACLU. They sued to remove three regulations around abortion that had been voted into place by legislators of both parties: informed consent, 48-hour waiting period, and that late-term abortions must be done in hospital settings.<\/p>\n<p>On September 15, 2000, the Tennessee Supreme Court decided in favor of Planned Parenthood; with this decision, the justices found a broad \u201cright to abortion\u201d in our State Constitution. Their decision\u00a0prevented any regulation of abortion providers from being enforced that could not pass a\u00a0<em>strict scrutiny<\/em>\u00a0standard.<\/p>\n<div id=\"attachment_63126\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-63126\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-63126 size-full\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/04\/TNCourthouse640.jpg\" alt=\"TNCourthouse640\" width=\"640\" height=\"416\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/TNCourthouse640.jpg 640w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/TNCourthouse640-300x195.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-63126\" class=\"wp-caption-text\">A court decision in Tennessee blocked pro-life legislation for 14 years\u00a0(Photo: Jake Brewer \/\u00a0<a href=\"https:\/\/www.flickr.com\/photos\/integralfocus\/4065585419\/\" target=\"_blank\">Flickr<\/a>)<\/p><\/div>\n<p>This decision emboldened an abortionist operating two facilities\u00a0<a href=\"http:\/\/www.tncourts.gov\/sites\/default\/files\/OPINIONS\/TCA\/PDF\/024\/BoyleGC.pdf\">to sue<\/a>\u00a0when the Department of Health tried to inspect the centers and demand that he meet the standards of same-day surgery centers.\u00a0He prevailed in court by saying he was operating under a doctor\u2019s office license and did not have to meet these regulations unless he performed a substantial number of abortions.<\/p>\n<p>The court did not define what constitutes a\u00a0<em>substantial<\/em>\u00a0number; left unanswered, he was free to operate using this loophole. Others followed suit.\u00a0As a result, Tennessee became known as the \u201cabortion mecca of the southeast\u201d and ranked\u00a0as the third state nationally for\u00a0<a href=\"http:\/\/www.tennessean.com\/story\/news\/health\/2014\/02\/18\/tennessee-abortion-numbers-drop-in-past-decade\/5572875\/\">out-of-state women<\/a>\u00a0coming to get their abortions.<\/p>\n<p>The dissenting judge from the 2000 decision advised the only remedy for the people was to enact an amendment to the State Constitution, stating that it was silent on the issue of abortion\u00a0\u2013\u00a0allowing the people to once again speak through their elected legislators to enact regulations around abortions.<\/p>\n<div id=\"attachment_63127\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-63127\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-63127 size-full\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/04\/YesOn1Team640.jpg\" alt=\"YesOn1Team640\" width=\"640\" height=\"379\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/YesOn1Team640.jpg 640w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/YesOn1Team640-300x178.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-63127\" class=\"wp-caption-text\">Volunteers in every one of Tennessee\u2019s 95 counties engaged in the Yes on 1 effort (Photo: <a href=\"https:\/\/www.facebook.com\/yeson1tn\/photos\/pb.554551221233859.-2207520000.1429799723.\/820893091266336\/\" target=\"_blank\">Yes on 1<\/a>)<\/p><\/div>\n<p>Amending the State Constitution is an arduous process. It must pass the General Assembly by a simple majority, followed by a super majority, appear on the ballot in a year that a Governor is elected and pass by\u00a0<em>at least 50 percent plus one<\/em>\u00a0(of the number of votes cast for Governor).<\/p>\n<p>It took 14 years of pro-life advocacy for this measure,\u00a0<a href=\"http:\/\/ballotpedia.org\/Tennessee_Legislative_Powers_Regarding_Abortion,_Amendment_1_(2014)\">Amendment 1<\/a>, to be on the 2014 ballot. Along the way, it was essential for the pro-life issue to be front and center in elections \u2013 changing the political landscape dramatically.\u00a0The battle to pass this state measure received national attention.<\/p>\n<p>The grassroots coalition \u201cYes on 1\u201d was\u00a0<a href=\"http:\/\/www.yeson1tn.org\/abortion_promoters_funding_94_of_vote_no_campaign\">outspent 3 to 1<\/a>,\u00a0and\u00a0<a href=\"http:\/\/voteno1tn.org\/2014\/10\/19\/four-major-tennessee-newspapers-urge-readers-vote-amendment-1\/\">all four major city newspapers<\/a>\u00a0endorsed the Planned Parenthood position. Funded by out-of-state\u00a0<a href=\"http:\/\/myemail.constantcontact.com\/Abortion-Industry-Attempts-to-Buy-Tennessee-Election.html?soid=1101571928552&amp;aid=ZpdL8_8bB9s\">pro-abortion interests<\/a>, the \u201cNo on 1\u201d campaign even produced what was\u00a0<a href=\"http:\/\/www.redstate.com\/2014\/10\/21\/dishonest-tv-ad-election-season\/\">named<\/a>\u00a0\u201cthe most dishonest TV ad of the 2014 election season.\u201d<\/p>\n<p>November 4, 2014 was the moment of truth. The pro-life Amendment 1\u00a0relied upon a strong grassroots effort in all 95 counties to win\u00a0<a href=\"http:\/\/www.politico.com\/2014-election\/results\/map\/ballot-measures\/tennessee\/\">53% to 47%<\/a>\u00a0in Tennessee.<\/p>\n<div id=\"attachment_63128\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-63128\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-63128 size-full\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/04\/DrBrentBoles-PressConference640.jpg\" alt=\"DrBrentBoles-PressConference640\" width=\"640\" height=\"311\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/DrBrentBoles-PressConference640.jpg 640w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/DrBrentBoles-PressConference640-300x146.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-63128\" class=\"wp-caption-text\">Dr. Brent Boles speaks at a Yes on 1 press conference in Nashville\u00a0(Photo: Yes on 1 \/\u00a0<a href=\"https:\/\/www.facebook.com\/yeson1tn\/photos\/pcb.816022388420073\/816021671753478\/\" target=\"_blank\">Facebook<\/a>)<\/p><\/div>\n<p>While the measure lost in Tennessee\u2019s four large cities,\u00a0<a href=\"http:\/\/nashvillepublicmedia.org\/blog\/2014\/11\/05\/tennessees-abortion-amendment-reveals-rural-urban-divide\/\">rural areas<\/a>\u00a0like Murfreesboro \u2013 where pastors were unafraid to\u00a0<a href=\"http:\/\/www.yeson1tn.org\/tennessee_votes_to_restore_life\">speak out on social issues<\/a>\u00a0\u2013 carried the measure to victory. Brent Boles, an OB-GYN who practices in Murfreesboro,\u00a0<a href=\"http:\/\/bound4life.com\/blog\/2014\/10\/31\/stop-hiding-the-truth-brent-boles-amendment-1-tn\/\">offered his medical expertise<\/a>\u00a0to the \u201cYes on 1\u201d effort as a volunteer spokesman.<\/p>\n<p>The improbable grassroots victory didn\u2019t go unnoticed. Statewide Associated Press reporters named the passage of Amendment 1 as the \u201c<a href=\"http:\/\/www.washingtontimes.com\/news\/2014\/dec\/25\/abortion-amendment-voted-top-tenn-story-of-2014\/?page=all\">Story of the Year<\/a>\u201d in Tennessee \u2013\u00a0where\u00a0<em>America at Its Best<\/em>\u00a0is the official state slogan.<\/p>\n<p>The first legislative session since Amendment 1 began in January 2015, and this week\u2019s landmark passage of these three protections was celebrated by many.\u00a0\u201c<a href=\"http:\/\/www.nationalrighttolifenews.org\/news\/2015\/04\/tuesday-a-banner-day-in-tennessee-for-unborn-children-and-their-mothers\/#.VTb8FiFVhHx\">Tennessee Right to Life<\/a>\u00a0thanks the people of Tennessee who supported Amendment 1 and the many legislative sponsors and supporters of these bills to protect the health and safety of women and girls,\u201d said Brian Harris, the organization\u2019s president.<\/p>\n<div id=\"attachment_63129\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-63129\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-63129 size-full\" src=\"https:\/\/www.liveactionnews.org\/wp-content\/uploads\/2015\/04\/TNAmendment1-Map640.jpg\" alt=\"TNAmendment1-Map640\" width=\"640\" height=\"306\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/TNAmendment1-Map640.jpg 640w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2015\/04\/TNAmendment1-Map640-300x143.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-63129\" class=\"wp-caption-text\">The majority of TN counties voted yes on 1; the pro-abortion coalition won only urban areas<\/p><\/div>\n<p>\u201cChildren will now be given a better chance at life because their mothers and families had the extra time and opportunity to make fully informed decisions,\u201d he continued.<\/p>\n<p>Today\u2019s losers? \u201cThose who profit from unregulated abortion in Tennessee,\u201d said Harris.
