{"id":6018,"date":"2011-08-31T01:23:05","date_gmt":"2011-08-31T05:23:05","guid":{"rendered":"http:\/\/liveaction.org\/blog\/?p=6018"},"modified":"2013-03-30T20:00:54","modified_gmt":"2013-03-31T00:00:54","slug":"judge-declares-pro-life-texas-sonogram-measure-unconstitutional","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/judge-declares-pro-life-texas-sonogram-measure-unconstitutional\/","title":{"rendered":"Judge declares pro-life Texas sonogram measure unconstitutional"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><a href=\"http:\/\/liveaction.org\/blog\/wp-content\/uploads\/2010\/05\/ultrasound3.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignright size-full wp-image-941\" style=\"margin: 10px;\" title=\"ultrasound3\" alt=\"ultrasound3\" src=\"http:\/\/liveaction.org\/blog\/wp-content\/uploads\/2010\/05\/ultrasound3.jpg\" width=\"250\" height=\"196\" \/><\/a>Texas Governor Rick Perry signed a sonogram bill into law in May of this year, which would allow women to see an image of their unborn child, listen to the heartbeat, and hear a description of his or her body prior to an abortion as of September.<\/p>\n<p>It was absolutely a pro-life victory, but it seems strange that pro-abortion groups who rally for \u201cinformed and educated choice\u201d fought so adamantly to prevent the legislation from passing.\u00a0 During any other invasive medical procedure, it is required that doctors explain the facts and risks associated with the surgery to the patients prior to performing it.\u00a0 Why are the standards different when it comes to abortion?\u00a0 Considering it is one of the most common surgeries performed in our country, shouldn\u2019t the laws applied to any other surgery especially apply to this one?\u00a0 Sounds to me like pro-abortion groups are afraid of something.<\/p>\n<p><!--more--><\/p>\n<p>US District Judge Sam Sparks has declared parts of the sonogram law \u201cunconstitutional\u201d and has <a href=\"http:\/\/www.scribd.com\/doc\/63609521\/Judge-Sam-Sparks-ruling-on-abortion-sonogram-law\" target=\"_blank\">altered the law<\/a> to disallow the state of Texas to require an abortionist to offer a woman an ultrasound of her unborn child.\u00a0 Judge Sparks considers the act of offering a pregnant woman an image of her baby to be simply a means to \u201cadvance an ideological agenda\u201d with which he disagrees\u2014but again, what is so disagreeable about offering a woman a chance to know more about the procedure she is about to undergo?<\/p>\n<p>Pro-abortion advocates will find this block to be a victory for women, because they claim that performing the ultrasound on a pre-abortive woman is \u201cinvasive,\u201d although performing an ultrasound beforehand is standard to determine the age of the baby (and the price of the abortion).\u00a0 They believe that offering a woman a chance to see her preborn baby prior to an abortion as labeling her \u201cincompetent to make important decisions,\u201d as Julie Rikelman, attorney for the Center for Reproductive Rights in NY, states.\u00a0 However, no rational person could possibly fathom how giving a woman all the information about abortion, including the option to view what the \u201cproduct of pregnancy\u201d to be removed looks like, is the same as considering her \u201cincompetent.\u201d\u00a0 If abortion and informed choice is about empowering women, shouldn\u2019t pro-<em>choice<\/em> advocates be applauding this law?<\/p>\n<p><a href=\"http:\/\/www.facebook.com\/#!\/TexasAllianceForLife\" target=\"_blank\">Texas Alliance for Life<\/a>, a non-profit, non-partisan organization based in Austin, states that they \u201cbelieve this case will be appealed to the 5th Circuit Court of Appeals, which will allow it to be fully enforced.\u201d\u00a0 Until then, women will be legally denied the right to view the image of their unborn child prior to an abortion, squelching their right to be fully informed on a permanent, life-changing decision.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Texas Governor Rick Perry signed a sonogram bill into law in May of this year, which would allow women to see an image of their unborn child, listen to the heartbeat, and hear a description of his or her body prior to an abortion as of September.
