{"id":60028,"date":"2015-02-23T09:19:57","date_gmt":"2015-02-23T14:19:57","guid":{"rendered":"\/news\/?p=60028"},"modified":"2015-02-24T19:12:56","modified_gmt":"2015-02-25T00:12:56","slug":"disdain-for-the-entire-judicial-process-ruth-bader-ginsburgs-history-on-abortion","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/disdain-for-the-entire-judicial-process-ruth-bader-ginsburgs-history-on-abortion\/","title":{"rendered":"&#8220;Disdain for the entire judicial process&#8221;: Ruth Bader Ginsburg&#8217;s history on abortion"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>As a judicial gatekeeper for the right to choose death, Ruth Bader Ginsburg enjoys rockstar status in pro-abortion circles, which is why MSNBC\u00a0<a href=\"http:\/\/www.msnbc.com\/msnbc\/ruth-bader-ginsburg-abortion-race-and-the-broken-congress\">recently interviewed<\/a>\u00a0the Supreme Court Justice to get her thoughts on aspects of the country&#8217;s abortion debate that have even less to do with her job as constitutional interpreter than <em>Roe v. Wade\u2019s <\/em>rationale does.<\/p>\n<p>The interview is especially interesting in light of how Ginsburg has been making the rounds on other issues before the court. On Thursday, Ethics and Public Policy Center president Edward Whelan\u00a0<a href=\"http:\/\/www.nationalreview.com\/article\/414026\/injudicious-ginsburg-edward-whelan\">argued<\/a>\u00a0that recent statements she\u2019s made about same-sex marriage require her to recuse herself from that case under both federal law and ethical standards that require judges not to publicly cast doubt on their own objectivity. At her own confirmation hearing, he notes, Ginsburg herself admitted:<\/p>\n<p style=\"padding-left: 30px\"><em>A judge sworn to decide impartially can offer no forecasts, no hints, for that would show not only disregard for the specifics of the particular case, it would display disdain for the entire judicial process.<\/em><\/p>\n<p>Does she have a similar impartiality problem on abortion? Let&#8217;s see.<!--more--><\/p>\n<p style=\"padding-left: 30px\"><em>We will never see a day when women of means are not able to get a safe abortion in this country.<\/em><\/p>\n<p>So you&#8217;re telling me the more money you have, the easier it is to skirt laws? Stop the presses! However relevant this point may be to the policy merits of banning abortion (not very), it tells us nothing about whether the Constitution entails a right to abort.<\/p>\n<p style=\"padding-left: 30px\"><em>Referring to the cascade of state-level laws curtailing access to abortion, some of which may well end up before the Supreme Court in the near future, Ginsburg said, \u201cAll the restrictions, they operate against the woman who doesn\u2019t have freedom to move, to go where she is able to get safely what she wants.\u201d<\/em><\/p>\n<p>This argument is only compelling if you accept the premise that\u00a0<em>any<\/em>\u00a0woman should be able to get an abortion in the first place, and again, even then only as a matter of policy, not jurisprudence. Nowhere does the Constitution say, \u201cunless you can enforce a prohibition with perfect efficiency across the board, you mustn&#8217;t prohibit it in part or for anyone.\u201d<\/p>\n<p style=\"padding-left: 30px\"><em>Now, Ginsburg said, \u201cI try to teach through my opinions, through my speeches \u2013 how wrong it is to judge people on the basis of what they look like, [the] color of their skin, whether they\u2019re men or women. [&#8230;]<\/em><\/p>\n<p style=\"padding-left: 30px\"><em>And when the time comes, what would she like to be remembered for?<\/em><\/p>\n<p style=\"padding-left: 30px\"><em>\u201cSomeone who used whatever talent she had to do her work to the very best of her ability,\u201d Ginsburg said. \u201cAnd to help repair tears in her society, to make things a little better through the use of whatever ability she has.\u201d<\/em><\/p>\n<p>These are noble sentiments on paper (if strikingly inconsistent with Ginsburg&#8217;s\u00a0<a href=\"http:\/\/www.lifenews.com\/2012\/10\/23\/justice-ginsburg-backtracks-from-racist-abortion-comments\/\">past remarks<\/a>\u00a0on\u00a0<em>Roe&#8217;s<\/em>\u00a0connection to \u201cconcern\u201d over \u201cgrowth in populations that we don\u2019t want to have too many of\u201d), but they have nothing to do with her job. Legal opinions are supposed to investigate what text actually means and, as close as we can determine, how its authors would have applied it to current controversies, not vehicles for a judge&#8217;s personal vision of what the law should have done. A good judge should be half legal technician, half historian\u2026and zero percent politician. A proper reading of the Constitution will have the effect of teaching\u00a0<em>its<\/em>\u00a0values, not swapping them with the judge&#8217;s own.<\/p>\n<p>It\u2019s apparent that something other than originalism or textualism guided her votes in partial-birth abortion cases <em>Stenberg v. Carhart<\/em> and <em>Gonzales v. Carhart<\/em>, and abortifacient case <em>Burwell v. Hobby Lobby<\/em>, in which her dissent was <a href=\"\/news\/ginsburgs-atrocious-hobby-lobby-analysis-draws-a-deluded-crowd\/\">riddled with factual errors and extra-constitutional arguments<\/a>. But in Ginsburg\u2019s case, it\u2019s actually worse than that.<\/p>\n<p>In the past, Ginsburg has <a href=\"http:\/\/www.washingtonexaminer.com\/the-pervading-dishonesty-of-roe-v.-wade\/article\/1080661\">criticized<\/a> <em>Roe<\/em> as \u201cheavy-handed judicial intervention [which] was difficult to justify,\u201d lamentable <a href=\"http:\/\/www.huffingtonpost.com\/2013\/05\/11\/ruth-bader-ginsburg-roe-v-wade_n_3261187.html\">because<\/a> it \u201chad given opponents of access to abortion a target to aim at relentlessly,\u201d thereby \u201cstopp[ing] the momentum that was on the side of change.\u201d Instead, she would have rather seen the court \u201cput its stamp of approval on the side of change and let that change develop in the political process.\u201d<\/p>\n<p>So on top of twisting the law to her own ends, here we have one of the most powerful judges in the land all but admitting a decision she\u2019s repeatedly voted to uphold doesn\u2019t actually deserve upholding, then openly arguing that SCOTUS should have made their decision based on <em>what would have best promoted the culture\u2019s long-term acceptance of abortion<\/em>.<\/p>\n<p>Ruth Bader Ginsburg may not have to run for re-election, but that doesn&#8217;t mean the rest of us are supposed to just sit down and take such lawlessness. Technically, the Constitution says that justices serve \u201c<a href=\"http:\/\/www.heritage.org\/constitution\/#!\/articles\/3\/essays\/104\/good-behavior-clause\">during good behavior<\/a>\u201d\u2014and <a href=\"\/news\/john-roberts-defection-spells-trouble-for-overturning-roe\/\">provides for their impeachment<\/a> when they betray their constitutional duty.
