{"id":59105,"date":"2015-01-30T16:03:11","date_gmt":"2015-01-30T21:03:11","guid":{"rendered":"\/news\/?p=59105"},"modified":"2015-02-02T11:47:14","modified_gmt":"2015-02-02T16:47:14","slug":"help-stop-planned-parenthood-from-writing-its-own-regulations-in-north-carolina","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/help-stop-planned-parenthood-from-writing-its-own-regulations-in-north-carolina\/","title":{"rendered":"Help stop Planned Parenthood from writing its own regulations in North Carolina"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Legislators in North Carolina did the right thing in July 2013 when they <a href=\"http:\/\/abc11.com\/archive\/9160065\/\">voted<\/a> to raise the quality standards for abortion clinics in the state.<\/p>\n<p>The hand-wringing response from the abortion industry was entirely predictable, with Planned Parenthood\u2019s vice president for public affairs, Melissa Reed, <a href=\"http:\/\/www.newsobserver.com\/2013\/07\/30\/3068013_mccrory-signs-nc-abortion-bill.html?rh=1\">calling<\/a> it \u201cthe most restrictive access to safe and legal abortions this state has ever seen.\u201d<\/p>\n<p>That was then.<\/p>\n<p><!--more--><strong>Inviting the Fox to Guard the Henhouse<\/strong><\/p>\n<p>But now, more than a year an a half later, the North Carolina abortion industry is <a href=\"http:\/\/www.wral.com\/nc-legislature-could-step-in-on-clinic-rule-proposal\/14401753\/\">perfectly fine<\/a> with the proposed regulations, which were submitted by the state\u2019s Department of Health and Human Services on December 1. The public comment period on the new rules ends January 30.<\/p>\n<p>Why such an about-face?<\/p>\n<p>The new legislation authorized the state\u2019s Department of Health and Human Services (DHHS) to propose new regulations governing abortion clinics.\u00a0 Incredibly, the DHHS <em>actually invited employees of Planned Parenthood and other abortion clinics<\/em> to be part of the committee that drafted the proposed new regulations that are now under consideration.<\/p>\n<p>There are enormous problems in the proposed rules. Today, our executive director, Eric Scheidler, submitted a <a href=\"http:\/\/prolifeaction.org\/docs\/2015\/PLALCommentsNCAbortionClinicRegulations.pdf\">6-page letter [PDF]<\/a> to the North Carolina Division of Health Service Regulation detailing the Pro-Life Action League\u2019s objections.<\/p>\n<p>Our three major objections are outlined below.<\/p>\n<ol>\n<li><strong> We object to the drastic reduction in the retention of medical records by abortion clinics, particularly as concerns minors.<\/strong><\/li>\n<\/ol>\n<p>Currently, North Carolina law requires that medical records for women who have abortions must be retained for 20 years. Under the Proposed Rules, that number would be reduced to 10 years.<\/p>\n<p>Even more troubling, though, is the proposed rule change regarding minors\u2019 medical records. According to the proposed rules, a minor\u2019s medical records may be destroyed by an abortion clinic three years after she turns 18, meaning that a minor girl could get an abortion at age 17 and have her medical records destroyed less than four years later.<\/p>\n<p>In our letter, we urge the North Carolina DHSR to require that medical records be retained for 20 years after a minor turns 21. There is no good reason for shortening the period unless the purpose of the rule change is to lessen abortion clinics\u2019 liability.<\/p>\n<ol start=\"2\">\n<li><strong> We object to the removal of the rule that medical or nursing staff must accompany a patient transferred from an abortion clinic by ambulance.<\/strong><\/li>\n<\/ol>\n<p>Under current North Carolina law, abortion clinics are required to have a medical staff member or nurse accompany a patient by ambulance in the event of an emergency. Under the proposed rules, that requirement is done away with.<\/p>\n<p>Moreover, under the proposed a rules, an abortion clinic is <em>not<\/em> required to obtain a written transfer agreement with a nearby hospital as long as it provides \u201cdocumentation of its efforts to establish such a transfer agreement with a hospital.\u201d<\/p>\n<p>In other words, an abortion clinic simply has to <em>try<\/em> to obtain a transfer agreement with a hospital. It doesn\u2019t actually have to <em>succeed<\/em>.<\/p>\n<p>No wonder the abortion clinics like the proposed regulations.<\/p>\n<ol start=\"3\">\n<li><strong> We object to the \u201cgrandfathering\u201d of abortion clinics that fail to meet building code requirements.<\/strong><\/li>\n<\/ol>\n<p>The proposed rules call for building code requirements to be applied <em>only<\/em> to \u201cnew clinics and to any alteration, repairs, rehabilitation work, or additions which are made to a previously certified facility.\u201d <em>This will not improve safety at all.\u00a0<\/em>In fact, it may actually worsen safety because an abortion clinic may put off a needed repair or other work specifically to avoid having to comply with building code requirements.<\/p>\n<p>For example, the requirement for corridor width for clinic facilities was amended to be a minimum of 60 inches in 1994, but this was never enforced because a \u201cnew facility\u201d was defined as one that was not certified as an abortion clinic as of that date. As a result, many, perhaps most, abortion clinics have been exempt from meeting this standard for <em>over 20 years<\/em>. Under the proposed rules, they will be grandfathered in <em>again<\/em>.<\/p>\n<p><strong>Make Your Voice Heard TODAY<\/strong><\/p>\n<p>The public comment period on the proposed rules ends <em>January 30<\/em>, so we are asking you to voice your objections <a href=\"mailto:dhsr.rulescoordinator@dhhs.nc.gov\">by e-mail<\/a> to the North Carolina Division of Health Service Regulation <em>today <\/em>\u2014 especially if you are a North Carolina resident.<\/p>\n<p>In your message, say the following:<\/p>\n<blockquote><p>I am writing to object to express serious concerns about the currently proposed rules for abortion clinics.<\/p>\n<p>Chiefly, I object to:<\/p>\n<ol>\n<li>The drastic reduction in the retention of medical records by abortion clinics, particularly as concerns minors.<\/li>\n<li>The removal of the rule that medical or nursing staff must accompany a patient transferred from an abortion clinic by ambulance.<\/li>\n<li>The \u201cgrandfathering\u201d of abortion clinics that fail to meet building code requirements.<\/li>\n<\/ol>\n<p>These objections are explained in more detail in a letter previously submitted by the Pro-Life Action League.<\/p><\/blockquote>\n<p>Submit your comments <em>no later than 5:00 p.m. Eastern time, January 30<\/em>.
