{"id":53303,"date":"2014-09-06T18:42:26","date_gmt":"2014-09-06T22:42:26","guid":{"rendered":"\/news\/?p=53303"},"modified":"2016-09-08T14:53:33","modified_gmt":"2016-09-08T18:53:33","slug":"pro-lifers-sue-to-stop-huntsville-abortion-center-from-re-opening","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/pro-lifers-sue-to-stop-huntsville-abortion-center-from-re-opening\/","title":{"rendered":"Pro-lifers sue to stop Huntsville abortion center from re-opening"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Pro-life advocates in Huntsville, Alabama are suing to try to prevent the city&#8217;s abortion center from re-opening near a middle school.<\/p>\n<p>The lawsuit was filed\u00a0Wednesday in Madison County Circuit Court. \u00a0The lawsuit asks a judge to overturn an August 19 <a title=\"Huntsville Board\" href=\"http:\/\/www.al.com\/news\/huntsville\/index.ssf\/2014\/08\/huntsville_upholds_building_pe.html\" target=\"_blank\">Huntsville Board of Zoning Adjustment vote<\/a>, which upheld the Alabama Women&#8217;s Center for Reproductive Alternatives&#8217; business license.<\/p>\n<p><!--more--><\/p>\n<p>Dalton Johnson, the administrator\u00a0of the <a title=\"Alabama Women's Center for Reproductive Alternatives\" href=\"http:\/\/abortiondocs.org\/clinic\/surgical\/8\/huntsville-alabama-womens-center-for-reproductive-alternatives\/\" target=\"_blank\">Alabama Women&#8217;s Center for Reproductive Alternatives\u00a0(AWCRA)<\/a>,\u00a0is attempting to relocate the abortion center to 4831 Sparkman Drive in Huntsville. \u00a0The new location is close to several churches, residential neighborhoods, and a middle school.<\/p>\n<p><a title=\"AL.com reported\" href=\"http:\/\/www.al.com\/news\/huntsville\/index.ssf\/2014\/09\/anti-abortion_activists_sue_in.html\" target=\"_blank\">AL.com reported:<\/a><\/p>\n<p><em>The suit contends the zoning board and Jim McGuffey, the city&#8217;s manager of planning services, &#8220;erroneously determined&#8221; that Alabama Women&#8217;s Center could move into a residential district based on a 16-year-old use variance.<\/em><\/p>\n<p><em>In 1998, the zoning board granted Huntsville Hospital a variance to open an outpatient medical clinic on the property now owned by Alabama Women&#8217;s Center.<\/em><\/p>\n<p><em>McGuffey ruled in May \u2013 and a majority of zoning board members later agreed \u2013 that the variance should also apply to an abortion clinic.<\/em><\/p>\n<p>The lawsuit also contends that the AWCRA began re-modeling its new building <a title=\"without necessary city permits\" href=\"http:\/\/www.al.com\/news\/huntsville\/index.ssf\/2014\/07\/abortion_opponents_claim_hunts.html\" target=\"_blank\">without necessary city permits.<\/a><\/p>\n<p><a title=\"seeking a new license\" href=\"http:\/\/www.al.com\/news\/huntsville\/index.ssf\/2014\/06\/state_health_department_north.html\" target=\"_blank\">The AWCRA, led by Johnson, is seeking\u00a0a license to perform abortions from the Alabama Department of Public Health<\/a>. \u00a0Its new building is part of the Alabama Women&#8217;s Wellness Center (AWWC), an OB-GYN practice with multiple locations in Alabama. \u00a0The AWWC is run by Dr. Yashica Robinson-White, who the federal government\u00a0<a title=\"recently indicted\" href=\"\/news\/alabama-doctor-indicted-for-selling-misbranded-iuds\/\" target=\"_blank\">recently indicted for Medicaid fraud and selling misbranded IUDs<\/a>. \u00a0<img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-medium wp-image-53305\" src=\"\/news\/wp-content\/uploads\/2014\/09\/AWWC-yashica-robinson-white1.tif\" alt=\"AWWC yashica-robinson white\" width=\"1\" height=\"1\" \/><\/p>\n<p>The AWWC <a title=\"website\" href=\"http:\/\/www.alabamawomenswellnesscenter.com\/index.html\" target=\"_blank\">website<\/a> lists one of its\u00a0addresses as 4831 Sparkman Drive.<\/p>\n<p>Life Legal Defense Foundation is assisting the\u00a0Huntsville pro-life community with the lawsuit.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pro-life advocates in Huntsville, Alabama are suing to try to prevent the city&#8217;s abortion center from re-opening near a middle school.
