{"id":51110,"date":"2014-06-26T11:49:45","date_gmt":"2014-06-26T15:49:45","guid":{"rendered":"\/news\/?p=51110"},"modified":"2015-09-17T23:16:14","modified_gmt":"2015-09-18T03:16:14","slug":"breaking-pro-life-victory-as-massachusetts-buffer-zone-law-struck-down","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/breaking-pro-life-victory-as-massachusetts-buffer-zone-law-struck-down\/","title":{"rendered":"Pro-life victory as Massachusetts &#8216;buffer zone&#8217; law struck down"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>A contentious law prohibiting pro-life sidewalk counselors from exercising their free speech rights outside of abortion mills has been struck down by the Supreme Court this morning.<\/p>\n<p>The SCOTUS ruling, <a href=\"http:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2014\/06\/26\/massachusetts-abortion-clinic-buffer-zone-law-overturned-in-mccullen-v-coakley\/\">says<\/a> attorney Eugene Volokh, &#8220;<span style=\"color: #333333;\">doesn&#8217;t overturn\u00a0<\/span><i style=\"color: #333333;\">Hill v.<\/i> <em>Colorado<\/em>, &#8221; the 14-year-old Colorado law which essentially affirmed the legality of an eight-foot buffer zone outside of abortion mills in that state. However, according to <em><a href=\"http:\/\/www.usatoday.com\/story\/news\/nation\/2014\/06\/26\/supreme-court-abortion-clinic-buffer-zones\/6698787\/\">USA Today<\/a><\/em>, Massachusetts &#8220;went too far &#8212; literally&#8221; when it instituted the <strong>35-foot<\/strong>\u00a0\u00a0buffer zone, which effectively bars any form of successful\u00a0communication outside of the facilities.<\/p>\n<p><!--more--><\/p>\n<p><span style=\"color: #141823;\">Dismayed by the ruling, Planned Parenthood utilized <a href=\"https:\/\/www.facebook.com\/photo.php?fbid=10152219851414639&amp;set=a.189478844638.126579.8934429638&amp;type=1&amp;theater\">Facebook<\/a> to quip that the buffer zone law struck down by the Supreme Court had been, &#8220;a commonsense law that protects patient and public safety while balancing free speech rights.&#8221; <\/span><\/p>\n<p><span style=\"color: #141823;\">Free speech rights advocates, however, state that the laws are a clear impingement on fundamental Constitutional rights of Americans. Charles C. W. Cooke at <a href=\"http:\/\/m.nationalreview.com\/article\/368575\/america-charles-c-w-cooke\"><em>National Review Online<\/em><\/a> pointed out the discriminatory nature of buffer zone laws, noting that the free speech rights of only pro-lifers are affected by them, and not those of any &#8220;<span style=\"color: #000000;\">citizen [who] either works in the clinic or is in agreement with what goes on inside.<\/span>\u00a0&#8221;\u00a0<\/span><br style=\"color: #141823;\" \/><br style=\"color: #141823;\" \/><span style=\"color: #141823;\">Planned Parenthood vowed to continue its opposition to the First Amendment of the US Constitution, warning: &#8220;This isn&#8217;t over.&#8221;<\/span><\/p>\n<p>The SCOTUS opinions on the Massachusetts case can be read in full <a href=\"http:\/\/www.supremecourt.gov\/opinions\/13pdf\/12-1168_6k47.pdf\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A contentious law prohibiting pro-life sidewalk counselors from exercising their free speech rights outside of abortion mills has been struck down by the Supreme Court this morning.
