\"PantsThe \u201cfact-checking\u201d cottage industry that\u2019s sprung up in recent years has a spotty record of actually, er, checking facts on matters like abortion<\/a>, so it\u2019s refreshing when a debunking actually lives up to its mandate. Last week, FactCheck.org\u2019s Eugene Kiely eviscerated<\/a> an attack ad by the Senate campaign of Montana Democrat John Walsh, which falsely claims Republican Congressman Steve Daines is so horribly anti-choice that he \u201ceven proposed making women criminals for having an abortion\u201d:<\/p>\n

The ad cites two sources for this claim: Daines\u2019 support for H.R. 1091, the\u00a0Life at Conception Act<\/a>, and an\u00a0Aug. 23, 2012, newspaper article<\/a>\u00a0in the\u00a0Independent Record.<\/p>\n

In April 2013, Daines signed on as a co-sponsor of the Life at Conception Act, which says \u201ceach born and preborn human person\u201d is entitled to \u201cequal protection\u201d under the\u00a014th Amendment<\/a>\u00a0of the U.S. Constitution. The bill is the latest attempt by abortion opponents to declare the \u201cpreborn\u201d U.S. citizens entitled to legal and constitutional rights.<\/p>\n

The bill is short \u2013 less than a page long \u2013 and doesn\u2019t mention penalties for violating the law. But it specifically prohibits the prosecution of women who have an abortion.<\/p>\n

Life at Conception Act, March 12, 2013<\/strong>: However, nothing in this Act shall be construed to authorize the prosecution of any woman for the death of her unborn child.<\/p>\n

That language directly contradicts the ad\u2019s claim that Daines proposed making women criminals for having an abortion. When we asked about that, Walsh campaign spokeswoman Lauren Passalacqua responded by saying, \u201ceven with that one-line provision [the bill] still makes abortion illegal.\u201d That\u2019s true, but that\u2019s not in dispute.<\/p><\/blockquote>\n

<\/p>\n

So the Walsh campaign thought prosecuting women who abort was distinct enough from merely banning abortion to warrant a separate line in a commercial, but when pressed, the latter is their only justification for the former? Sounds par for the course in the world of pro-abortion logic. [Full disclosure: I also work for the National Pro-Life Alliance<\/a>, which lobbies for the LCA.]<\/p>\n

Team Walsh\u2019s next defense doesn’t fare any better:<\/p>\n

The\u00a0Independent Record\u00a0newspaper article cited by the Walsh campaign also doesn’t support the ad\u2019s claim. The article was about the reaction to Republican Todd Akins\u2019 controversial comments on \u201clegitimate rape\u201d during the 2012 Senate election in Missouri. Daines said he found Akins\u2019 remarks \u201cextremely offensive,\u201d but his Democratic opponent in the 2012 House race, Kim Gillian, claimed Daines\u2019 criticism of Akins wasn’t strong enough. At the end of the article, the paper writes: \u201cDaines noted that his position is the same as the national Republican Party\u2019s platform: That abortion should be legal only to save the life of the mother.\u201d<\/p>\n

Passalacqua, Walsh\u2019s spokeswoman, cites Daines\u2019 support for the Republican platform as evidence that he \u201cproposed making women criminals for having an abortion.\u201d She argues, \u201cThe Republican Platform does not include any provision to protect women who receive abortions from penalties. Abortion, once illegal would be a criminal act.\u201d<\/p>\n

It\u2019s true that in past years the GOP platform contained language that specifically opposed any \u201cpunitive action\u201d against women for obtaining an abortion. In 2004, the last time the platform contained such language,\u00a0the platform said<\/a>: \u201cWe oppose abortion, but our pro-life agenda does not include punitive action against women who have an abortion.\u201d<\/p>\n

But absence of the language isn’t evidence that Daines \u201cproposed making women criminals for having an abortion[.]\u201d<\/p><\/blockquote>\n

As if that wasn’t enough, Kiely goes on to note that not only have other major pro-life bills, such as the Pain-Capable Unborn Child Protection Act and Partial-Birth Abortion Ban Act, explicitly exempted abortion-seeking women from prosecution, but also that pro-aborts\u2019 own sainted Guttmacher Institute admits that prosecuting women would be a departure from pro-life legal tradition:<\/p>\n

In a paper on the\u00a0history of abortion before\u00a0Roe V. Wade<\/em><\/a>, the Guttmacher Institute says abortion was widely illegal in the United States from the mid-1800s to the early 1960s and violating state abortion laws carried \u201cserious legal consequences.\u201d During this time, the Guttmacher paper says, \u201c[w]omen were rarely convicted for having an abortion; instead, the threat of prosecution often was used to encourage them to testify against the provider.\u201d<\/p><\/blockquote>\n

Kiely and FactCheck.org should be commended for so exhaustively scrutinizing the truth behind Walsh\u2019s lie, but there\u2019s actually one additional detail that bears highlighting.<\/p>\n

At MediaTrackers Montana, Ron Catlett points out<\/a> that the ad\u2019s speaker, identified by the Walsh Campaign only as<\/a> Helena, MT resident and rape survivor Melissa Barcroft, \u201cis\u00a0a Grassroots Organizer for Planned Parenthood of Montana<\/a>\u00a0and\u00a0regularly writes<\/a>\u00a0for the Planned Parenthood Advocates of Montana website where she has attacked Daines for his pro-life beliefs.\u201d<\/p>\n

Granted, rape survivors deserve our sympathy no matter where they work, but hiding Barcroft\u2019s biases and presenting her as a private citizen motivated to get involved strictly by Daines\u2019s actions and not by her own ideology is a cheap attempt to further exaggerate the \u201cextremism\u201d of his already-distorted record.<\/p>\n

Further, if Barcroft really was the non-partisan Walsh presented her as, it would be easy to imagine she was merely misled by sleazy political operatives exploiting the horrible crime committed against her. But a semi-professional, self-described<\/a> \u201cactivist for reproductive rights and justice\u201d who works for Planned Parenthood and attends Emily’s List training events<\/a> has a greater responsibility to know whether the things she says are true\u2014and less room to claim she didn’t know better. Alas, Barcroft also says<\/a> people who support parental consent for abortion<\/a> \u201cthink their daughters are property,\u201d so it seems that ship has sailed already.<\/p>\n

Naturally, an ostensible hard-news report<\/a> by the Huffington Post\u2019s<\/em> Samantha Lachman and a campaign round-up<\/a> by Rachel Maddow hench-blogger Steve Benen \u201cmissed\u201d both the truth behind Walsh\u2019s claim and Barcroft\u2019s status as a pro-abortion activist. To their credit, the Washington Post’s<\/em> Sean Sullivan<\/a> and the Missoulian State Bureau’s <\/a><\/em>Mike Dennison<\/a> bothered to check what the LCA actually said (Dennison also thought to ask whether Barcroft\u2019s rape had resulted in pregnancy, which the Walsh campaign refused to answer), but neither caught her true identity.<\/p>\n

It\u2019s a pity fact-checkers who operate as advertised seem to be the exception, rather than the rule\u2014they\u2019re especially needed in the abortion debate, where the \u201cright to choose\u201d apparently also includes the right to choose your own facts.<\/p>\n","protected":false},"excerpt":{"rendered":"
