Taylor recently pleaded guilty to four charges of felony nonpayment of child support. In connection with his plea, an Ohio judge placed Taylor on probation and, as a condition of that probation, ordered Taylor not to have any more children until he had paid his child support debt. Specifically, Taylor was ordered to \u201cmake all reasonable efforts to avoid impregnating a woman during the community control period or until such time that [he] can prove to the Court that he is able to provide support for his children he already has and is in fact supporting the children or until a change in conditions warrant the lifting of this condition.\u201d<\/p><\/blockquote>\n<p><!--more--><\/p>\n<p>Judge James Walther characterized his decision as a \u201cmatter of common sense and personal responsibility,\u201d but Pieklo fears this \u201cconservative judge\u201d (who\u2019s <a href=\"http:\/\/www.loraincounty.us\/Info-Center\/County-Officials.aspx\">actually a Democrat<\/a>) is continuing a trend of eroding the \u201cfundamental constitutional right\u201d to procreate, which\u2014of course\u2014is most endangered for \u201cthe poor and people of color\u201d:<\/p>\n<blockquote><p>Perhaps in cases of extreme neglect or failure to support, it\u2019s easier to stomach the kind of probation condition ordered for Taylor and other\u00a0convicted persons. And there\u2019s a long line of case law that justifies more state invasions of privacy based on a person\u2019s relationship to the criminal justice system. But as the\u00a0Buck v. Bell\u00a0decision makes so clear, it really is a slippery slope from determining who is \u201cfit\u201d by the state\u2019s standards to reproduce and who is not. In Buck v. Bell, the Supreme Court justified the mandatory sterilization law by reasoning that \u201cthree generations of imbeciles are enough,\u201d reflecting\u00a0a\u00a0disdain for people with developmental disabilities in our culture and enshrining it in our law.<\/p>\n<p>As more and more people fall into the reach of the criminal justice system simply because they are poor, decisions like those\u00a0made in Taylor\u2019s case threaten to do the same with the cultural disdain for poverty.<\/p><\/blockquote>\n<p>First, I think \u201cimpregnated four different women yet helped none of them with the resulting children\u201d is straightforward and egregious enough that we can safely rule out Taylor\u2019s skin color or economic class as the real motivating factor.<\/p>\n<p>Second, last time I checked, not being forced to live behind bars is at least as big a \u201cfundamental constitutional right\u201d as child-rearing, yet it\u2019s unquestionably constitutional to revoke that right upon a guilty verdict, so one need not agree with Walther\u2019s ruling to nevertheless understand that similarly revoking the right to reproduce isn\u2019t exactly going out on a limb, legally speaking.<\/p>\n<p>Third, if you <em>really<\/em> want to talk about <a href=\"\/news\/?s=disability\">enshrining &#8220;a disdain for people with developmental disabilities&#8221; in our law<\/a>\u2026<\/p>\n<p>What I find most interesting about Pieklo\u2019s piece is the way it actually undermines the narrative she\u2019s trying to weave it into. Assuming this Democrat judge really is part of \u201cthe Right\u201d and pro-lifers are uniformly as gung-ho about banning deadbeats from having kids as she suggests, wouldn&#8217;t punishing and restricting a <em>man<\/em> who reproduces irresponsibly only prove that the sex of the parent and maintaining \u201cproper\u201d gender roles\u00a0<i>aren&#8217;t<\/i>\u00a0our motivation, as feminist\u00a0mythology teaches is why we really oppose abortion? That the welfare of children created by parents who don\u2019t want them really is our driving concern?<\/p>\n<p>It\u2019s especially ironic to see a pro-abort expressing discomfort over a judge ruling that Taylor mustn&#8217;t create children only to imperil their welfare, considering that their movement <a href=\"\/news\/abortion-advocates-solution-for-infant-mortality-crisis-kill-babies-before-birth-since-they-might-die-anyway\/\">justifies abortion using the exact same logic<\/a>\u2014except, of course, for the fact that abortion \u201csaves\u201d already-existing children by killing them, whereas Judge Walther\u2019s ruling really would do what they pretend abortion does: simply prevent the victim from being created in the first place.<\/p>\n<p>Indeed, so absurd is Pieklo\u2019s attack that of the seven people who commented on the article as of this writing, three disagreed with her and a fourth had mixed feelings. When you can\u2019t even get a majority of RH Reality Check\u2019s notoriously lemming-like commenters to go along with your cockamamie contortion, there\u2019s officially a problem.<\/p>\n<p>The extent of the state\u2019s power to restrict reproduction in the interests of the resulting children is a worthy topic of debate.
