The policies governing Fort Wayne, Indiana\u2019s Public Transportation Corporation (also known as \u201cCitilink\u201d) allow advertising to be placed inside or outside the bus, so long as the advertising does not<\/a> \u201cexpress or advocate opinions or positions upon political, religious, or moral issues.\u201d\u00a0 Women\u2019s Health Link, an organization that provides free health care services for women, wanted to put this 11\u2019\u2019x17\u2019\u2019 advertisement<\/a> in the bus.<\/p>\n

According to a lawsuit<\/a> filed Monday by Women’s Health Link,<\/p>\n

Citilink prohibited Plaintiff\u2019s public service announcement and denied it equal access to its advertising forum because of Women\u2019s Health Link\u2019s life-affirming viewpoint and association with a pro-life group.<\/p><\/blockquote>\n

Other non-profit organizations have been allowed to display advertisements \u2013 some even had to do with health care, but Women\u2019s Health Link was denied<\/a> as the \u201cpublic service announcement was not commercial in nature\u201d and their \u201cwebsite contained information about \u2018controversial issues.\u2019\u201d\u00a0 After a second request, Citilink responded<\/a>, \u201cWe feel that this ad does not educate the general public or raise awareness regarding a significant social issue in a viewpoint neutral manner. We do not choose to post this ad as a PSA.\u201d<\/p>\n

The lawsuit alleges that in allowing Citilink to have broad discretion over who is allowed to advertise, they are allowing content-based restriction on speech and association, in violation of the First Amended.\u00a0 Additionally, Women\u2019s Health Link claims that their Fourteenth Amendment rights to Due Process and Equal Protection have been violated.<\/p>\n

When the city creates an opportunity for community advertising, it cannot single out pro-life organizations for censorship.
