{"id":45351,"date":"2014-01-19T01:12:54","date_gmt":"2014-01-19T06:12:54","guid":{"rendered":"\/news\/?p=45351"},"modified":"2014-01-19T01:12:54","modified_gmt":"2014-01-19T06:12:54","slug":"judge-rules-nyc-anti-pregnancy-center-law-violates-first-amendment","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/judge-rules-nyc-anti-pregnancy-center-law-violates-first-amendment\/","title":{"rendered":"Judge rules NYC anti-pregnancy center law violates First Amendment"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>In March of 2011, Mayor Bloomberg of New York City signed a bill into law \u2013 Local Law 17, which required pregnancy centers to make several disclosures to their clients.\u00a0 These <a href=\"http:\/\/www.adfmedia.org\/files\/PCCNYopinion.pdf\">three disclosures<\/a> are 1) a \u201cStatus Disclosure\u201d \u2013 disclosing if a licensed medical provider is on staff, 2) a \u201cGovernment Message\u201d \u2013 telling clients that the New York City Department of Health and Mental Hygiene encourages pregnant women to talk with a licensed provider, and 3) a \u201cService Disclosure\u201d \u2013 informing the clients if they provide abortion, referrals for abortion, emergency contraception, or prenatal care.\u00a0 Penalties for failure to make these disclosures included civil fines and a potential for a temporary shut down of the pregnancy center.<\/p>\n<p>Several pregnancy centers brought a <a href=\"http:\/\/oldsite.alliancedefensefund.org\/userdocs\/PCCNYcomplaint.pdf\">lawsuit<\/a> challenging the law on First Amendment grounds.\u00a0 The District Court found that all three disclosure requirements ran afoul of the First Amendment and granted a preliminary injunction for the Plaintiff and also enjoined the entire law.\u00a0 New York City and the other defendants appealed the decision to the Second Circuit Court of Appeals.<\/p>\n<p><!--more--><\/p>\n<p>Two of the three judges <a href=\"http:\/\/www.adfmedia.org\/files\/PCCNYopinion.pdf\">ruled<\/a> that only the \u201cStatus Disclosure\u201d was acceptable under the First Amendment, but they found that the \u201cGovernment Message\u201d and \u201cService Disclosure\u201d ran afoul of the protection afforded by the First Amendment.\u00a0 The case will now return back to the District Court.<\/p>\n<p>Justice Wesley, while agreeing that the \u201cGovernment Message\u201d and \u201cService Disclosure\u201d violated the First Amendment, believed the \u201cStatus Disclosure\u201d should be struck down as well.\u00a0 According to his <a href=\"http:\/\/www.adfmedia.org\/files\/PCCNYconcur-dissent.pdf\">written opinion<\/a>:<\/p>\n<blockquote><p>Local Law 17 is a bureaucrat\u2019s dream. It contains a deliberately ambiguous set of standards guiding its application, thereby providing a blank check to New York City officials to harass or threaten legitimate activity.<\/p><\/blockquote>\n<p>He went on to <a href=\"http:\/\/www.adfmedia.org\/files\/PCCNYconcur-dissent.pdf\">explain<\/a>:<\/p>\n<blockquote><p>No one disputes that Local Law 17 burdens First Amendment expression, and in my view the law utterly fails to provide adequate guidance for its enforcement.
