{"id":44716,"date":"2013-12-31T10:48:04","date_gmt":"2013-12-31T15:48:04","guid":{"rendered":"\/news\/?p=44716"},"modified":"2016-09-08T15:43:25","modified_gmt":"2016-09-08T19:43:25","slug":"seventh-circuit-puts-wisconsin-law-requiring-admitting-privileges-for-abortionists-on-hold","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/seventh-circuit-puts-wisconsin-law-requiring-admitting-privileges-for-abortionists-on-hold\/","title":{"rendered":"Seventh Circuit puts Wisconsin law requiring admitting privileges for abortionists on hold"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><div id=\"attachment_28022\" style=\"width: 310px\" class=\"wp-caption alignright\"><img aria-describedby=\"caption-attachment-28022\" decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-28022\" style=\"margin-left: 15px;\" alt=\"planned-parenthood-wisconsin\" src=\"\/news\/wp-content\/uploads\/2013\/02\/planned-parenthood-wisconsin-300x202.jpg\" width=\"300\" height=\"202\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/02\/planned-parenthood-wisconsin-300x202.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/02\/planned-parenthood-wisconsin.jpg 800w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-28022\" class=\"wp-caption-text\">Planned Parenthood is one of Wisconsin&#8217;s largest abortion providers.<\/p><\/div>\n<p>The Seventh Circuit <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D12-20\/C:13-2726:J:Manion:con:T:fnOp:N:1262114:S:0\">recently upheld an injunction<\/a>, stopping a law from going into effect that would not allow an abortionist to perform an abortion unless that doctor had admitting privileges at a hospital within a 30-mile radius from the abortion clinic.\u00a0 Planned Parenthood of Wisconsin and Milwaukee Women\u2019s Medical Service, the only two abortion providers in Wisconsin, filed a lawsuit challenging the new law.\u00a0 When the district court granted a preliminary injunction, the case was appealed.<\/p>\n<p>Judge Posner, writing for the court noted that there was only a weekend between when the law was passed and when it was to take effect and that it takes two to three months to obtain admitting privileges at a hospital.\u00a0 However, it was noted that five months after the law was to take effect, none of the abortionists have been granted admitting privileges and one doctor has been flat out denied his request.\u00a0 Posner focuses <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D12-20\/C:13-2726:J:Manion:con:T:fnOp:N:1262114:S:0\">part of his opinion<\/a> on the fact that a weekend is not enough time to gain admitting privileges:<\/p>\n<blockquote><p>The impossibility of compliance with the statute even by doctors fully qualified for admitting privileges is a compelling reason for the preliminary injunction, albeit a reason that diminishes with time. There would be no quarrel with a one\u2010year deadline for obtaining admitting privileges as distinct from a one\u2010weekend dead\u2010 line, and if so that might seem to argue for a one\u2010year (or even somewhat shorter) duration for the preliminary injunction.<\/p><\/blockquote>\n<p>Posner also found an equal protection issue in this case, based on the fact that abortion was singled out from other medical procedures, <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D12-20\/C:13-2726:J:Manion:con:T:fnOp:N:1262114:S:0\">stating<\/a>, \u201cAn issue of equal protection of the laws is lurking in this case.\u201d<\/p>\n<p><!--more--><\/p>\n<p>Judge Manion, <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D12-20\/C:13-2726:J:Manion:con:T:fnOp:N:1262114:S:0\">in his opinion<\/a>, which concurred in part with the majority, found that the law met the rational basis test:<\/p>\n<blockquote><p>Wisconsin\u2019s admitting-privileges requirement adds an extra layer of protection for <i>all <\/i>of the patients of abortion doctors. Indeed, every circuit to address the issue has held that admitting-privileges requirements further states\u2019 legitimate interests.<\/p><\/blockquote>\n<p>He <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D12-20\/C:13-2726:J:Manion:con:T:fnOp:N:1262114:S:0\">points out<\/a> that the state does have a reason to single out abortion, \u201cWisconsin had a perfectly good reason for addressing abortion first\u2014namely, the Gosnell scandal. \u201c\u00a0 Manion <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D12-20\/C:13-2726:J:Manion:con:T:fnOp:N:1262114:S:0\">went on to write<\/a>:<\/p>\n<blockquote><p>There has been no high-profile exposure of substandard care by doctors who perform outpatient procedures other than abortion. However, just a few weeks prior to the enactment of Wisconsin\u2019s admitting-privileges requirement, there was a shocking revelation of terrible conditions and procedures at an abortion clinic that received nationwide attention.<\/p><\/blockquote>\n<p>Manion <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D12-20\/C:13-2726:J:Manion:con:T:fnOp:N:1262114:S:0\">concludes<\/a> that the law \u201cis rationally related to the State\u2019s legitimate interests and should not create an undue burden to Wisconsin women\u2019s right to abortion. \u201c\u00a0 However, he believes that the short time frame between the passing of the law and the law taking effect was not reasonable.\u00a0 As such, he believes the preliminary injunction was appropriate.<\/p>\n<p>The case will now proceed back to the district court where it will be heard on the merits.\u00a0 The law will not take effect unless it is upheld by the court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Seventh Circuit recently upheld an injunction, stopping a law from going into effect that would not allow an abortionist to perform an abortion unless that doctor had admitting privileges at a hospital within a 30-mile radius from the abortion clinic.\u00a0 Planned Parenthood of Wisconsin and Milwaukee Women\u2019s Medical Service, the only two abortion providers [&hellip;]<\/p>\n","protected":false},"author":200,"featured_media":31193,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false},"categories":[4],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.7 -
