That\u2019s because, despite being a self-professed liberal, Dershowitz exercises greater objectivity than most of his ideological brethren.<\/p>\n<p>And he recently displayed that objectivity on CNBC. On Monday, he <a href=\"http:\/\/video.cnbc.com\/gallery\/?play=1&amp;video=3000209997\">told<\/a> Larry Kudlow:<\/p>\n<blockquote><p>I can\u2019t find anything in the Constitution that says you prefer the life of the mother, or the convenience of the mother if it\u2019s an abortion by choice, over the potential life of the fetus. Look, I think women if they\u2019re required to not have abortions could die and could &#8212; so I favor a woman\u2019s right to choose. But I can\u2019t find it in the Constitution. And everything I favor I don\u2019t think is necessarily constitutionally based. <!--more--><\/p><\/blockquote>\n<p>As a policy matter, Dershowitz is tragically wrong &#8211; the fetus\u2019s life is <a href=\"http:\/\/www.deathroe.com\/pro-life_answers\/answers.cfm?ID=58\">actual, not potential<\/a>, and pro-life principles <a href=\"\/news\/a-student-interviews-josh-brahm-on-fetal-pain-the-inhumanity-of-abortion-in-what-scenario-would-he-perform-an-abortion\/\">do not mean<\/a> that women must continue truly life-threatening pregnancies &#8211; but it\u2019s refreshing that he refrains from using judicial malpractice to get what he wants.<\/p>\n<p>This isn\u2019t the first time Dershowitz has made this point; in 2001, he <a href=\"http:\/\/washingtonexaminer.com\/the-pervading-dishonesty-of-roe-v.-wade\/article\/1080661\">wrote<\/a> that \u201cclear governing constitutional principles\u201d were \u201cnot present\u201d in <em>Roe v. Wade<\/em>, and that \u201c[j]udges have no special competence, qualifications, or mandate to decide between equally compelling moral claims (as in the abortion controversy),\u201d making abortion an issue \u201cmore appropriately left to the political process.\u201d<\/p>\n<p>Indeed. Whenever the Constitution mentions the central \u201cright\u201d <em>Roe<\/em> hinges on, privacy, it <a href=\"\/news\/privacy-dumbest-argument-legal-abortion\/\">can&#8217;t even be remotely construed<\/a> as applicable to abortion. And the rest of the ruling <a href=\"http:\/\/liveaction.org\/blog\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">makes a mockery<\/a> of logic, law, history, and science:<\/p>\n<blockquote><p>First, the Constitution doesn\u2019t define person, but the Constitution doesn\u2019t define privacy either. The Supreme Court applied a double standard in Roe, arbitrarily giving the word person a narrow definition and the word privacy a broad definition in order to rationalize its decision to legalize abortion-on-demand. Second, if a fetus isn\u2019t a person because the provisions of the Constitution don\u2019t apply to a fetus, then infants aren\u2019t persons either, because the provisions also don\u2019t apply to infants. Or adolescents in some instances. Third, it\u2019s irrelevant if state abortion laws were less restrictive in the past. Many laws were less restrictive in the past. And it\u2019s irrelevant if state abortion laws originate from statutes not common-law. Many laws originate from statutes. Fourth, when the Fourteenth Amendment was adopted in 1868, abortion was already restricted by at least <a href=\"http:\/\/caselaw.lp.findlaw.com\/cgi-bin\/getcase.pl?court=us&amp;vol=410&amp;invol=113\">36 laws<\/a> enacted by state or territorial legislatures, including the very Texas law the Supreme Court struck down in Roe. Or in other words, state or territorial laws restricting abortion were already recognized when the Fourteenth Amendment was adopted: the Amendment wasn\u2019t intended to overturn laws restricting abortion [\u2026]<\/p>\n<p>The Court deliberately ignored the facts and misled the public. First, the question of when human life begins is neither one of philosophy nor theology; the question is one of science. Second, the medical community had already arrived at the consensus that human life begins at conception. In October 1971, a group of medical experts filed a brief of <a href=\"http:\/\/caselaw.lp.findlaw.com\/cgi-bin\/getcase.pl?court=us&amp;vol=410&amp;invol=113\">amicus curiae<\/a> (advice to a court from a person or persons not a party to the case) to the Supreme Court. The brief showed conclusively that science (embryology, fetology, genetics, perinatology, all of biology) establishes that human life begins at conception. And not a single person or group refuted the brief.<\/p><\/blockquote>\n<p>Alan Dershowitz deserves credit for distinguishing between his policy goals and the tactics used to pursue them.
