Wade<\/em><\/a>, the \u201cright to privacy\u201d remains one of abortion\u2019s most important defenses, not to mention the alleged reason why voters cannot be allowed to decide on abortion\u2019s legality at the ballot box.<\/p>\n<p>But for its importance, privacy is also perhaps the most nonsensical of all arguments for allowing people to kill their babies.<\/p>\n<p>Embryology denial and bodily autonomy don\u2019t hold up to analytical scrutiny, but at least they seem kind of sensible if you aren\u2019t familiar with the science behind the former or don\u2019t stop to think too much about the latter.<\/p>\n<p>Privacy, however, doesn\u2019t even come close to justifying abortion on a superficial level.<!--more--><\/p>\n<p>Though conceding that \u201cthe Constitution does not explicitly mention any right of privacy,\u201d <em>Roe<\/em>\u2019s <a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/historics\/USSC_CR_0410_0113_ZO.html\">majority ruling<\/a> held that past Supreme Court decisions had found \u201croots\u201d and \u201cpenumbras\u201d pointing to such a right in various clauses of the Constitution, and that it had \u201csome extension to activities relating to\u201d marriage, procreation, contraception, family relationships, and child-rearing. Therefore, the author, Justice Harry Blackmun, wrote:<\/p>\n<blockquote><p>This right of privacy, whether it be founded in the Fourteenth Amendment&#8217;s concept of personal liberty and restrictions upon state action, as we feel it is, or, as the District Court determined, in the Ninth Amendment&#8217;s reservation of rights to the people, is broad enough to encompass a woman&#8217;s decision whether or not to terminate her pregnancy.<\/p><\/blockquote>\n<p>If that seems like Blackmun forgot to show his work, it\u2019s because he did. Even putting aside his reaching to stretch how far the Constitution\u2019s privacy-related provisions go, there is no logical connection between someone\u2019s personal privacy and actions that harm someone <em>other than<\/em> oneself. None.<\/p>\n<p>Is there any other aspect of life or law where such a claim wouldn\u2019t immediately get laughed out of the room? If you\u2019re charged with assault, rape, or murder, good luck trying to convince the judge or jury that the fact that you did it in the privacy of your basement should make a difference. In fact, using privacy to obscure your crime &#8211; as did the late Ariel Castro &#8211; is typically thought of as an exacerbating factor, not a mitigating one. Yet for abortion, it\u2019s deemed a fount of unquestionable moral legitimacy.<\/p>\n<p>The closest parallel we have would be the controversy over Stand Your Ground laws protecting the use of lethal force against an intruder on your property. But there, the rationale hinges on the threat of being harmed or killed by an intruder, not that a man\u2019s home is literally his castle in which he may exercise absolute dominion over whoever is within his walls.<\/p>\n<p>It\u2019s telling that even Blackmun recognized privacy\u2019s inadequacy, right in <em>Roe<\/em>\u2019s text, by conceding:<\/p>\n<blockquote><p>The appellee and certain amici argue that the fetus is a &#8220;person&#8221; within the language and meaning of the Fourteenth Amendment. In support of this, they outline at length and in detail the well known facts of fetal development. If this suggestion of personhood is established, the appellant&#8217;s case, of course, collapses, for the fetus&#8217; right to life would then be guaranteed specifically by the Amendment.<\/p><\/blockquote>\n<p>Therefore, humanity\/personhood is the determining factor in whether someone is legally killable for personal convenience &#8211; not privacy. In fact, privacy isn\u2019t a defense even when the victim isn\u2019t human at all; just ask <a href=\"http:\/\/www.whiotv.com\/news\/news\/crime-law\/animal-cruelty-suspected-at-dayton-home\/nZc4f\/\">this Ohio man<\/a> busted for multiple counts of animal cruelty inside his house.<\/p>\n<p>So shouldn\u2019t pro-choice rhetoric and legal theory that hinges on the right to privacy have died out? Or are the arguments just lofty-sounding placeholders for \u201cI want this\u201d?<\/p>\n<p>It\u2019s easy to see why pro-aborts have prioritized other arguments over privacy, but not so much as to admit that abortion\u2019s status as a court-created right is founded on a joke.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lately it may not be as popular as purposely vague platitudes about \u201cwomen\u2019s health care\u201d and indignant assertions of \u201cbodily autonomy,\u201d but thanks to its starring role in Roe v.
