For seventeen years, a legal battle<\/a> has been waging around the parental consent law passed in 1995. But the history of that legal battle goes back even farther in time.<\/p>\n

The Parental Notice of Abortion Act of 1995 actually has a history that started in 1983, with the passage of the Parental Notice of Abortion Act of 1983. That law was put into effect into 1983 over the veto of Illinois\u2019s Governor Thompson. A lawsuit was brought challenging its constitutionality, and the case eventually made it to the U.S. Supreme Court, where the District Court’s decision (striking down the 24-hour waiting period) was affirmed without an opinion. Litigation continued with a petition to review the constitutionality of the 1983 Act. In 1995, the 1983 Act was repealed by the Illinois legislature and replaced with the Parental Notice of Abortion Act of 1995.<\/p>\n

The 1995 Act required that \u201c48 hours actual notice\u201d be given to \u201can adult family member\u201d if the person seeking an abortion was either an unemancipated minor or an incompetent person. Five exceptions were provided wherein that notice was not required. Six days after the Act was passed, the constitutionality was challenged. Litigation has continued for seventeen years, but today, the Illinois Supreme Court unanimously has upheld the law<\/a> and dismissed the lawsuit.<\/p>\n

The majority opinion<\/a>\u00a0states in part:<\/p>\n

[W]e reject plaintiffs\u2019 premise that our constitution\u2019s privacy clause protects a woman\u2019s right to have an abortion.<\/p>\n

[W]e find, as did the circuit court below, that plaintiffs cannot show that the Act\u2019s intrusions on a minor\u2019s privacy are unreasonable\u2014at least not in all cases, which is all that is necessary to defeat a facial challenge.<\/p>\n

[W]e find that, while a minor clearly has an expectation of privacy in her medical information, which includes the fact of her pregnancy, the intrusion on the minor\u2019s privacy occasioned by the Act is not unreasonable.<\/p><\/blockquote>\n

According to Casey Mattox<\/a>, Senior Counsel with Alliance Defending Freedom:<\/p>\n

The well-being of young women is more important than the bottom line of abortionists. All this law has sought to do since 1995 is to uphold the duty and desire of parents to protect their own children rather than allow them to be taken advantage of by others. As the Illinois Supreme Court unanimously found, the law constitutionally encourages \u2018an unmarried, pregnant minor to seek the help and advice of a parent or other adult family member in making the very important decision whether or not to bear a child.\u2019 The ACLU kept this law from protecting women for more than 17 years, but that is now over.<\/p><\/blockquote>\n
