{"id":36583,"date":"2013-06-14T03:40:51","date_gmt":"2013-06-14T07:40:51","guid":{"rendered":"\/news\/?p=36583"},"modified":"2013-06-14T12:03:08","modified_gmt":"2013-06-14T16:03:08","slug":"planned-parenthood-aclu-sue-over-new-alabama-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/planned-parenthood-aclu-sue-over-new-alabama-law\/","title":{"rendered":"Planned Parenthood, ACLU sue over new Alabama law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Planned Parenthood and the American Civil Liberties Union <a href=\"http:\/\/www.reuters.com\/article\/2013\/06\/11\/us-usa-abortion-alabama-idUSBRE95A17U20130611\">filed a federal lawsuit<\/a> on Tuesday challenging the <a href=\"http:\/\/www.lifenews.com\/2013\/04\/09\/alabama-gov-signs-bill-that-could-close-abortion-clinics\/\">Women\u2019s Health and Safety Act<\/a>, an Alabama law that will increase medical standards at abortion facilities by requiring them to meet the same building codes as ambulatory surgical centers and requiring abortionists to have admitting privileges at local hospitals.<\/p>\n<p>Abortion facilities will have 180 days to comply with the new law, which will go into effect on July 1. There are five licensed abortion facilities in Alabama, all located in heavily populated areas near college campuses &#8211; Tuscaloosa, Birmingham, Montgomery, Huntsville, and Mobile. A sixth abortion center, New Woman All Women, is operating illegally, for which <a href=\"\/news\/lawsuit-against-illegally-operating-birmingham-abortion-center-continues\/\">the state is pressing charges<\/a> against its owner, \u201cabortion queen\u201d Diane Derzis; her secretary Patrick Smith; and abortionist Bruce Norman.<\/p>\n<p>The lawsuit <a title=\"claims\" href=\"http:\/\/blog.al.com\/wire\/2013\/06\/planned_parenthood_southeast_f.html\" target=\"_blank\">claims<\/a> that the Planned Parenthood facilities in Birmingham and Mobile and the abortion center in Montgomery will be unable to comply with the new law, restricting women\u2019s access to abortion. The lawsuit claims that requiring abortionists to have admitting privileges at a local hospital is medically unnecessary, despite the numerous women who have been hospitalized in Alabama as a result of complications from abortions.<\/p>\n<p>Planned Parenthood and the ACLU are going to court on behalf of abortion centers that have a history of providing women with a very poor standard of care. The entire Alabama abortion industry has proven unsafe, unsanitary, and in desperate need of regulation.<\/p>\n<p><b>Birmingham<\/b><\/p>\n<p>In 2012, Roberta Clark <a href=\"http:\/\/abortiondocs.org\/wp-content\/uploads\/2012\/09\/Clark-v.-PPUmoren1.pdf\">filed charges<\/a> against the Birmingham Planned Parenthood for negligence resulting in a botched abortion. Abortionist Aqua-don Umoren failed to diagnose Clark&#8217;s tubal pregnancy, which ruptured 25 days later, forcing her to undergo emergency surgery. She is now infertile. LifeSiteNews <a href=\"http:\/\/www.lifesitenews.com\/news\/alabama-planned-parenthood-sued-after-botched-abortion-leaves-client-infert\/\">reported<\/a>:<\/p>\n<blockquote><p>Roberta Clark walked into the Birmingham Planned Parenthood on August 20, 2010, for what she thought would be a routine first-trimester abortion. An ultrasound exam was conducted by an unlicensed, untrained worker, who said indicated that Clark was eight weeks, four days pregnant with an intrauterine pregnancy, when in fact, the ultrasound indicated there was no baby in the womb. Umoran noted in Clark\u2019s chart that he conducted a pelvic exam that he said concurred with the eight week, four day diagnosis.<\/p>\n<p>\u2026Clark was given a suction abortion, after which she continued to complain of nausea, vomiting, and pelvic pain. The pathology report that indicated no fetal parts were identified in the tissue specimen that had been submitted for inspection that same day. Clark was not informed of this nor is there a record of her receiving any follow-up care from Umoren or Planned Parenthood.<\/p>\n<p>Twenty five days later, Clark was in a Birmingham hospital E.R. undergoing emergency surgery to save her life. Doctors removed her ruptured fallopian tube containing a 13-week fetus and placenta.<\/p><\/blockquote>\n<p>The Birmingham Planned Parenthood was put on probation in 2008 after Live Action documented the <a title=\"willingness of its employees to cover up statutory rape\" href=\"http:\/\/www.liveaction.org\/monalisa\/birmingham-alabama\/\" target=\"_blank\">willingness of its employees to cover up statutory rape<\/a>.<\/p>\n<p>In January 2012, New Woman All Women sent three abortion patients to the hospital in one day. One of the women, who was bleeding and partially clothed, had to be <a title=\"hand-carried\" href=\"http:\/\/www.lifenews.com\/2012\/01\/22\/botched-abortions-injure-two-women-in-birmingham-alabama\/) to\" target=\"_blank\">hand-carried down steps to a gurney<\/a> in a trash-filled alley.<\/p>\n<p>As I\u2019ve <a title=\"previously reported\" href=\"\/news\/lawsuit-against-illegally-operating-birmingham-abortion-center-continues\/\" target=\"_blank\">previously reported<\/a>:<\/p>\n<blockquote><p>In March 2012, the health department issued a <a href=\"http:\/\/abortiondocs.org\/wp-content\/uploads\/2012\/04\/NEW-WOMAN-ALL-WOMEN-201203011.pdf\">76-page deficiency report<\/a> about the conditions at New Woman All Women and in April 2012, the health department announced that New Woman All Women had been ordered to surrender its license by no later than May 18, 2012.\u00a0 The deficiencies included inadequately trained staff; failure to have policy and procedures related to medication errors and the administration of medications, which resulted in the hospitalization of three abortion patients, one of whom was placed in the ICU; no documentation indicating that Derzis\u2019 two abortionists were even licensed to perform abortions; inadequate preparation and administration of drugs, which led to overdoses and inadequate pain management; and use of uninspected equipment.<\/p><\/blockquote>\n<p>The Alabama Department of Public Health denied New Woman All Women two applications to reopen its doors for business. In March 2013, Operation Rescue and other pro-life groups <a title=\"documented\" href=\"http:\/\/www.operationrescue.org\/archives\/birmingham-abortion-clinic-operating-illegally-in-defiance-of-state-ordered-closure\/\" target=\"_blank\">documented<\/a> New Woman All Women advertising for and conducting abortions. After statewide pro-life leaders demanded action, the Alabama Department of Public Health announced that it was <a title=\"investigating\" href=\"\/news\/illegally-operating-abortion-facility-under-investigation-by-state-health-department\/\" target=\"_blank\">investigating<\/a> New Woman All Women for acting as an abortion provider without a license.<\/p>\n<div id=\"attachment_36601\" style=\"width: 277px\" class=\"wp-caption alignright\"><a href=\"\/news\/wp-content\/uploads\/2013\/06\/935767_10102237821110400_664173126_n.jpg\"><img aria-describedby=\"caption-attachment-36601\" decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-36601 \" alt=\"Bound4LIFE Birmingham\" src=\"\/news\/wp-content\/uploads\/2013\/06\/935767_10102237821110400_664173126_n-300x300.jpg\" width=\"267\" height=\"267\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/06\/935767_10102237821110400_664173126_n-300x300.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/06\/935767_10102237821110400_664173126_n-150x150.jpg 150w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/06\/935767_10102237821110400_664173126_n.jpg 654w\" sizes=\"(max-width: 267px) 100vw, 267px\" \/><\/a><p id=\"caption-attachment-36601\" class=\"wp-caption-text\">Bound4LIFE Birmingham.<\/p><\/div>\n<p>Derzis filed a motion to dismiss the case on the grounds that the Alabama Department of Public Health doesn\u2019t have the jurisdiction to enforce health and safety regulations. She withdrew her motion on May 31, and Judge Joseph Boohaker ruled to expedite the hearing against New Woman All Women. It will be held on August 5.<\/p>\n<p>The pro-life movement in Birmingham is very strong &#8211; it holds well-attended 40 Days for Life campaigns and has a <a title=\"Bound4LIFE chapter\" href=\"http:\/\/bound4life.com\/local-chapters\/\" target=\"_blank\">Bound4LIFE chapter<\/a> that regularly prays outside Planned Parenthood and New Woman All Women, and local activists, including a newly formed Students for Life group at the University of Alabama at Birmingham, are involved in numerous pro-life efforts.<\/p>\n<p><b>Tuscaloosa<\/b><\/p>\n<p>The West Alabama Women\u2019s Center is strategically located just down the street from The University of Alabama. Dr. Louis Payne, the facility\u2019s lone abortionist, has admitting privileges at a local hospital. It is unclear whether the West Alabama Women\u2019s Center will be able to comply with the building codes required by the Women\u2019s Health and Safety Act; however, it hasn\u2019t teamed up with Planned Parenthood and the ACLU to take the new law to court.<\/p>\n<p>In 2013, the Alabama Department of Public Health found that the West Alabama Women\u2019s Center <a title=\"failed to meet its own sterility standards\" href=\"http:\/\/adphnotes.state.al.us\/hcfweb.nsf\/d071913f859fe47d862571ce00736df8\/77857a017a1c49e386257b1a006c64ef\/$FILE\/west%20alabama%20women's%20center,%20inc%2001112013.pdf\" target=\"_blank\">failed\u00a0 to meet its own sterility standards<\/a> for hand-washing, glove usage, cleaning of supplies, and safe use of sharps containers. There were needles lying on the floor, a broken soap dispenser that made safe hand-washing impossible, and unlabeled syringes containing liquid.<a href=\"\/news\/wp-content\/uploads\/2013\/06\/2649365.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-36596 alignleft\" style=\"margin-right: 15px; margin-top: 5px; margin-bottom: 5px;\" alt=\"2649365\" src=\"\/news\/wp-content\/uploads\/2013\/06\/2649365-300x169.jpg\" width=\"352\" height=\"198\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/06\/2649365-300x169.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/06\/2649365.jpg 706w\" sizes=\"(max-width: 352px) 100vw, 352px\" \/><\/a><\/p>\n<p>In 2011, the Alabama Department of Public Health found that West Alabama Women\u2019s Center <a title=\"failed to follow its own policy\" href=\"http:\/\/adphnotes.state.al.us\/hcfweb.nsf\/d071913f859fe47d862571ce00736df8\/0e2b11cab9a45ea68625797a006cb3bc\/$FILE\/west%20alabama%20women's%20center,%20inc%2007262011.pdf\" target=\"_blank\">failed to follow its own policy<\/a> for gestational age limits. The abortion center had aborted a baby who was just older than 20 weeks.<\/p>\n<p>In 2010, the Alabama Department of Public Health issued a deficiency report revealing that the West Alabama Women\u2019s Center had <a title=\"failed\" href=\"http:\/\/abortiondocs.org\/wp-content\/uploads\/2012\/10\/West-Alabama-Womens-Deficiency-Report-Oct-28-2010.pdf\" target=\"_blank\">failed<\/a> to have documented physician orders and records of who administered patient medication.<\/p>\n<p>Tuscaloosa\u2019s pro-life movement is gaining steady momentum. Bama Students for Life, the pro-life group at The University of Alabama, maintains a weekly presence outside the abortion facility; in the past year or so, more and more community members have begun praying and sidewalk-counseling throughout the week; and Tuscaloosa&#8217;s pregnancy resource center is closer to campus than the abortion business.<\/p>\n<p><b>Montgomery<\/b><\/p>\n<p>Reproductive Health Services has largely flown under the radar as New Woman All Women\u2019s appalling conditions were revealed to the public. According to Alabama Physicians for Life, one of their abortionists is infamous Aqua-don Umoren, who also works at the Birmingham Planned Parenthood.<\/p>\n<p>Montgomery was formerly home to the Beacon Women&#8217;s Center, an abortion facility that <a title=\"closed\" href=\"http:\/\/www.lifenews.com\/2010\/06\/11\/state-5182\/\" target=\"_blank\">closed in 2006<\/a> after a nurse gave the abortion pill to a woman with high blood pressure who required medical attention. The state also found that the facility had improperly distributed controlled substances without proper physician authorization, failed to adhere to state ultrasound laws, and used unsterilized equipment. Nurses had failed to administer correct medication, and there were numerous other deficiencies.<\/p>\n<p><b>Huntsville<\/b><\/p>\n<p>In 2013, the Alabama Department of Public Health issued a <a title=\"deficiency report\" href=\"http:\/\/adphnotes.state.al.us\/hcfweb.nsf\/1b480cf04b92be2786256d2600704885\/7bf57ecd91a4947086257b1a006c3132\/$FILE\/alabama%20women%27s%20center%20for%20rep%2001092013.pdf\" target=\"_blank\">deficiency report<\/a> indicating that Alabama Women\u2019s Center for Reproductive Alternatives didn\u2019t clean exam tables between abortions, dispensed expired medication, and failed to comply with state informed consent laws.<\/p>\n<p>In 2006, the health department found Alabama Women\u2019s Center for Reproductive Alternatives in <a title=\"violation of ten health codes\" href=\"http:\/\/www.lifenews.com\/2006\/11\/30\/state-1980\/\" target=\"_blank\">violation of ten health codes<\/a>.<\/p>\n<p>The pro-life movement in Huntsville is relentless in its dedication &#8211; community members regularly hold prayer vigils outside Alabama Women\u2019s Center for Reproductive Alternatives, often drawing crowds of 100-200 pro-lifers.<\/p>\n<div id=\"attachment_36598\" style=\"width: 310px\" class=\"wp-caption alignleft\"><a href=\"\/news\/wp-content\/uploads\/2013\/06\/GEDC1205-2.jpg\"><img aria-describedby=\"caption-attachment-36598\" decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-36598\" alt=\"Young pro-life activists pray outside the Alabama Women's Center for Reproductive Alternatives. \" src=\"\/news\/wp-content\/uploads\/2013\/06\/GEDC1205-2-300x225.jpg\" width=\"300\" height=\"225\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/06\/GEDC1205-2-300x225.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2013\/06\/GEDC1205-2.jpg 800w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-36598\" class=\"wp-caption-text\">Young pro-life activists pray outside the Alabama Women&#8217;s Center for Reproductive Alternatives.<\/p><\/div>\n<p>It is astounding that the abortion lobby maintains its claim that it seeks to protect \u201cwomen\u2019s health,\u201d yet it insists that regulating abortion centers with shocking records of negligence, illegal activity, and blatant disregard for the basic dignity with which every woman deserves to be treated is somehow bad for women.<\/p>\n<p>Let\u2019s pray that in light of the horrors that the Gosnell trial revealed, true respect for women\u2019s health prevails over the self-serving interests of Planned Parenthood and its abortion-loving ally the ACLU.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Defending abortion facilities with a long, long list of infractions, failures, and dangers to women.<\/p>\n","protected":false},"author":225,"featured_media":36598,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false},"categories":[8],"tags":[575,695,1325],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.7 -
