{"id":35866,"date":"2013-06-01T21:46:17","date_gmt":"2013-06-02T01:46:17","guid":{"rendered":"\/news\/?p=35866"},"modified":"2016-09-16T18:54:24","modified_gmt":"2016-09-16T22:54:24","slug":"lawsuit-against-illegally-operating-birmingham-abortion-center-continues","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/lawsuit-against-illegally-operating-birmingham-abortion-center-continues\/","title":{"rendered":"Lawsuit against illegally operating Birmingham abortion center continues"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><img decoding=\"async\" loading=\"lazy\" class=\"alignright size-full wp-image-35884\" style=\"margin-left: 15px; margin-top: 5px; margin-bottom: 5px;\" alt=\"new woman alabama\" src=\"\/news\/wp-content\/uploads\/2013\/06\/new-woman-alabama.jpg\" width=\"240\" height=\"180\" \/>The state of Alabama is <a title=\"moving forward\" href=\"http:\/\/blog.al.com\/spotnews\/2013\/05\/judge_clears_path_for_august_h.html\" target=\"_blank\">moving forward<\/a> with its charges against notorious Birmingham abortion center New Woman All Women, which has been <a title=\"operating illegally\" href=\"http:\/\/www.operationrescue.org\/archives\/birmingham-abortion-clinic-operating-illegally-in-defiance-of-state-ordered-closure\/\" target=\"_blank\">operating illegally<\/a> despite being <a title=\"ordered by the Alabama Department of Public Health to close\" href=\"http:\/\/www.lifenews.com\/2012\/04\/06\/abortion-clinic-in-alabama-closed-after-botched-abortions\/\" target=\"_blank\">ordered by the Alabama Department of Public Health to close<\/a> after it sent two women to the hospital in <a title=\"one day\" href=\"http:\/\/www.lifenews.com\/2012\/01\/22\/botched-abortions-injure-two-women-in-birmingham-alabama\/\" target=\"_blank\">one day<\/a>. \u00a0The state is suing New Woman All Women for acting as an abortion provider without a license after <a title=\"pro-life activists demanded\" href=\"\/news\/illegally-operating-abortion-facility-under-investigation-by-state-health-department\/\" target=\"_blank\">pro-life activists demanded<\/a> the Department of Public Health take action.\u00a0 Yesterday, New Woman All Women owner Diane Derzis and her attorneys withdrew their motion to dismiss the case against New Woman All Women, and Judge Joseph Boohaker ruled to expedite the hearing against the infamous abortion center, which will be held on August 5, 2013.\u00a0 New Woman All Women\u2019s motion to dismiss had <a title=\"claimed\" href=\"http:\/\/www.lldf.org\/uncategorized\/birmingham-abortion-business-argues-that-the-alabama-department-of-public-health-does-not-have-jurisdiction-to-enforce-health-and-safety-rules\/\" target=\"_blank\">claimed<\/a> that the Alabama Department of Public Health had no jurisdiction to enforce health and safety rules.<\/p>\n<p>Dana Cody, Life Legal Defense Foundation Executive Director, <a title=\"said\" href=\"http:\/\/www.lldf.org\/uncategorized\/birmingham-abortion-business-argues-that-the-alabama-department-of-public-health-does-not-have-jurisdiction-to-enforce-health-and-safety-rules\/\" target=\"_blank\">said<\/a>, \u201cLife Legal Defense Foundation was instrumental in getting this clinic closed for health code violations a year ago, and has now requested that the Alabama Department of Public Health enforce its own rules by issuing an emergency administrative order of closure against the illegal clinic.\u00a0 Clinic owner Diane Derzis and abortionist Bruce Norman are deliberately violating the law through operation of this clinic, and it ought to be closed immediately.\u201d<\/p>\n<p>The state is pressing charges against All Women\u2019s Inc., of which the lawsuit lists Derzis as the president, doing business as New Woman All Women\u2019s Health.\u00a0 Abortionist Bruce Norman and secretary of All Women\u2019s Inc. Patrick Smith are also defendants.<\/p>\n<p>In March 2012, the health department issued a <a title=\"76-page deficiency report\" href=\"http:\/\/abortiondocs.org\/wp-content\/uploads\/2012\/04\/NEW-WOMAN-ALL-WOMEN-201203011.pdf\" target=\"_blank\">76-page deficiency report<\/a> about the conditions at New Woman All Women and in April 2012, the health department announced that New Woman All Women had been ordered to surrender its license by no later than May 18, 2012.\u00a0 The deficiencies included inadequately trained staff; failure to have policy and procedures related to medication errors and the administration of medications, which resulted in the hospitalization of three abortion patients, one of whom was placed in the ICU; no documentation indicating that Derzis&#8217; two abortionists were even licensed to perform abortions; inadequate preparation and administration of drugs, which led to overdoses and inadequate pain management; and use of uninspected equipment.<\/p>\n<p>Derzis, known as the \u201cabortion queen\u201d in the Southeast for owning Mississippi\u2019s only abortion facility, and abortionist Bruce Norman\u2014who also works at Derzis\u2019 Mississippi abortion business\u2014were ordered last year not to have any involvement with New Woman All Women.<\/p>\n<p>Pro-life leaders in Alabama were pleased with the results of yesterday\u2019s hearing.\u00a0 Father Terry Gensemer, director of the Charismatic Episcopal Church for Life <a title=\"said the decision\" href=\"http:\/\/www.cecforlife.com\/?p=1315\" target=\"_blank\">said the decision<\/a> \u201cgave the Alabama Department of Public Health a wide open door for shutting down Derzis\u2019 back-alley abortion mill.\u00a0 I truly pray that the Alabama Department of Public Health uses this opportunity to preserve the lives of Alabama women and children and close the doors of this facility for good.\u201d<\/p>\n<p>\u201cI just want to make sure this place stays closed because it hurts women,\u201d Kim Philpot of Birmingham 40 Days for Life <a title=\"said.\" href=\"http:\/\/www.cbs42.com\/2013\/05\/31\/lawsuit-against-birmingham-abortion-clinic-moves-forward\/\" target=\"_blank\">said<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The state of Alabama is moving forward with its charges against notorious Birmingham abortion center New Woman All Women, which has been operating illegally despite being ordered by the Alabama Department of Public Health to close after it sent two women to the hospital in one day. \u00a0The state is suing New Woman All Women [&hellip;]<\/p>\n","protected":false},"author":225,"featured_media":35884,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false},"categories":[4],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.7 -
