The group claimed the states&#8217; pro-life laws were violations of the group&#8217;s religious freedom, as the Satanic Temple believes abortion is a &#8220;ritual&#8221; and a &#8216;religious&#8217; rite; additionally, as satanists worship the notion of bodily autonomy, abortion is therefore allegedly a &#8216;religious&#8217; issue for them.<\/p>\n<p>The group\u2019s Third Tenet states that \u201c[o]ne\u2019s body is inviolable, subject to one\u2019s own will alone,\u201d which they use as a religious justification for abortion.<\/p>\n<p>\u201c(The Satanic Temple) venerates, but does not worship, the allegorical Satan described in the epic poem Paradise Lost \u2014 the defender of personal sovereignty against the dictates of religious authority,\u201d the lawsuits said, adding, \u201cAll of the Involuntarily Pregnant Women who are TST members believe the fetal tissue they carry in their uterus \u2013 from conception until viability \u2014 is part of their body and not imbued with any humanity or existence separate and apart from that of the Involuntarily Pregnant Woman herself.\u201d<\/p>\n<p>All a member must do to perform the so-called &#8220;<a href=\"https:\/\/archive.liveaction.org\/news\/satanic-temple-violate-religious-rite-abortion\/\" target=\"_blank\" rel=\"noopener\">religious rite<\/a>&#8221; of abortion is to recite a series of affirmations in front of a mirror while chemically aborting a child.<\/p>\n<div id=\"attachment_228566\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-228566\" decoding=\"async\" loading=\"lazy\" class=\"size-large wp-image-228566\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/08\/satanic-abortion-screenshot-700x351.jpg\" alt=\"\" width=\"700\" height=\"351\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/08\/satanic-abortion-screenshot-700x351.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/08\/satanic-abortion-screenshot-300x151.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/08\/satanic-abortion-screenshot-768x385.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/08\/satanic-abortion-screenshot-500x251.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2020\/08\/satanic-abortion-screenshot.jpg 1200w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><p id=\"caption-attachment-228566\" class=\"wp-caption-text\">Screenshot from Satanic Temple website<\/p><\/div>\n<p>Still, the lawsuit was <a href=\"https:\/\/archive.liveaction.org\/news\/judge-dismisses-satanic-temples-lawsuit-idaho\/\" target=\"_blank\" rel=\"noopener\">dismissed<\/a> in February of 2024 by Chief U.S. District Court Judge David C. Nye, saying that their claims \u201cwhile interesting, are convoluted and do not lead to the desired result.\u201d<\/p>\n<h2>The Details:<\/h2>\n<p>After appealing, the Ninth Circuit Court <a href=\"https:\/\/www.courthousenews.com\/satanic-temple-blocked-from-suing-over-idaho-abortion-ban\/\" target=\"_blank\" rel=\"noopener\">upheld<\/a> Nye&#8217;s decision, with U.S. Circuit Judge Margaret McKeown \u2014 who was appointed by Bill Clinton \u2014 plainly <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2025\/08\/satanic-temple-ninth-circuit-opinion.pdf\" target=\"_blank\" rel=\"noopener\">pointing out<\/a> that the Satanic Temple had no standing to sue to begin with.<\/p>\n<p>&#8220;TST, whose sole telehealth abortion clinic is in New Mexico, had not shown that one of its members has suffered or will imminently suffer an injury given that TST has no patients in Idaho, no doctors who are licensed to treat Idaho patients, and identified no Idaho citizen who sought an abortion from the organization,&#8221; she wrote. &#8220;The panel held that TST had not met its burden to show organizational standing. TST\u2019s argument that it diverted resources to open its New Mexico clinic to provide abortions in response to Idaho\u2019s and other states\u2019 abortion bans was insufficient to establish standing. The panel rejected TST\u2019s argument that its mission to promote abortions was frustrated by Idaho\u2019s law.&#8221;<\/p>\n<h2>The Bottom Line:<\/h2>\n<p>Attorney General Ra\u00fal Labrador celebrated the ruling in a <a href=\"https:\/\/www.krem.com\/article\/news\/local\/idaho\/appeals-court-dismissal-satanic-temples-lawsuit-idaho-abortion-law\/293-8dd09a81-e1e6-45a0-a22f-506cffd492ae\" target=\"_blank\" rel=\"noopener\">statement<\/a>, saying he will always protect preborn lives in Idaho.<\/p>\n<p>&#8220;I will always defend Idaho&#8217;s laws that protect families and preserve the sanctity of life,\u201d he said. \u201cThe Ninth Circuit Court of Appeals correctly found that the plaintiff lacked standing to challenge Idaho&#8217;s laws protecting mothers and their unborn children.
