(Washington, D.C., C-Fam<\/a>) The UN human rights committee focused on protecting children\u2019s rights continues to double down in favor of abortion for minors and against parental rights in its forthcoming general comment<\/a> focused on children\u2019s access to justice. The government of Argentina has spoken out strongly against it.<\/p>\n

The Committee on the Rights of the Child is the treaty body monitoring countries\u2019 compliance with the Convention on the Rights of the Child, which is the UN human rights treaty ratified by the most nations\u2014only the United States has not ratified it. The committee\u2019s general comments indicate how it will interpret the various articles of the treaty in its dialogues with member states.<\/p>\n

The new draft comment specifically mentions the lack of \u201caccess to safe abortion services for adolescent girls\u201d as a matter that would require \u201can effective remedy for a child rights violation\u201d where \u201ctime is of the essence.\u201d<\/p>\n

Argentina issued strong critical remarks, saying that \u201cthe draft requires substantial structural revisions.\u201d Specifically, Argentina pointed to its use of \u201cgender\u201d rather than \u201csex\u201d in several paragraphs and argues that the reference to abortion violates both national sovereignty and parental rights. Also, the draft confuses access to justice, a procedural guarantee, with \u201ca holistic fulfillment of rights.\u201d<\/p>\n

Argentina suggests the entire article may be duplicative, as \u201chas already been addressed in nearly half of the Committee on the Rights of the Child\u2019s general comments, including two dedicated ones.\u201d In summary, \u201c[i]n its current form, it exceeds the Committee\u2019s mandate under the Convention and the UN Charter, violating the principle of good faith in treaty interpretation.\u201d<\/p>\n
