Therefore, closures cannot be blamed on the defunding provision.<\/li>\n<\/ul>\n<h2>The Backstory:<\/h2>\n<p>On July 4, President Trump <a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/trump-signs-big-beautiful-bill-into-law\/ar-AA1HZMlj?ocid=BingNewsSerp\" target=\"_blank\" rel=\"noopener\">signed<\/a> the <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1\/text\/enr\">reconciliation bill<\/a>, partially defunding businesses that commit elective abortions for one year \u2014\u00a0including America\u2019s abortion giant, Planned Parenthood. The bill prohibits such businesses from receiving federal Medicaid reimbursements for one year unless they stop committing elective induced abortions.<\/p>\n<p>Planned Parenthood immediately <a href=\"https:\/\/archive.liveaction.org\/news\/obama-judge-temporarily-blocks-defunding-planned-parenthood\/\">filed<\/a> a lawsuit in a Boston federal court, and District Court Judge Indira Talwani, an Obama appointee, blocked the provision. The Center for Reproductive Rights followed that up with another lawsuit on behalf of the Maine Family Planning abortion chain, challenging the provision.<\/p>\n<h2>The Details:<\/h2>\n<p>Now, 22 abortion-supporting states plus the District of Columbia (including the governor of one state) have also filed a <a href=\"https:\/\/coag.gov\/app\/uploads\/2025\/07\/PP-defunding-complaint.pdf\">lawsuit<\/a> against the Trump administration \u2014 in the same federal court as Planned Parenthood&#8217;s own lawsuit \u2014 to secure federal taxpayer funding for Planned Parenthood.<\/p>\n<p>Plaintiffs in the lawsuit are Pennsylvania Governor Josh Shapiro along with attorneys general from these states plus the District of Columbia (D.C.): California, Connecticut, Colorado, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oregon, Rhode Island, Vermont, Washington, and Wisconsin.<\/p>\n<p>The lawsuit alleges that the Trump administration defunded Planned Parenthood in a targeted attack based on the group&#8217;s pro-abortion advocacy, and it makes a host of other arguments that fall flat.<\/p>\n<h3><strong>Claim #1: The defunding is due to abortion advocacy.<\/strong><\/h3>\n<p>The lawsuit claims (emphasis added), \u201cThe Defund Provision is a stand-alone provision that eliminates the use of federal funds for any health care obtained at Planned Parenthood health centers. Congress specifically designed the Defund Provision to target and punish PPFA and the Planned Parenthood health centers\u00a0<b data-stringify-type=\"bold\">for advocating for abortion access<\/b>.&#8221;<\/p>\n<p>The provision does not &#8220;punish&#8221; Planned Parenthood for &#8220;advocating for abortion access,&#8221; but states that family planning entities which commit elective abortions (not for rape\/incest, threat to mother&#8217;s life\/health) cannot receive federal Medicaid funding. Advocacy in favor of abortion access (or free speech) is not at issue in the case, according to the Department of Health and Human Services, which stated that it is action \u2014 not speech \u2014\u00a0that is impacted by the defunding provision.<\/p>\n<p>Even Planned Parenthood health centers and affiliates that no longer offer abortion themselves do more than simply &#8220;advocate&#8221; for abortion access; they <strong>refer<\/strong> abortion seekers directly to other Planned Parenthood centers that <em>do<\/em> provide abortions, and to resources like AbortionFinder.org \u2014 with which Planned Parenthood itself is a &#8220;<a href=\"https:\/\/www.abortionfinder.org\/about-us\">partner<\/a>,&#8221; Planned Parenthood affiliates and centers no longer offering abortions directly is <a href=\"https:\/\/www.plannedparenthood.org\/planned-parenthood-south-texas\/patients\/abortion-information\">still supporting abortion within the Planned Parenthood organization<\/a>.<\/p>\n<h3><strong>Claim #2: Defunding will &#8216;cripple&#8217; states&#8217; medical healthcare ecosystems.<\/strong><\/h3>\n<p>The lawsuit continues, &#8220;Congress has also forced the States to harm themselves, by either 1) crippling the States\u2019 medical healthcare ecosystems as Planned Parenthood health centers close or reduce hours and services, thereby increasing the States\u2019 long-term medical care costs or 2) using the States\u2019 own funds to keep those health centers operating\u2014and thereby foregoing matching federal funds.\u201d<\/p>\n<p>Some things to note:<\/p>\n<p><strong>1. Planned Parenthood has been <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-closures-restructuring-telehealth\/\" target=\"_blank\" rel=\"noopener\">shuttering its centers<\/a> and consolidating its services for <em>years.<\/em> <\/strong><\/p>\n<p>Early this year, in abortion-friendly Illinois, <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-illinois-restructures-downsizes-closing-centers\/\">the corporation closed four facilities<\/a> and encouraged clients to obtain services via its PP Direct app. Planned Parenthood affiliates have been closing or merging in various states while the company begins to put more of its eggs into the telehealth basket, so to speak.<\/p>\n<p>A January press release from Planned Parenthood stated, \u201cPPIL is planning on expanding appointment availability and access at the Champaign, Peoria, Springfield, and Roseland health centers as well as expanding virtual options via telehealth appointments and the PPDirect app to minimize patient disruption.\u201d<\/p>\n<p>This news came just a month after Planned Parenthood of Illinois\u2019 CEO Jennifer Welch resigned <a href=\"https:\/\/archive.liveaction.org\/news\/two-midwest-planned-parenthood-executives-step-down\/\">after nearly a decade<\/a>. Shortly after her resignation, abortionist Colleen McNicholas, medical director of the mega-center in Fairview Heights, Illinois (who formerly led the St. Louis Planned Parenthood \u2014 one of the most dangerous abortion businesses in the U.S.) also resigned.<\/p>\n<p>As previously reported by Live Action News, Planned Parenthood in Illinois saw a \u201c&#8217;47% increase in overall abortion care patients and an unprecedented number of out-of-state patients&#8217;\u201d but that &#8220;amazingly just isn\u2019t enough to sustain its business, despite the fact that PP of Illinois\u2019 most recent annual report <a href=\"https:\/\/www.plannedparenthood.org\/uploads\/filer_public\/67\/c6\/67c694d3-e7ee-405b-9e44-43c02893dabc\/ppil-ar-2023-web.pdf\">claims<\/a> that &#8216;In FY23, Illinois saw more out-of-state abortion patients than any other state in the country.&#8217; <strong>The affiliate ended fiscal year 2023 with <a href=\"https:\/\/www.plannedparenthood.org\/uploads\/filer_public\/67\/c6\/67c694d3-e7ee-405b-9e44-43c02893dabc\/ppil-ar-2023-web.pdf\">more than<\/a> $10 million in excess revenue<\/strong>.&#8221;<\/p>\n<p>It makes sense to close facilities within affiliates <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-victim-shift-virtual-business-model\/\">financially in the red<\/a>\u00a0\u2014 like Planned Parenthood Southwest Ohio Region, Planned Parenthood New England, and Planned Parenthood Mar Monte \u2014 but it is even closing facilities in affiliates with <em>millions in<\/em> <em>excess revenue<\/em>.<\/p>\n<p><strong>2. The defunding<\/strong> <em><strong>has not even begun<\/strong><\/em><strong> due to Judge Talwani&#8217;s decision to block it,<\/strong> <strong>so <em>how could it be causing<\/em> the Planned Parenthood closings that have happened and are currently happening?<\/strong><\/p>\n<p>As Live Action Research Fellow Carole Novielli <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-closures-restructuring-telehealth\/\" target=\"_blank\" rel=\"noopener\">pointed out<\/a>, &#8220;While Planned Parenthood shutters facilities and blames it on the defunding in the &#8216;Big Beautiful Bill&#8217; \u2014 which is not in effect and has been <a href=\"https:\/\/archive.liveaction.org\/news\/judge-preliminary-injunction-planned-parenthood-funded-lawsuit\/\">blocked<\/a> by a judge \u2014 is it actually experiencing a crisis, or is it manufacturing one to gain money and power?&#8221;<\/p>\n<p>She added:<\/p>\n<p style=\"padding-left: 40px;\"><em>Planned Parenthood <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-victim-shift-virtual-business-model\/\">had already chosen<\/a>\u00a0to move toward a more virtual business model in order to remain solvent, yet it has disingenuously chosen to blame federal Medicaid defunding for its facility closures and staff layoffs.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Restructuring, closures, and even the expansion of its telehealth program to <strong>ALL of its affiliates<\/strong>\u00a0began<strong>\u00a0long before<\/strong> any discussion of federal defunding.<\/em><\/p>\n<h3>Claim #3: States will have to dip into their own funding to keep Planned Parenthood locations open.<\/h3>\n<p>There is nothing that says states <em>must support<\/em> Planned Parenthood locations \u2014 they can simply choose to do so. They also have the right to defund Planned Parenthood from their own state Medicaid programs, <a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-states-defund-abortion-planned-parenthood\/\">according to a recent Supreme Court decision<\/a>.<\/p>\n<h3><strong>Claim #4: Defunding will have &#8216;devastating consequences&#8217; for citizens.<\/strong><\/h3>\n<p>The lawsuit states, &#8220;&#8230; the Defund Provision denies access to health centers that provide essential, lifesaving care, such as cancer screening and prevention, testing and treatment for sexually transmitted infections (STI), and family planning services, all in the name of retribution for PPFA and Planned Parenthood health centers\u2019 political advocacy. And the result is devasting [sic] consequences for those who will be denied care in the Plaintiff States, as well as negative impacts to the Plaintiff States themselves.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Today, I&#8217;m suing the Trump Administration alongside 22 other states to stop them from unlawfully defunding Planned Parenthood, which will rip away healthcare from thousands of Pennsylvanians.<\/p>\n<p>This unconstitutional decision threatens to close vital health care centers and deny\u2026<\/p>\n<p>\u2014 Governor Josh Shapiro (@GovernorShapiro) <a href=\"https:\/\/twitter.com\/GovernorShapiro\/status\/1950261591506669998?ref_src=twsrc%5Etfw\">July 29, 2025<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The &#8220;essential, lifesaving care&#8221; the plaintiffs speak of, such as cancer screening, STI testing and treatment, and so-called &#8216;family planning&#8217; services, have been dropping dramatically over the year at Planned Parenthood locations across the country, according to the organization&#8217;s own annual reports. Client numbers have also plummeted.<\/p>\n<p>As <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-closures-restructuring-telehealth\/\" target=\"_blank\" rel=\"noopener\">explained<\/a> by Novielli, &#8220;The number of clients seen by Planned Parenthood has been steadily declining.&#8221; Since 2006, it has &#8220;experienced a\u00a0<strong>nearly 33% decrease in clients<\/strong> from a record high of 3.1M in 2006.&#8221;<\/p>\n<p>Planned Parenthood&#8217;s 2023-2024 annual report revealed major declines in services in just one year, including:<\/p>\n<ul>\n<li>Contraceptive services: <strong>Down just over 1%<\/strong><\/li>\n<li>STI testing\/treatment: <strong>Down<\/strong><strong>\u00a011%<\/strong><\/li>\n<li>Overall cancer screenings: <strong>Down<\/strong><strong>\u00a08%<\/strong><\/li>\n<li>Breast screenings: <strong>Down<\/strong><strong>\u00a010%<\/strong><\/li>\n<li>Pap tests: <strong>Down<\/strong><strong> 12%<\/strong><\/li>\n<\/ul>\n<p>Meanwhile, abortions were up to a record high of over 402,000, an increase of 2.5% from the previous year, and taxpayer funding was up to $792.2 million, a 13% ($93 million) jump from the year before.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">We\u2019re suing the Trump Administration over its illegal attempt to defund Planned Parenthood in the reconciliation law.<\/p>\n<p>Federal funds don&#8217;t pay for abortions.<\/p>\n<p>This is purely retaliation against Planned Parenthood that will wreak havoc on healthcare services across the nation. <a href=\"https:\/\/t.co\/3q9kv4s0zj\">pic.twitter.com\/3q9kv4s0zj<\/a><\/p>\n<p>\u2014 Rob Bonta (@AGRobBonta) <a href=\"https:\/\/twitter.com\/AGRobBonta\/status\/1950245345180733713?ref_src=twsrc%5Etfw\">July 29, 2025<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>But the lawsuit also notes, &#8220;&#8230; the Defund Provision also incidentally sweeps in a couple of additional healthcare entities who provide abortion care. These entities are just collateral damage.&#8221;<\/p>\n<p>This actually appears to be an admission that Planned Parenthood&#8217;s business model is based around abortion.<\/p>\n<p><strong>Medicaid funds cannot be used for abortions<\/strong><\/p>\n<p>Medicaid funds cannot be used to <em>directly<\/em> pay for abortions themselves. However, when the finances of a business are linked \u2014 as Planned Parenthood&#8217;s abortion and health care services are linked \u2014 that money is fungible \u2014 meaning money that goes to Planned Parenthood is used to prop up the company&#8217;s staff, operating costs, etc., whether the facility or affiliate commits abortions, refers for abortions, or sells abortion pills virtually.<\/p>\n<h2>The Bottom Line:<\/h2>\n<p>The lawsuit is a desperate attempt to keep taxpayer money in Planned Parenthood&#8217;s pockets even as it has been shutting down its own centers, losing clients, decreasing its legitimate health care services, and switching its business to telehealth. Polling shows that the majority of Americans <em>oppose<\/em> taxpayer funding of abortion.
