It was immediately challenged by Planned Parenthood and the ACLU after its passage, and blocked in the courts.<\/p>\n<p>According to the <a href=\"https:\/\/ohiocapitaljournal.com\/2025\/07\/10\/ohio-judge-allows-telemedicine-abortion-care-for-a-third-time\/\" target=\"_blank\" rel=\"noopener\">Ohio Capital Journal<\/a>, the abortion industry later &#8220;amended its lawsuit, arguing that certain statutes regarding medical licensure in Ohio Administrative Code and Ohio Revised Code &#8216;could be read to preclude (advanced practice clinicians) from providing medication abortion care.'&#8221;<\/p>\n<p>Judge Alison Hatheway of the Court of Common Pleas in Hamilton County has now agreed with the plaintiffs. In her ruling, Hatheway said the regulations \u201ccould be read to preclude otherwise qualified (nurse practitioners) or (certified nurse midwives) from providing medication abortions merely because they are licensed by the Board of Nursing, not the (State) Medical Board.\u201d<\/p>\n<p>She also referenced the Ohio amendment passed by voters last November which made abortion a constitutional &#8220;right&#8221; in the state, saying the amendment \u201cgrants sweeping protections ensuring reproductive autonomy for patients in Ohio.\u201d She said the plaintiffs offered \u201csubstantial evidence\u201d that the law about medical licensure violates the abortion amendment \u201cand actually causes harm to plaintiffs and their patients.\u201d<\/p>\n<p>With Hatheway&#8217;s ruling, advanced practice clinicians who are not physicians are now free to act as abortionists.<\/p>\n<h2>Why it Matters:<\/h2>\n<p>The abortion pill has been shown to be <a href=\"https:\/\/archive.liveaction.org\/news\/study-abortion-pill-four-times-dangerous-surgical\/\" target=\"_blank\" rel=\"noopener\">four times more dangerous<\/a> than a first-trimester surgical abortion.<\/p>\n<p>A recent analysis of insurance data reported that <a href=\"https:\/\/archive.liveaction.org\/news\/study-nearly-11-serious-adverse-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">11% of women<\/a> who take the abortion pill experience sepsis, infection, hemorrhaging, or other serious or life-threatening complications. This rate is 22 times higher than the FDA reported complication rate on the mifepristone label. A separate study out of Ireland found that <a href=\"https:\/\/archive.liveaction.org\/news\/research-ireland-12-er-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">12% of women<\/a> went to the ER for bleeding or infection after taking the abortion pill.<\/p>\n<p>Women are at increased risk when taking the abortion pill via telemedicine, because they fail to receive an ultrasound or other standard testing to confirm the child&#8217;s gestational age and to ensure the pregnancy is not ectopic.<\/p>\n<h2>The Bottom Line:<\/h2>\n<p>Hatheway&#8217;s ruling was slammed by Ohio Right to Life, who <a href=\"https:\/\/ohiolife.org\/ohio-right-to-life-condemns-reckless-judicial-interference-in-womens-health\/\" target=\"_blank\" rel=\"noopener\">called it<\/a> &#8220;reckless judicial interference.&#8221;<\/p>\n<p>&#8220;The practice of medicine should be done by doctors, not lawyers who are diluting the practice of medicine and placing women\u2019s lives at risk.
