Jackson Women&#8217;s Health Organization<\/em> decision.<\/li>\n<li>AAPLOG <a href=\"https:\/\/archive.liveaction.org\/news\/lawsuit-mississippi-pro-life-law-clarification\/\" target=\"_blank\" rel=\"noopener\">filed a lawsuit<\/a> in 2022 seeking to have the Mississippi Supreme Court decision overturned, but it was dismissed in 2024 by a Hinds County judge for lack of standing.<\/li>\n<li>Under a new legal team, AAPLOG is appealing that ruling and asking the state Supreme Court to weigh in on the issue.<\/li>\n<\/ul>\n<h2>The Details:<\/h2>\n<p>American Dream Legal, a new non-profit, public interest law firm, is representing AAPLOG in the new case, with the firm <a href=\"https:\/\/www.americandreamlegal.org\/cases\/pro-life-doctors-defend-the-right-to-life\" target=\"_blank\" rel=\"noopener\">noting<\/a> that there is a legal contradiction in place in Mississippi. In the <em>Fordice<\/em> decision, the court determined that there was an &#8220;implicit&#8221; but not &#8220;explicit&#8221; constitutional right to abortion in Mississippi \u2014 even though there are currently laws in place protecting preborn children from abortion in the state, and abortion was also illegal in Mississippi at the time the state&#8217;s constitution was drafted.<\/p>\n<p>The firm wrote:<\/p>\n<p style=\"padding-left: 25px;\"><em>[W]hether elective abortions are \u201clawful\u201d in Mississippi depends on whether the Mississippi Supreme Court\u2019s opinion in Fordice is still valid. <\/em><\/p>\n<p style=\"padding-left: 25px;\"><em>This uncertainty keeps pro-life physicians in Mississippi in a state of constant legal peril. For that reason, American Dream Legal is representing the American Association of Pro-Life Obstetricians and Gynecologists (AAPLOG) in a case before the Mississippi Supreme Court. <\/em><\/p>\n<p style=\"padding-left: 25px;\"><em>Through its lawsuit, AAPLOG hopes to obtain a ruling that overturns Fordice and finally puts an end to court-imposed, elective abortion policy in the state that took down Roe.<\/em><\/p>\n<p>And while the 2024 ruling claimed that AAPLOG did not have standing, the new <a href=\"https:\/\/static1.squarespace.com\/static\/67d8c584754aba0d9d438854\/t\/6859913bec1499136b7998d5\/1750700348165\/AAPLOG%27s+Appellate+Brief+%286.23.25%29.pdf\" target=\"_blank\" rel=\"noopener\">appellate brief<\/a> filed for the Mississippi Supreme Court argues otherwise:<\/p>\n<p style=\"padding-left: 40px;\"><em>AAPLOG is an organization of obstetrician-gynecologists and other physicians who oppose elective abortion, including members in Mississippi, and so the interests it seeks are germane to the organization\u2019s purpose.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>AAPLOG physicians would have standing to sue in their own right on two separate grounds, either of which is independently sufficient to confer standing. <\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>First, they are adversely affected by the elective abortion ban\u2019s irreconcilable conflict with the Fordice opinion. Second, they are private citizens raising a constitutional conflict that is otherwise likely to escape judicial review.<\/em><\/p>\n<p>Aaron Rice, CEO of American Dream Legal and counsel for AAPLOG, <a href=\"https:\/\/apnews.com\/article\/mississippi-general-news-courts-abortion-mississippi-state-government-3554b5aba31a74ff66ae0b254da5dff0\" target=\"_blank\" rel=\"noopener\">said<\/a> these pro-life physicians are now \u201ccaught between conflicting legal duties: refer patients and risk prosecution under state law \u2014 or refuse to refer and risk professional ruin.\u201d<\/p>\n<h2>The Backstory:<\/h2>\n<p>With the <em>Dobbs<\/em> decision, both <em>Roe<\/em> and <em>Doe<\/em> were overturned. This, then, allowed a trigger law in Mississippi to take effect. Passed in 2007, it was certified by Mississippi Attorney General Lynn Fitch just days after <em>Dobbs<\/em>, and protected virtually all preborn children from abortion, with the only exceptions being cases where the mother\u2019s life is in danger, or when a woman has been raped, and the crime was reported to law enforcement.<\/p>\n<p>\u201cMississippi\u2019s laws to promote life are solid and thanks to the Court\u2019s clear and strong opinion in <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>, they can now go into effect,\u201d Fitch <a href=\"https:\/\/mississippitoday.org\/2022\/06\/27\/fitch-certifies-mississippis-trigger-law-banning-abortion-in-nearly-all-cases\/\" target=\"_blank\" rel=\"noopener\">said<\/a> at the time. \u201cAs we have said throughout this case, <em>Roe v. Wade<\/em> presented a false choice between a woman\u2019s future and her child\u2019s life. As we proceed in this post-<em>Roe<\/em> world, the people of Mississippi and of all the states will be able to fully engage in the work of both empowering women and promoting life.
