Pro-life states would also have less power to investigate out-of-state people suspected of illegally distributing abortion drugs by mail into the state.<\/p>\n<p>\u201cThe new protections that my Administration is putting in place are an important step forward in our fight to protect access to reproductive health care and ensure patient privacy and peace of mind,\u201d Biden said at the time in a statement. \u201cBy safeguarding patient information, the new rule will help health care providers give complete and accurate information to patients and improve the quality of health care.\u201d<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/zVk1qM1El9o?si=iyvSD-dfK7my9Fo8\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<h2>The Ruling:<\/h2>\n<p>The lawsuit was filed by ADF attorneys on behalf of Carmen Purl, M.D., who said the HHS rule could keep her from reporting the suspected abuse of a patient who may have been pressured into an abortion.<\/p>\n<p>In December, Judge Kacsmaryk had issued a <a href=\"https:\/\/archive.liveaction.org\/news\/judge-injunction-biden-abortion\/\" target=\"_blank\" rel=\"noopener\">temporary injunction<\/a> pending the outcome of the lawsuit, just one day before the rule was set to take effect. That decision, however, only exempted Purl from the rule; this week&#8217;s ruling blocks the rule nationwide.<\/p>\n<p>Kacsmaryk ruled <a href=\"https:\/\/adfmedia.org\/press-release\/texas-court-frees-nations-doctors-from-unlawful-biden-era-abortion-gender-health-privacy-changes\/\" target=\"_blank\" rel=\"noopener\">in favor of Purl<\/a>, saying that the Biden administration \u201cinvoked HIPAA as a shield against abortion-restrictive states.\u201d<\/p>\n<p>Kacsmaryk <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2025\/06\/judge-strikes-down-abortion-privacy-rule-usdc-texas-northern.pdf\">said<\/a> that, under the rule, HHS was attempting to protect politicized procedures only, adding that HIPAA does not allow HHS to \u201cdistinguish between types of health information to accomplish political ends.\u201d<\/p>\n<h2>Commentary:<\/h2>\n<p>ADF director of regulatory practice Matt Bowman praised the ruling in a <a href=\"https:\/\/adfmedia.org\/press-release\/texas-court-frees-nations-doctors-from-unlawful-biden-era-abortion-gender-health-privacy-changes\/\" target=\"_blank\" rel=\"noopener\">press release<\/a>.<\/p>\n<p>\u201cAs the court rightly found, doctors and states should be able to protect patients from abuse,\u201d he said. \u201cThis unlawful rule change would have weaponized laws about privacy that have nothing to do with abortion or gender identity.&#8221;<\/p>\n<p>He added, &#8220;The Biden administration attempted to undermine state laws that protect mothers and unborn children from the harms of abortion, and vulnerable children from dangerous and sterilizing procedures like puberty blockers, cross-sex hormones, and life-altering surgeries.\u201d<\/p>\n<p><a href=\"https:\/\/actnow.io\/G3Bhv6M\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-332271\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/06\/LA25DefundPP_EmailBannerAd-02-700x251.jpg\" alt=\"\" width=\"700\" height=\"251\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/06\/LA25DefundPP_EmailBannerAd-02-700x251.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/06\/LA25DefundPP_EmailBannerAd-02-300x107.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/06\/LA25DefundPP_EmailBannerAd-02-768x275.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/06\/LA25DefundPP_EmailBannerAd-02-500x179.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/06\/LA25DefundPP_EmailBannerAd-02.jpg 1167w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge struck down a &#8220;special rule&#8221; implemented by the Biden administration to expand privacy protections specifically for abortion.
