Mifepristone (200mg), approved by the FDA in 2000 as the abortion pill for use in a regimen with a second drug (off-label) called misoprostol, was placed under the REMS after serious adverse events <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-dangerous-safety-requirement\/\" target=\"_blank\" rel=\"noopener\">resulted<\/a> in the deaths of multiple women.<\/p>\n<p>The FDA <a href=\"https:\/\/www.fda.gov\/drugs\/drug-safety-and-availability\/risk-evaluation-and-mitigation-strategies-rems\" target=\"_blank\" rel=\"noopener\">defines<\/a> REMS as:<\/p>\n<p style=\"padding-left: 40px;\"><em>a drug safety program that the&#8230; FDA can require for certain medications with serious safety concerns to help ensure the benefits of the medication outweigh its risks. REMS are designed to reinforce medication use behaviors and actions that support the safe use of that medication.<\/em><\/p>\n<p>Abortion pills have a black box warning on the <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2023\/020687Orig1s026lbl.pdf\" target=\"_blank\" rel=\"noopener\">label<\/a> for risk of hemorrhage, sepsis, and <a href=\"https:\/\/archive.liveaction.org\/news\/emergency-room-visits-abortion-pill-tens-thouands\/\" target=\"_blank\" rel=\"noopener\">other life threatening conditions<\/a>.<\/p>\n<p>FDA&#8217;s <a href=\"https:\/\/www.accessdata.fda.gov\/scripts\/cder\/rems\/index.cfm?event=RemsDetails.page&amp;REMS=390\" target=\"_blank\" rel=\"noopener\">REMS website<\/a> states that the goal is &#8220;to mitigate the risk of serious complications&#8230;&#8221; by:<\/p>\n<ul>\n<li><em>Requiring healthcare providers who prescribe mifepristone to be certified&#8230;<\/em><\/li>\n<li><em>Ensuring that mifepristone is only dispensed by or under the supervision of certified prescribers, or by certified pharmacies on prescriptions issued by certified prescribers.<\/em><\/li>\n<li><em>Informing patients about the risk of serious complications associated with mifepristone.<\/em><\/li>\n<\/ul>\n<p>Currently the full <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/rems\/Mifepristone_2023_03_23_REMS_Full.pdf\" target=\"_blank\" rel=\"noopener\">REMS<\/a>\u00a0includes a <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/rems\/Mifepristone_2023_03_23_Patient_Agreement_Form.pdf\" target=\"_blank\" rel=\"noopener\">patient agreement<\/a>, <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/rems\/Mifepristone_2023_03_23_Prescriber_Agreement_Form_for_Danco_Laboratories_LLC.pdf\" target=\"_blank\" rel=\"noopener\">prescriber agreement<\/a>, and <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/rems\/Mifepristone_2023_03_23_Pharmacy_Agreement_Form%20_for_Danco_Laboratories_LLC.pdf\" target=\"_blank\" rel=\"noopener\">pharmacy agreement<\/a>.<\/p>\n<h3><strong>THE DETAILS:<\/strong><\/h3>\n<p><strong>1. The pro-abortion states want all safety protocols removed \u2014 just for them. <\/strong><\/p>\n<p>Their <a href=\"https:\/\/www.mass.gov\/doc\/rems-mifepristone-citizen-petition\/download?utm_source=substack&amp;utm_medium=email\" target=\"_blank\" rel=\"noopener\">citizen petition<\/a> seeks to (emphases added):<\/p>\n<p style=\"padding-left: 40px;\"><em>&#8230; <strong>remove the current shared system risk evaluation and mitigation strategy program<\/strong>, known as the Mifepristone REMS Program, for Mifeprex and its generic, Mifepristone Tablets, 200 mg&#8230; <\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Alternatively, Petitioner States ask FDA to exercise its discretion <strong>not to enforce certain aspects<\/strong> of the Elements to Assure Safe Use \u2014 <strong>specifically, the Prescriber Certification, Patient Certification, and Pharmacy Certification elements <\/strong>\u2014 in Petitioner States <strong>given the rigorous regulations already in place around the practice of medicine<\/strong>.\u00a0<\/em><\/p>\n<p>To support their petition, the States cite pro-abortion organizations masquerading as unbiased medical groups \u2014\u00a0such as the <a href=\"https:\/\/archive.liveaction.org\/news\/top-myths-debunked-american-college-obstetricians-gynecologists\/\" target=\"_blank\" rel=\"noopener\">American College of Obstetricians and Gynecologists<\/a> (ACOG) \u2014\u00a0as well as <a href=\"https:\/\/archive.liveaction.org\/news\/new-york-times-overlooks-facts-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">studies<\/a> authored by <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-money-trail-abortion-pill-corruption\/\" target=\"_blank\" rel=\"noopener\">pro-abortion<\/a> heavy hitters, some of whom might be on the <a href=\"https:\/\/archive.liveaction.org\/news\/media-abortion-experts-payroll-manufacturers\/\" target=\"_blank\" rel=\"noopener\">payroll<\/a> of the manufacturer or <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-money-trail-abortion-pill-corruption\/\" target=\"_blank\" rel=\"noopener\">funded<\/a> by abortion pill investors.<\/p>\n<p><strong>2. The states admit the majority of abortions there are already done by abortion pill, yet they claim the safety regulations are &#8220;burdensome.&#8221;<\/strong><\/p>\n<p>The states note that &#8220;Medication abortion is the primary means by which patients access abortion in the Petitioner States,&#8221; listing the following percentages for abortions done by abortion pill in 2023:<\/p>\n<ul>\n<li>Massachusetts: 65% of abortions<\/li>\n<li>California: 71% of abortions<\/li>\n<li>New York: 58% of abortions<\/li>\n<li>New Jersey: 57% of abortions<\/li>\n<\/ul>\n<p>The REMS has been in place through <a href=\"https:\/\/archive.liveaction.org\/news\/fda-abortion-pill-timeline-events\/\" target=\"_blank\" rel=\"noopener\">multiple pro-abortion administrations,<\/a> and clearly the majority of abortions in the Petitioner States are done by pill \u2014 yet they claim the requirements are &#8220;unnecessary, duplicative, and burdensome.&#8221;<\/p>\n<p>They claimed the abortion pill has a &#8220;well-established, 25-year safety record,&#8221; making current restrictions &#8220;no longer justified by science or law, particularly in the Petitioner States where the right to abortion is legal, protected, and comprehensively regulated by state law.&#8221;<\/p>\n<p>Despite these states&#8217; <a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-shield-laws-prosecution-states\/\" target=\"_blank\" rel=\"noopener\">shield laws<\/a> (which protect <em>abortion providers<\/em> instead of <a href=\"https:\/\/archive.liveaction.org\/news\/shielding-abortion-providers-consequences-women-risk\/\" target=\"_blank\" rel=\"noopener\">women<\/a>), virtually zero abortion regulations, and <a href=\"https:\/\/archive.liveaction.org\/news\/increased-numbers-abortion-pill-stockpiling\/\" target=\"_blank\" rel=\"noopener\">abortion pill stockpiling<\/a>, the states claimed they have &#8220;robust legal and regulatory protections in place to rigorously oversee the medical professions, maximize patient safety, and ensure informed consent,&#8221; in the Petitioner States, the fact is that the abortion industry already <em><strong>isn&#8217;t following most of the safety protocols<\/strong><\/em>; Big Abortion has been <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-industry-fda-rules-risking-safety\/\" target=\"_blank\" rel=\"noopener\">openly flouting<\/a> the REMS for decades.<\/p>\n<p>The <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/rems\/Mifepristone_2023_03_23_REMS_Full.pdf\" target=\"_blank\" rel=\"noopener\">March 2023 REMS<\/a> seem <em>entirely reasonable<\/em> \u2014 especially given that these states claim to provide such exemplary medical care. The REMS <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/rems\/Mifepristone_2023_03_23_Prescriber_Agreement_Form_for_Danco_Laboratories_LLC.pdf\" target=\"_blank\" rel=\"noopener\">require<\/a> that a certified prescriber of mifepristone must be able to:<\/p>\n<ul>\n<li><em>&#8230; Assess the duration of pregnancy accurately <\/em><\/li>\n<li><em>&#8230; Diagnose ectopic pregnancies <\/em><\/li>\n<li><em>&#8230; Provide surgical intervention in cases of incomplete abortion or severe bleeding, or to have made plans to provide such care through others<\/em><\/li>\n<li><em>&#8230; Assure patient access to medical facilities equipped to provide blood transfusions and resuscitation, if necessary.<\/em><\/li>\n<\/ul>\n<p>In addition, a prescriber must make sure that the &#8220;Patient Agreement Form is reviewed with the patient and the risks of the mifepristone treatment regimen are fully explained.&#8221;<\/p>\n<div id=\"attachment_311134\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-311134\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-311134\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/04\/March-2023-FDA-prescriber-agreement-for-Mifepristone.jpg\" alt=\"March 2023 FDA prescriber agreement for Mifepristone\" width=\"600\" height=\"431\" aria-describedby=\"caption-attachment-311134\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/04\/March-2023-FDA-prescriber-agreement-for-Mifepristone.jpg 871w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/04\/March-2023-FDA-prescriber-agreement-for-Mifepristone-300x216.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/04\/March-2023-FDA-prescriber-agreement-for-Mifepristone-700x503.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/04\/March-2023-FDA-prescriber-agreement-for-Mifepristone-768x552.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/04\/March-2023-FDA-prescriber-agreement-for-Mifepristone-500x359.jpg 500w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><p id=\"caption-attachment-311134\" class=\"wp-caption-text\">March 2023 FDA prescriber agreement for Mifepristone<\/p><\/div>\n<h4><strong>Here&#8217;s what Big Abortion has<em> not<\/em> been doing, despite these prescriber requirements:<\/strong><\/h4>\n<p style=\"padding-left: 40px;\"><strong>1. <em>Not properly dating pregnancies and not limiting use of the drug to <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-industry-abortion-pills-arent-pregnant\/\" target=\"_blank\" rel=\"noopener\">confirmed pregnancies<\/a>. <\/em><\/strong><\/p>\n<p style=\"padding-left: 40px;\">The FDA has approved the abortion pill up to 10 weeks\/70 days gestation, but Big Abortion <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-industry-abortion-pill-fda-limits\/\" target=\"_blank\" rel=\"noopener\">advertises<\/a> the <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-advertises-abortion-pill-fda-limits\/\" target=\"_blank\" rel=\"noopener\">abortion pill<\/a> into the <a href=\"https:\/\/archive.liveaction.org\/news\/reports-abortion-pill-kill-babies-late-pregnancy\/\" target=\"_blank\" rel=\"noopener\">second trimester<\/a> and is pushing to have it <a href=\"https:\/\/archive.liveaction.org\/news\/reports-abortion-pill-kill-babies-late-pregnancy\/\" target=\"_blank\" rel=\"noopener\">used<\/a> in the <a href=\"https:\/\/archive.liveaction.org\/news\/group-recommends-abortion-pill-third-trimester\/\" target=\"_blank\" rel=\"noopener\">third trimester<\/a>.<\/p>\n<p style=\"padding-left: 40px;\"><strong>2. <em>Not doing proper testing before giving out the pill.<\/em><\/strong><\/p>\n<p style=\"padding-left: 40px;\">The &#8220;<a href=\"https:\/\/archive.liveaction.org\/news\/alarming-abortion-pill-ultrasounds-guess\/\" target=\"_blank\" rel=\"noopener\">no-test<\/a>&#8221; abortion pill protocol removes testing, blood work, and labs and often <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-abortion-pill-fda-ectopic\/\" target=\"_blank\" rel=\"noopener\">does not diagnose potentially dangerous ectopic pregnancies<\/a>, prompting <a href=\"https:\/\/archive.liveaction.org\/news\/alert-er-docs-undiagnosed-ectopic-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">pro-abortion doctors to warn ER staff<\/a> that they may see more undiagnosed ectopics.<\/p>\n<p style=\"padding-left: 40px;\"><strong>3.<\/strong> <em><strong>Not spending <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-care-mere-minutes-follow-up\/\" target=\"_blank\" rel=\"noopener\">enough time<\/a> reviewing risks with abortion pill clients.<\/strong> <\/em><\/p>\n<p style=\"padding-left: 40px;\">It is doubtful most mention the drug&#8217;s serious black box warning. Instead, they <a href=\"https:\/\/archive.liveaction.org\/news\/baseless-abortion-pill-safer-than-tylenol\/\" target=\"_blank\" rel=\"noopener\">falsely<\/a> tout the drug as &#8220;safer than Tylenol&#8221; while pocketing profits.<\/p>\n<p style=\"padding-left: 40px;\"><strong>4. <em>Not providing continuity of care.<\/em><\/strong><\/p>\n<p style=\"padding-left: 40px;\">The abortion industry <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-conceal-abortion-pill-complications\/\" target=\"_blank\" rel=\"noopener\">advises women to present to the ER<\/a> and claim to be experiencing a natural miscarriage \u2014 a scheme to <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-complications-buried-for-decades-in-abortion-industry-plot-to-hide-the-truth\/\" target=\"_blank\" rel=\"noopener\">hide abortion pill complications<\/a>.<\/p>\n<p style=\"padding-left: 40px;\">Some conducting clinical trials to expand use of the abortion pill have <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-conceal-abortion-pill-complications\/\" target=\"_blank\" rel=\"noopener\">suggested<\/a> that <a href=\"https:\/\/archive.liveaction.org\/news\/media-blame-pro-life-abortion-pill-er\/\" target=\"_blank\" rel=\"noopener\">emergency room<\/a> staff should lie to cover adverse events. This <a href=\"https:\/\/archive.liveaction.org\/news\/big-abortion-avoids-buries-pill-complications\/\" target=\"_blank\" rel=\"noopener\">fraudulent scheme<\/a> keeps prescribers in the dark so they do not have to report complications up the chain, and it makes the abortion pill appear safer than it really is.<\/p>\n<p style=\"padding-left: 40px;\">As <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-complications-buried-for-decades-in-abortion-industry-plot-to-hide-the-truth\/\" target=\"_blank\" rel=\"noopener\">documented<\/a> by Live Action News, prior to 2016, prescribers of the drug were required to report <strong>all<\/strong> adverse events to Danco (the manufacturer) which then reported them to the FDA. Since that time, they&#8217;ve only had to report deaths.<\/p>\n<h3><strong>BEHIND THE CURTAIN:<\/strong><\/h3>\n<p>The Petitioner States deny what is printed in black and white.<\/p>\n<p><strong>Lie #1: It&#8217;s not the abortion pill that causes women to hemorrhage; that&#8217;s just how abortion is.<\/strong><\/p>\n<p>Mifepristone\u2019s <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2023\/020687Orig1s026lbl.pdf\" target=\"_blank\" rel=\"noopener\">2023 label<\/a> contains a black box warning and states that 2.9-4.6% of women who take abortion drugs end up in the ER (<a href=\"https:\/\/archive.liveaction.org\/news\/emergency-room-visits-abortion-pill-tens-thouands\/\" target=\"_blank\" rel=\"noopener\">indicating<\/a> potentially <em>tens of thousands<\/em> of abortion pill-related visits annually), and the FDA&#8217;s\u00a0<a href=\"https:\/\/www.earlyoptionpill.com\/wp-content\/uploads\/2023\/03\/DANCO_MedGuide_ENG_Web.pdf\" target=\"_blank\" rel=\"noopener\">medication guide<\/a> notes as many as seven percent (7%) of women will need surgery after \u2018to stop bleeding\u2019 or complete the abortion.<\/p>\n<p>Yet, the Petitioner States claim, &#8220;the risk of heavy bleeding is not caused by mifepristone; rather, it is the pregnancy termination that may lead to heavier than normal bleeding in some patients,&#8221; and:<\/p>\n<p style=\"padding-left: 40px;\"><em>There is no evidence that mifepristone requires long-term therapy or threatens serious adverse events immediately after administration&#8230;. mifepristone itself does not cause serious infection. These violations continue along with secrecy, as even the <em>number<\/em> of prescribers was considered &#8220;confidential commercial information&#8230; not publicly available from FDA&#8221; when Live Action News sought this information.
