Yet there was <a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-new-york-abortions-birth\/\" target=\"_blank\" rel=\"noopener\">little to celebrate<\/a> about this law; it allows abortion through all nine months of pregnancy, so long as the mother&#8217;s life or health is deemed to be at risk, which is an easily-exploited loophole. It is up to the abortionist to decide if an abortion can be considered &#8220;medically necessary.&#8221;<\/p>\n<p>As Cuomo pointed out, both <em>Roe v. Wade<\/em> and <em>Doe v. Bolton<\/em> were the inspiration for this legislation; under <em>Doe<\/em> specifically, \u201chealth of the mother\u201d meant virtually anything \u2014 physical, emotional, psychological, familial, and even age.<\/p>\n<p>The law also removed protections for abortion survivors, allowing them to be left to die if they are born alive after the procedure, and changed homicide laws to <em>exclude<\/em> fetal victims.<\/p>\n<h3><strong>THE DETAILS:<\/strong><\/h3>\n<p>In 2021, the Thomas More Society filed a <a href=\"https:\/\/archive.liveaction.org\/news\/class-action-lawsuit-new-york-governor-abortion\/\" target=\"_blank\" rel=\"noopener\">class-action lawsuit<\/a> against the law, asking the court:<\/p>\n<ul>\n<li><em>to acknowledge First Amendment rights for women whose unborn children are killed by assailants, <\/em><\/li>\n<li><em>to clarify dangerous ambiguities in the RHA that impact women,<\/em><\/li>\n<li><em> and to affirm existing, but previously unrecognized, rights for near-term unborn children and children who survive abortion.<\/em><\/li>\n<\/ul>\n<p>As their press released state, it is the first time a New York abortion law had been challenged for violating not only women&#8217;s rights, but the rights of children, including viable preborn children. A social worker, named &#8220;Mary Doe&#8221; in the suit, was named as the plaintiff.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/jAbRlqcIsNc?si=zroK7jBFqHMkiXJD\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p>The U.S. Court of Appeals for the Second Circuit ruled against the Thomas More Society, however, claiming that they had <a href=\"https:\/\/www.courthousenews.com\/second-circuit-rejects-challenge-to-ny-abortion-law\/\" target=\"_blank\" rel=\"noopener\">no standing<\/a> to bring the lawsuit. &#8220;[Doe] failed to identify or otherwise describe any class member in the viable fetus class that she sought to represent,\u201d U.S. Circuit Judge Richard Sullivan wrote in the ruling.<\/p>\n<p>Yet this ruling also avoided the question of whether or not preborn children are human beings, meaning they would be eligible to the right to life under the United States Constitution.
